2. The promoter is Henkel Australia PTY LTD (ABN 82 001 302 996) of P.O BOX 63, Kilsyth 3137 Victoria, telephone 03 9724 6444 (in Australia) and Henkel New Zealand Limited (Business Number 059990) of 2 Allens Road, East Tamaki 2013, Auckland (in New Zealand) (both, the “Promoter”).
3. Entry is only open to Australian and New Zealand residents aged 18 years or over. Directors, managers and employees (and their “immediate families”) of the Promoter, participating stores and agencies associated with the Promotion are ineligible. “Immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step- parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step- sister or first cousin.
4. The Promotion commences at 8:00am Australian Eastern Standard Time (“AEST”) on 26/06/2017 and final entries close at 11:59pm AEST on 30/09/2017 (“Promotional Period”).
5. To enter, individuals must complete the following steps during the Promotional Period:
a. purchase any Fab liquid product from any store in Australia and New Zealand that offers Fab liquid products for sale (“Qualifying Purchase”);
b. visit

c. provide all requested personal and Qualifying Purchase details, upload a copy of the Qualifying Purchase sales receipt, and submit the fully completed entry form as directed.
6. Only one (1) entry per person is allowed during the Promotional Period.
7. Entrants must retain a copy of the Qualifying Purchase sales receipt as proof of purchase. The Promoter may request the Qualifying Purchase sales receipt from the entrant to verify the validity of their entry. Failure to produce the Qualifying Purchase sales receipt when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize. The Qualifying Purchase sales receipt must clearly show the store of purchase, that a Fab product was purchased and that the purchase was made during the Promotional Period but prior to entry.
8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. All valid entries received during the Promotional Period will be entered into the draw.
10. Incomplete, indecipherable or incomprehensible entries will be deemed invalid. Entries made using store purchase receipts that are stolen, forged, exchanged, obtained from a third party or tampered with in any way will be invalid.
11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
12. The draw will take place at Prime Focus, Level 1, 500 Chapel Street, South Yarra, Victoria, 3141, Australia on 03/10/2017 at 10am Australian Eastern Daylight Saving Time (“AEDST”). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. 13. The Promoter’s decision is final and no correspondence will be entered into. 14. The first (1st) valid entry drawn will win $5,000 worth of Westfield Gift Cards, which also includes the services of a personal shopper (subject to availability).
15. The next thirty (30) valid entries draw will each win a $50 Westfield gift card.
16. Winners acknowledge the following conditions in regard to any voucher or gift card:
a. Redemption of any voucher/gift card by a winner or any other person will be subject to the terms and conditions of the issuer of the voucher/gift card, which will be provided with the voucher/gift card;;
b. The Promoter is not responsible for any ancillary costs associated with redeeming the voucher/gift card
c. The Promoter accepts no responsibility whatsoever for any unused balance of the voucher/gift card, or expired, unused, stolen or lost voucher/gift card.
17. The prizes will be delivered within 28 days of the draw or any re-draw. If, for any reason, a prize cannot be delivered (such as where an invalid address has been provided by a winner) or a winner does not take a prize within a reasonable time after notification by the Promoter, determined in accordance with any applicable requirements of the relevant regulatory authorities in that winner’s State/Territory, the prize will be forfeited and deemed an unclaimed prize for the purposes of clause 21 of these Terms and Conditions.
18. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. Total prize pool value is $6,500.
20. Prizes are not transferable or exchangeable and cannot be taken as cash, unless specified otherwise.
21. A re-draw for any unclaimed prizes may take place on 07/01/2018 at the same time and place as the original draw, subject to any directions from a regulatory authority. 22. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
23. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties or unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
24. Any cost associated with accessing the Promotion website is the entrant’s responsibility and is dependent on the Internet service provider used.
25. The Promoter accepts no responsibility for any tax implications that may arise from a winner accepting a prize. Independent financial advice should be sought.
26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Promotion.
27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity);; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control) (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter (d) any variation in prize value in accordance with these Terms and Conditions; (e) any tax liability incurred by a winner or entrant or (f) taking and/or use of a prize.
28. The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to regulatory authorities. Entry is conditional on providing this PI.
