1. The Birkdale Fair Shopping Centre “Win a $500 Shopping Spree” promotion (“Promotion”) starts at 11:00am
(AEST) on Monday 6 November 2017 and concludes at 12:00pm (AEST) Monday 11 December 2017 (“Promotional
Period”).
2. The Promoter of the Promotion is The Trust Company (Australia) Limited trading as Birkdale Fair (the “Promoter”),
ABN 21 000 000 993, located at 2-12 Mary Pleasant Drive, Birkdale, Queensland, 4159.
3. All entrants will be subject to, and will need to adhere to, the Terms and Conditions as set out by the Promoter and
any future Terms and Conditions or alterations to these Terms and Conditions.
4. Information on how to enter the Promotion and information on Prizes which may be mentioned anywhere in
messages, advertisements, signs or posters in the Shopping Centre or elsewhere (“Promotion Information”) form
part of these Terms and Conditions.
5. These Terms and Conditions may be amended or varied by the Promoter at any time in the Promoter’s sole and
absolute discretion without prior notice. Any amendments will be posted on the Promoter’s Website and it is the
responsibility of each person entering the Promotion or using the Website to ensure that they review these Terms
and Conditions regularly to ensure familiarity with changes.
6. Entry into the Promotion is only open to Queensland residents.
7. To enter the competition, entrants can enter via the following method: Spend $20 or more at any Birkdale Fair
participating specialty retailer or $100 or more at Birkdale Fair Woolworths to be eligible to receive one (1) entry
form. You can enter via this method as often as you like, subject to complying with these Terms and Conditions.
8. Receipts must be dated within the Promotional Period. Receipts exclude: sales receipts for account payments (e.g.
electricity, gas, telephone), premiums (e.g. insurance and health fund premiums), cigarette and any other tobacco
related purchases, pharmaceutical prescriptions, scratch-it and lotto purchases, account payments to banks or any
financial institutions, and Lay-by payments made outside the Promotional Period.
9. Receipts can be combined to reach $20 or more for Birkdale Fair participating specialty retailers or $100 or more
for Birkdale Fair Woolworths.
10. To be valid, receipts must be attached to each fully completed official entry form as proof of purchase and the entry
form must contain the entrant’s full name and address and be placed in the competition barrel provided by the
Promoter located outside Woolworths at Birkdale Fair.
11. Purchase receipt(s) must be intact, must clearly display the amount spent by the entrant, must clearly state
the participating Birkdale Fair retailer’s name/s and indicate that the eligible purchase was made during the
Promotional Period.
12. Multiple entries per entrant allowed. Entrants can only win one (1) $500 Shopping Spree (“Prize”) once.
13. The promoter, the owners and managers of Birkdale Fair and their employees, participating retailers and their
employees, other retailers in Birkdale Fair and their employees or contractors and the immediate families of any of
the persons and entities set out above and associated agencies of the Promoter and Birkdale Fair are not eligible
to enter.
14. There are Two (2) Prizes to be won and two (2) Prize Draws at the end of the Promotional Period. For each Prize
Draw the first eligible entry drawn will win $500 worth of Birkdale Fair gift vouchers (“Prize”). The Prize Draws
will take place at 1:00pm on 11/12/2017. The first two (2) eligible entries drawn will each receive $500 worth of
Birkdale Fair gift vouchers. The total prize pool is valued at $1,000 (“Prize”).

15. Prize value is based upon the recommended retail price at the time of printing (inclusive of GST). The Promoter
accepts no responsibility for change in Prize value between now and the ultimate Prize redemption date. The
Promoter accepts no responsibility for any malfunction, variation in any of the Prize or the value thereof.

16. If the Prize, cannot, in the sole and absolute discretion of the Promoter, be provided for any reason, then the
Promoter reserves the right to provide an alternative Prize of equal or greater value, subject to any directions from
a regulatory authority.
17. The Promoter makes no representations, warranties, guarantees or assurances with respect to the Prize.
18. If any of the winning entrants are under the age of 18 as at the date of the draw, the entrant’s Prize will be
transferred into the name of the Winners’ parent or legal guardian.
19. The Prize is not transferable, refundable or exchangeable for cash or kind.
20. The Winners need not be present to claim the Prize.
21. The Winners will be notified by telephone or by email on Monday 11 December 2017 after the competition draw.
22. The Promoter reserves the right in its sole discretion to disqualify any participant who the Promoter has reason to
believe has breached any of these conditions, or engaged in unlawful or other improper misconduct calculated to
jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other
compensation from such a person are reserved.
23. The Promoter also reserves the right to cancel, void or invalidate any entries that are not fully completed or
otherwise fail to comply with these Terms and Conditions. The Promoter will not be responsible for any entries
that are late or not received as an original, fully completed entry form. The Promoter accepts no responsibility for
invalidated, voided, incomplete, incorrectly submitted, delayed, misdirected or illegible entries. Any entries that are
not in accordance with these Terms and Conditions will be deemed so. The decision of the Promoter in this regard
is final and binding.
24. The Promoter does not accept any responsibility to persons, entrants, or winners for fees, costs or charges
associated with entering the Promotion.
25. The Promoter reserves the right to ask for proof of identity or residency at any time and may use any resource
available to carry out verification that the Promoter deems appropriate. In the event that suitable proof is not
presented where required or the Promoter, in its sole and absolute discretion is not satisfied with any proof that is
presented, the Promoter may cancel, void or invalidate any entry form or Prize award.
26. The Promoter (including related entities) and its respective of officers, employees, contractors and agents shall not
be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential
economic loss) or for personal injury suffered or sustained, as a result of the promotion or in connection with the
Prize.
27. The warranty on the goods and services obtained as a result of this promotion remains the sole responsibility of
the manufacturer/supplier of the Prize. The Promoter will not be responsible for any malfunction, fault, technical or
design error or any other breakdown concerning the Prize whatsoever. The Winner undertakes to liaise directly with
the providers of the Prize in respect of any manufacturer’s warranties and/or guarantees and hereby release the
Promoter from any liability whatsoever in respect thereto.
28. The Promoter accepts no responsibility whatsoever for any tax implications (including Fringe Benefits or Personal
Income Tax) that may arise from the Prize winnings. Independent financial advice should be sought prior to the
acceptance of the Prize.
29. To be eligible to claim the Prize, each Winner agrees to provide information and photographs of themselves for
marketing and publicity use and undertakes to comply with any of the Promoter’s or Prize supplier’s requirements.
Each Winner grants the Promoter a non- transferable, sub–licensable, royalty free, worldwide license to use these
photographs in any way that the Promoter wishes.
30. The Promoter’s decision is final and binding on all entrants and each Winner. No person will object to the
Promoter’s decision in any way whatsoever and the Promoter will not take responsibility for any substitutions or
variations of the Prize.
31. The Promoter will use reasonable endeavours to notify each Winner by email, telephone or otherwise. If the
Promoter is unable to make contact with any of the two Winners within 10 days from the date of the draw, or if
any of the four Winners fail to claim their Prize within one (1) month from the date of the draw, then the Prize will
be forfeited and the Promoter will draw an alternative Winner and attempt to make contact with that person for
collection of the Prize. The Promoter will continue this in this fashion until a Winner has been notified and has
collected their Prize.

32. The Promoter accepts no liability whatsoever for any loss, damage whatsoever (including, but not limited to indirect
or consequential loss) or any injury to a person or their property that may arise in any way from the participation in
or the conduct of the Promotion.
33. Entrants and Winners in/of the Promotion agree to indemnify the Promoter, its subsidiaries, employees, advisers
and agents against all claims, losses, damages, costs and expenses reasonably or lawfully suffered or incurred by
the Promoter by reason of any loss, damage or injury by the Promoter arising out of this promotion.
34. Subject to any restrictions imposed by law, in the case of the intervention of any outside act, agent, event
which prevents or significantly hinders the Promoters ability to proceed with the Promotion on the dates and
in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures,
tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, etc, the Promoter may in its
absolute discretion, suspend or cancel the Promotion and recommence it at a date in which the Promoter deems
appropriate from the start and on these same Terms and Conditions.
35. Subject to any restrictions imposed by law, if for any reason this Promotion is not capable of running as planned,
due to causes including but not limited to computer failure or viruses, tampering, unauthorised intervention, fraud,
technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration,
security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion
to cancel, terminate, modify or suspend the promotions.
36. The Promoter is not responsible for any problems or technical malfunctions of any telephone network lines,
computers, online computer systems, servers, providers, equipment, software, traffic congestion on the internet
or any website, or any combination therefore, including but not limited to any injury or damage to any person’s
computer relating to or resulting from participation in or downloading materials in this promotion.
37. The Promoter reserves the right to collect and use personal information provided by the Entrants and Winners for
the purpose of carrying out this Promotion.
38. If an Entrant or a Winner does not provide the information requested, the Promoter may, in its sole and absolute
discretion, void any entry for entitlement to claim a Prize for that particular person.
39. Each Entrant’s and/or Winner’s personal information may be passed to relevant regulatory bodies, the police or
other authorities in the course of any investigation of any complaints or suspected unlawful activity.
40. The Promoter may use personal information provided by any person to send publications or other promotional
material. The Promoter may supply the personal information to contractors which assist the Promoter to do this, to
organisations which provide special prizes or offers and which are associated with the Promotion and to selected
approved organisations which may use it to inform Entrants or Winners about other products, services or events. A
copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected can be found at

41. The Promoter may use the Winner’s personal information in any media for publicity purposes associated with the
Promotion without any further payment or other form of compensation unless the Winner otherwise notifies the
Promoter not to use their personal information in such a manner.
42. If an Entrant or a Winner prefers that the Promoter does not use and/or retain their details, they must contact the
Promoter.
43. Any Entrants or Winners have a right to access most personal information which the Promoter holds. The Promoter
may deny a request for access in some circumstances. If the Promoter does this, it will be required to explain why. If
at any time an Entrant’s or Winner’s details change or they require access to the personal information, the Promoter
may be contacted.
