Terms and Conditions

Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is only open to Australian and New Zealand residents aged 18 years or over.

Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

The promotion commences at 12.01am on 09/05/2017 and final entries close at 11:59pm AEST on 31/07/2017 (“Promotional Period”).

To enter, individuals must input the requested details (including their full name and a valid email address) and submit the fully completed entry form so that it is received during the Promotional Period.

Incomplete or indecipherable entries will be deemed invalid.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

The draw will take place at Intrepid Travel of 567 Collins Street, Melbourne, VIC 3000 on 08/08/2017 at 12noon AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

The winner will be notified by email within two (2) business days of the draw on 10 August 2017 and on the Intrepid Travel website www.intrepidtravel.com/asiacomp.

The Promoter’s decision is final and no correspondence will be entered into.

Total prize pool value is $5,000.

The first valid entry drawn will win a $ 5,000 Intrepid Travel voucher to use towards an Intrepid tour of their choice. The prize package has a prize value of up to $5,000 and cannot be split up into different packages and must be taken at once. Prizes are not exchangeable, are not transferrable [to another traveller] and cannot be redeemed for an equivalent cash value. Travellers must be 18 years to qualify. The trip must be booked with Intrepid Travel and confirmed before 31 December 2017. Travel must be completed before 30 June 2018. No extension is available. It is the winner's responsibility to ensure the voucher is used within the specified timeframe. If the Intrepid trip is over $5,000 the additional cost will be at the prize winner’s expense. If the Intrepid trip is under $5,000 the remaining balance will be forfeited. The trip is subject to availability and confirmation by Intrepid Travel. All components of the prize must be taken together or otherwise are deemed to be forfeited. A minimum of 4 travellers must be confirmed on the Intrepid trip for the for prize winner booking to be confirmed on their requested date, please check at time of booking. Travel Insurance is required to be held by all Intrepid travellers & is not included in the prize. Voucher cannot be used towards Intrepid small group adventures in Antarctica, Arctic, Expeditions, Urban Adventures, Short Break Adventures or third party operated trips. International flights, upgrades, domestic flights, travel insurance, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, passports, travel visas required, any other transport as required to and from departure point, single supplement and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. There is no cash value to this prize & cannot be exchanged or transferred. The trip must be taken by 30 June 2018 otherwise it will be deemed to be forfeited by the winner. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner. Standard booking conditions apply. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. In the event of war, terrorism, state of emergency, disaster or any other circumstance beyond the control of the Promoter,  the Promoter reserves the right to either provide an alternative travel destination to the same value as the original prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion. Please note that the Intrepid marketing team may contact the winner post travel for feedback on the trip. It is the winner’s responsibility to ensure that they have valid documentation, including but not limited to valid identification, which meets the requirements of any government authorities at the destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the winners.

If for any reason the winner does not take/redeem the prize (or an element of the prize) then the prize (or that element of the prize) will be forfeited.

If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

As a condition of accepting the prize, the winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.intrepidtravel.com/privacy.  If an entrant opts in then in addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use that entrant’s PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.

The laws of Australia apply to this promotion to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.
