1. This promotion – “The Oscars® Win a HOYTS Gift Card!” (“Promotion”) is conducted by The HOYTS Corporation Pty. Limited, of Level 50, 680 George Street, Sydney, NSW 2000, ABN 31 006 082 551 (“Promoter”).
2. Information regarding prizes and how to enter forms part of these Terms and Conditions. Submission of an entry into this promotion is deemed to be acceptance of these Terms and Conditions. Entries not completed in accordance with these Terms and Conditions are ineligible.
3. Entry is only open to HOYTS Rewards members who are permanent residents of NSW, ACT, VIC, QLD, SA & WA who have opted in to receive email communications. Directors, management and employees (and their immediate families) of the Promoter, participating retailers, agencies and companies associated with this Promotion are ineligible to enter. Entrants who are under the age of 18 years old must obtain their parent’s consent before entering. If a winner is under the age of 18 they must provide details of a parent or guardian aged over 18 years of age to accept the prize on their behalf.

5. The Promotion commences at 12:01am AEDST on 26 January 2017 and final entries close at 11.45 pm AEDST on 26 February 2017 (the “Promotional Period”). To be a valid entry, all of the necessary information must be included with an entry and the entry must be received by the Promoter during the Promotional Period.
How to Enter
6. HOYTS Rewards members must have completed the HOYTS Rewards membership sign-up and activation process online and checked the box ‘Please send me weekly newsletters & HOYTS offers’ in the Subscriptions section of Update Details in the HOYTS Rewards section of the Hoyts website

7. HOYTS Rewards members are required to present themselves as a HOYTS Rewards member when purchasing a ticket to an Eligible Movie in person in cinema or log in as a HOYTS Rewards members if buying online at
www.hoyts.com.au when purchasing tickets to an Eligible Movie showing during the Promotional Period at participating HOYTS Cinemas in NSW, ACT, VIC, QLD, WA or SA. Eligibility is based on one (1) entry per unique Eligible Movie transaction only. For clarity members who see the same Eligible Movie more than once will only be eligible to complete one entry, regardless of the number of times they see the specific movie. If the member purchases tickets for, and views an additional movie that is also an Eligible Movie during the Promotional Period, they will receive 1 entry for each unique Eligible Movie they see at Hoyts during the Promotional Period. Eligible HOYTS Rewards members who meet the above requirement will receive an email the next day after their purchase if they have opted in to receive weekly newsletters & HOYTS offers with a link to complete their entry.
8. To submit their entry, HOYTS Rewards members must follow the link provided in the e-mail sent by HOYTS, and they will be asked to provide their HOYTS Rewards email address (the email address associated with their HOYTS Rewards Membership which can be found at
www.hoyts.com.au/myhoyts sign in, edit details) and respond with who they think will win this year’s Academy Awards® in the various categories and will also be required to complete a tie-breaker question for use if a tie occurs. A valid entry will require a HOYTS Rewards member to answer seven (7) separate multiple choice questions and one (1) tie-breaker question. All entries must be submitted by 11:59pm AEDST on Sunday 26 February 2017.
9. The seven (7) multiple choice 89th Academy Award® category questions are as follows: best performance by an actor in a leading role, best performance by an actor in a supporting role, best performance by an actress in a leading role, best performance by an actress in a supporting role, achievement in costume design, best motion picture and achievement in visual effects. The tie-breaker question is 'If you were accepting an Oscar and the music started to play what would you do that is out of the ordinary to continue your acceptance speech?'.
10. Entrants must retain proof of purchase to verify eligibility for entry if required.
11. Entries are deemed to be received at the time of receipt into the Promoter’s database, not the time of transmission by the entrant.
Prizes
12. Upon the release of the official results of the 89th Academy Awards®, each correct answer received will be awarded one (1) point.
13. The valid entry with the highest number of correct answers in total will win the Major Prize. The next two (2) valid entries with the highest number of correct answers will win the Runner-Up Prizes. In the event of a tie for a place (1st, 2nd and 3rd) each tied member’s tie-breaker answer will be used to determine the winners. The Major Prize winner and runners up will be notified by email within two (2) days of being determined.
14. The Promoter’s decision is final and no correspondence will be entered into. The Major Prize Draw winner and runners up will have their name(s) published online at
www.hoyts.com.au in March 2017.
15. The Major Prize winner will receive a HOYTS $500 Gift Card.
16. The winner of the second Runner Up Prize will receive a HOYTS $200 Gift Card.
17. The winner of the third Runner Up Prize will receive a HOYTS $100 Gift Card.
18. For the sake of clarity, there is one (1) Major Prize valued at $500 AUD and two (2) Runner Up Prizes, valued at $300 AUD combined.
HOYTS Gift Cards can be redeemed in any HOYTS cinema in NSW, ACT, VIC, QLD, WA or SA upon presentation of a valid HOYTS Gift Card. All prizes must be taken as offered and are not exchangeable, transferable or redeemable for cash.
General
19. The total prize pool is valued at up to $800 AUD including GST.
20. All prizes must be taken as offered. No portion of the prizes are redeemable for cash. All prizes are non- refundable, exchangeable or transferable. The prizes cannot be used in conjunction with any other special offer. The prizes are valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize values. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way. The Promoter and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit.
21. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
22. All entries become the property of the Promoter. The Promoter’s decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the Promoter. Entries will be deemed void if incomplete, indecipherable, illegible, stolen, forged or mutilated in any way.
23. If any prize is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute that prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. The Promoter accepts no other liability or responsibility for any loss.
24. If any of the prize winners cannot be contacted or do not claim the prizes by 12.00pm (AEST) on 2 April 2017, the Promoter reserves the right to award those prizes to the next eligible winner based on the same criteria as the original winners. In the event the original prize winners do not claim their prize by 2 April 2017, the subsequent winner’s details will be published online at
www.hoyts.com.au on 9 April 2017.
25. In the event subsequent winners cannot be contacted or do not claim their prize within 4 weeks of an attempted notification by the Promoter, the Promoter is permitted to determine further subsequent winners in accordance with clause 25 of these Terms and Conditions. Subsequent Prize winners, if any, will be contacted by phone or in writing within two (2) days of the date they are identified.
26. If for any reason the conduct or operation of the Promotion is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion, subject to the approval of the authorities that have issued permits for its conduct.
27. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication including any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, or otherwise, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Promotion (whether as a result of one of the foregoing causes or otherwise).
28. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
29. The Promoter assumes no responsibility for, and the entrant releases the Promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant’s participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrant’s error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion’s administration, security, fairness or integrity are compromised or affected, the Promoter may (where necessary with the approval of the relevant Department) cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion in any way.
30. Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described.
