TERMS AND CONDITIONS

This document outlines the terms and conditions and privacy statement (“Statement”) of the competition being promoted and conducted on The Good Meal Co. Gluten Free product packages.
 
1. The promoter is The Kuisine Company Pty Ltd (“Promoter”, “The Kuisine Company”) (ABN 59 147 334 101) of 37 Bromley Road, Emu Plains, NSW 2750, Australia. Tel: 02 4735 8200 (International +61 2 4735 8200). The Good Meal Co is a trademark and brand registered by and owned by The Kuisine Company Pty Ltd.
 
2. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.
 
3. Entry is only open to individuals who reside within Australia aged 18 years or above. Employees (and their immediate families) of the promoter are ineligible to enter. Immediate family refers to any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, brother, sister, step-brother, step-sister or 1st cousin.
 
4. The competition commences on 21/11/2016 and closes at 23:59 (11:59pm) AEST on 31/03/2017 (“Competition Period”).
 
5. To enter the competition, eligible individuals must purchase a Good Meal Co. Gluten Free product and enter their details in the form on The Kuisine Company’s website.
 
6. Only one (1) entry is permitted per product purchased.
 
7. The Promoter reserves the right, at any time, to verify the validity of entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and Omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
 
8. If there is dispute as to identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
 
9. All draws will take place at The Kuisine Company, 37 Bromley Road, Emu Plains, NSW 2750, Australia. The first prize will be drawn at 17:00 (5:00pm) AEST on 30/12/2016. The second prize will be drawn at 17:00 (5:00pm) AEST on 31/01/2017. The third prize will be drawn at 17:00 (5:00pm) AEST on 28/02/2017. The fourth prize will be drawn 17:00 (5:00pm) AEST on 31/03/2017.
The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner is drawn based on a random selection. The winner will be notified by Email Message within two (2) business days of the draw.
 
10. The Promoter’s decision is final and no correspondence will be entered into.
 
11. The winner of the prize will receive a Supermarket Voucher valued at $500. The winner will be given the opportunity to choose a Coles or Woolworths voucher. The voucher is subject to two (2) years expiry from the issue date. The expiration date will be stated on the voucher card once issued to the winner. The Promoter does not take any responsibility in the reissuing of a second voucher card if the initial card issued expires.
 
12. Any ancillary costs associated with the redemption of the voucher, such as transport to and from the supermarket retail outlet, are not included. Any unused balance of the voucher will not be awarded as cash. Redemption of the Gift Voucher is subject to the Terms and Conditions of the issuer including those specified on the Gift Voucher.
 
13. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.
 
14. If the prize in unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
 
15. Total prize value is $2000 (four (4) $500 vouchers, one (1) drawn at the end of every month from December 2016 to March 2017). Prizes, or any unused portion of the prize, are
not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
 
16. A draw for any unclaimed prizes may take place after seven (7) days after the initial draw at the same time and place as the original draw (stated in clause 9), subject to any written directions from a regulatory authority. This winner will be notified by Email Message within two (2) business days of the draw.
 
17. Entrants consent to the Promoter using their name (first name and last name initial) and their suburb of residence in the event they are the winner in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
 
18. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reasons beyond reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.
 
19. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under ASIC Act or similar consumer protection laws in the States or Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including Non-Excludable Guarantee, the Promoter (including respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss of damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including Non-Excludable Guarantee, the Promoter (including respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss of damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third-party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation to the prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; (f) use of prize.
 
21. The Promoter collects personal information (“PI”) such as Name, Email Address and Mailing Address to conduct the competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will contact the winner once drawn to source a mailing address to distribute the prize. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.kuisine.com.au/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants may opt out, access, update or correct their PI by using our Contact Form provided on our website or clicking the link on the bottom of all emails sent by the Promoter. By entering this competition, entrants automatically consent that the Promoter will use their PI for the purposes stated above. All entries become the property of the Promoter.
