MITSUBISHI MOTORS AUSTRALIA LIMITED – WIN AN ECLIPSE CROSS PROMOTION ("PROMOTION")
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these terms and conditions. Submission of an entry (as defined below) is deemed acceptance of these terms and conditions.
2. Entry is only open to Australian residents ("Eligible Entrant").
3. If an Eligible Entrant is under the age of 18 they must obtain prior consent from their parent or legal guardian to enter and the parent or legal guardian may be required to verify the granting of consent and/or sign a release at the discretion of the Promoter. Failure of an Eligible Entrant’s parent or legal guardian to verify consent and/or sign a release under this clause will invalidate the Eligible Entrant’s entry.
4. Employees of the Promoter and agencies associated with this Promotion are ineligible to enter.
5. Promotion commences on 0.00am ACST 1 September 2017 and entries close at 4.00pm ACDT on 30 November 2017 (“Promotion Period”).
6. To enter, Eligible Entrants must, during the Promotion Period:
a) visit
https://www.mitsubishi-motors.com.au/vehicles/eclipse-cross; b) input the requested information including the Eligible Entrant’s full name, email address, post code, telephone number and age; and
c) agree to the terms of this Promotion and the Mitsubishi privacy statement.
("Entry").
7. The Promoter reserves the right, at any time, to verify the validity of Entries and Eligible Entrants (including an entrant’s identity and place of residence) and to disqualify any entrant who submits an Entry that is not in accordance with these terms and conditions or who tampers with the Entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Incomplete Entries will be deemed invalid. Any incorrect details submitted may render the corresponding Entry invalid.
9. Multiple Entries permitted subject to the following:
a) Only one Entry permitted per valid email address; and
b) each Entry must be submitted separately and in accordance with these terms and conditions.
10. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in their sole discretion, to determine the identity of the Eligible Entrant.
11. The draw will take place at Suite 46, 26-32 Pirrama Road, Pyrmont NSW 2009 at 2:00pm AEDT on 1 December 2017.
12. There is one prize. The first valid Entry drawn will win a 2018 model Mitsubishi Eclipse Cross Exceed with automatic transmission ("Prize"). Prize includes vehicle owner registration, compulsory insurance and on road costs. All other additional insurance, optional extras, vehicle inclusions, choice of vehicle colour, petrol and other ancillary costs are not included and are the responsibility of the winner.
13. Total Prize value is up to $38,700.00 (estimated value only). Actual RRP of the Prize value has not yet been determined and may vary.
14. Prize must be collected from a Mitsubishi Motors dealer located near the winner, which will be nominated by the Promoter in its sole discretion.
15. If the winner of the Prize is under the age of 18 years, the Prize will be awarded to the winner's nominated parent or guardian.
16. The winner will be notified by telephone and by email within two days of the draw and the winner's name will be published in The Australian within seven (7) days of the draw.
17. The Promoter’s decision is final in relation to all matters in this Promotion and no correspondence will be entered into.
18. The Prize is not transferable or exchangeable and is not redeemable for cash.
19. If for any reason whatsoever the winner does not claim the Prize within 3 months from the draw date then the Prize will be forfeited by the winner and cash will not be awarded in lieu.
20. If the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with an alternative prize of equal value and/or specification, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.
21. If for any reason whatsoever beyond the reasonable control of the Promoter, the Promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to cancel, suspend, modify, terminate or cancel the Promotion.
22. Unless expressly stated within these terms and conditions regarding the Prize, all other expenses become the responsibility of the winner.
23. If the Prize is not claimed as provided for in clause 20, an unclaimed prize draw may take place on 2 March 2018 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winner will be notified by telephone and email on within two (2) days of any unclaimed prize draw and the winner's name will be published in The Australian within seven (7) days of any unclaimed prize draw.
24. Any costs associated with accessing the promotional website is the Eligible Entrant's responsibility and is dependent on the Internet service provider used.
25. Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
26. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these terms and conditions would contravene any statute or cause any part of these terms and conditions to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these terms and conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non-Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax implications; (e) any variation in Prize value to that stated in these terms and conditions; (f) any tax liability incurred by a successful claimant or Eligible Entrant and/or (g) the Prize or use of the Prize.
27. The Promoter collects personal information in order to conduct the Promotion, provide direct marketing materials to Eligible Entrants and to update the Promoter's records. The Promoter may, for these purposes, disclose such information to third parties, including, but not limited to, prize suppliers and for any purpose required under Australian lottery legislation or any other regulatory authority. Entry is conditional on providing this information. Unless otherwise advised at the time of entry, the Promoter may also use the information for promotional, marketing and publicity purposes. Eligible Entrants should direct any request to access, update or correct information to the Promoter.
