Terms and Conditions1. Information on how to enter and prizes forms part of these terms and conditions. By participating in the Promotion, you agree to be bound by these terms and conditions.
Entry
2. The Promotion commences on 23rd October 2017 and closes at 12.00am AEDST on 31st December 2017 (“Promotional Period”).
3. You must be aged 18 years or over to enter. Entry is open to residents of Australia. Employees of the Promoter and their immediate family and other persons associated with the Promotion are ineligible to enter.
4. You can enter by going to
www.elle.com/indi and following the prompts to the competition entry page. At the competition entry page, you submit an online entry by completing the entry form (including your full name, mailing address, email address and daytime telephone number) and submitting the entry as instructed during the Promotional Period.
5. Only one entry per person will be permitted.
6. An entry must not be: (a) late; (b) incomplete; (c) indecipherable; (d) incomprehensible; (e) illegible; or (f) unlawful. Any such entry will be ineligible and will be discarded. Any entry that the Promoter deems otherwise inappropriate will be ineligible and will be discarded.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. The Promoter is not responsible or liable for late, lost or misdirected mail enclosing an entry, or an entry not being received by the Promoter for any reason whatsoever.
9. Any costs associated with entering the Promotion, including data costs, are the entrant’s responsibility.
Draw and award of prize
10. The draw will take place at Bauer Media, 54 Park Street, Sydney NSW 2000 on 15th January 2018 at 12.00pm AEST (AEDST, when applicable).
11. On the draw date, the Promoter will conduct random draw(s) to determine the winner(s) from valid entries submitted during the Promotional Period. The Promoter will also draw reserve winners in the event an original drawn winner is invalid or ineligible. If this process does not result in all prizes being awarded, the remaining prize(s) will be awarded in the unclaimed prize draw as set out below.

The first (1) valid entry drawn from all valid entries received will win the following prize(s):
• Two (2) x return economy airfares from winner's nearest capital city to Sydney, NSW (only provided if winner resides outside of NSW). If the winner is from NSW, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash, valued at up to $650.00 each

• Return airport transfers for two (2) people to and from Sydney airport to the accommodation (if required), valued at up to $300.00
• Return venue transfers for two (2) people to and from the concert, valued at up to $300.00

14. Prize must be redeemed in full and as a package between 13th August 2018 and 18th August 2018 to coincide with the Katy Perry Concert dates, on a date and time to be agreed upon between the winner and Promoter. Specific dates will be given at the time of winner notification.
15. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the Katy Perry Concert is postponed, cancelled, rescheduled or relocated for any reason whatsoever.
16. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the Katy Perry Meet & Greet is unavailable, is postponed, cancelled, rescheduled for any reason whatsoever. Dates and times are subject to her schedule and availability at the time of the arranged Meet & Greet.
17. The winner(s) will be notified by telephone and in writing within seven (7) business days of the draw using the contact details provided in their entry. The winner(s) name will be published on
www.elle.com.au on 15th January 2018.
18. The winner must take the prize as offered. The prize, or any unused portion of the prize, is not exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer.
19. If, for any reason, the winner does not take the prize at the time stipulated by the Promoter, the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
20. If a prize, or part of a prize, is unavailable, the Promoter may substitute an alternative prize to substantially the same recommended retail value and/or specification, subject to any written direction from the various regulatory authorities.
21. If necessary, an unclaimed prize draw will be held on 15thApril 2018 at the same time and place as the original draw in order to distribute any unclaimed prize(s), subject to any directions from a regulatory authority. A winner from this draw, if any, will be notified by e-mail using the contact details provided in their entry within seven (7) business days of the unclaimed prize draw and their name will be published on
www.elle.com.au for 28 days from 15th April 2018.
Prizes
22. The prize will be delivered to the nominated address of the winner, provided that address is in Australia. The Promoter is not responsible or liable for any delay or failure in delivery of the prize by a third party or for any damaged caused to the prize during delivery.
23. The prize does not include any ancillary costs associated with redeeming the prize, which are the responsibility of the winner.
24. In accepting the prize, the winner acknowledges that they may incur ongoing costs associated with the prize that are the responsibility of the winner.
25. The prize is subject to the standard terms and conditions of individual prize and service providers.
26. The prize winner may not alter the package in any way. The prize package is not transferable, exchangeable and not redeemable for cash or any other alternate prize. No exceptions will be made for lost, misplaced, damaged or forgotten vouchers. The prize cannot be used in conjunction with any other offer or discount. No credit will be given for any unused portion of the prize.
27. The winner (and their companion) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
28. Unless expressly stated in these terms and conditions all other expenses (including travel to and from the departure point) become the responsibility of the winner.
29. The two (2) flights must be utilized at the same time, for the same travel dates, to the same destination.
30. Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for international travel are included in the prize winning international airfares provided by the Promoter.
31. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The components of the Prize may alter for reasons beyond the Promoter’s control. The Prize is not, nor any component thereof, transferable, exchangeable or redeemable for cash. No components of the Prize can be exchanged for other travel or accommodation at other destinations. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the Winner.
32. It is a condition of accepting the prize that the winner (and any traveling companions) must comply with all the conditions of use of the prize and prize supplier’s requirements
33. It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at any hotel to cover all incidentals they may incur including their stay at that hotel.
34. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of prize at a venue is subject to the standard rules and regulations of that venue/s.
35. In the event, the winner is 18 years or under, a parent or legal guardian must accompany the winner when redeeming the prize.
General
36. The Promoter’s decision in relation to all aspects of the Promotion is final and no correspondence will be entered into.
37. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster) the Promoter may, subject to relevant state and territory rules and regulations, cancel, terminate, modify or suspend the Promotion.
38. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act or similar applicable laws (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any: (a) personal injury arising in any way out of the Promotion; or (b) any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of: (i) the Promotion; (ii) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (iii) any theft, unauthorised access or third party interference; (iv) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (v) any variation in prize value to that stated in these terms and conditions; (vi) any tax liability incurred by a winner or entrant; or (vii) use of the prize.
39. Subject to the Non-Excludable Guarantees, the Promoter makes no representations or warranty as to the quality, suitability or merchantability of any of the goods or services offered as a prize.
40. The Promoter collects personal information (“PI”) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry in the Promotion is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which is available at
http://www.bauer-media.com.au/privacy. In addition to any use that may be outlined in the Promoter’s privacy policy, the Promoter may also, for an indefinite period, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning you. You should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of you PI as set out in the Promoter’s privacy policy. All entries become the property of the Promoter.
