CONDITIONS OF ENTRY (“CONDITIONS”)
1. Information on how to enter, mechanics of entry and prizes form part of these Conditions. By participating, Eligible Entrants agree to be bound by these Conditions and all entries must comply with these Conditions to be valid.
2. Entry into this Promotion is deemed acceptance of these Conditions. Entry is via: a) Internet; or b) premium SMS (short messaging service).
3. The “Promoter” is Coates Hire Operations Pty Limited ABN 99 074 126 971 of 241 O’Riordan Street, Mascot NSW 2020 (telephone number 13 15 52).
ELIGIBILITY
4. The Promotion starts at 7:00am AEDT on 22 November 2017 and ends at 7:00pm AEDT on 20 December 2017 (“Promotional Period”).
5. Entry into this Promotion is open only to Australian residents who are over 18 years of age (“Eligible Entrants”), but excluding:
a. directors, management, agents, employees (and their immediate families) of the Promoter, and each of their related bodies corporate;
b. members whose account with the Promoter is suspended, cancelled or otherwise terminated at any time during the Promotional Period or at the time of the draw or any redraw (as applicable); and
c. directors, management and employees (and their immediate families) of other hire companies and equipment manufacturers.
6. Employees of customers of the Promoter (and their immediate families) must have obtained the written authorisation of the customer prior to entry to be eligible. The Promoter has the right to request a copy of such written authorisation before awarding any prize. No person can enter the Promotion if to do so would breach any internal policy of their employer. The Promoter requires the employee to disclose all details of their intended entry and individual hire schedules to their employer prior to entry. Disclosure is the sole responsibility of the employer and its employee and the Promoter is not responsible in the event of non-disclosure.
HOW TO ENTER
7. To enter, Eligible Entrants must, during the Promotion Period:
(a) register their details via the on-line registration form located on the Promoter’s website at
www.coateshire.com.au/WIN (“Promotional Website”);
(b) only register as an individual;
(c) not include anything defamatory or otherwise inappropriate;
(d) log on to the Promotional Website and fully complete the requested details in accordance with the directions on the entry page for this Promotion; or
(e) via Quick Entry. Customers who have transacted during the Promotional Period will receive an SMS enabling them to reply ”Y” to submit their entry using the entry details supplied at the time of the transaction.
(f) Each Eligible Entrant can have multiple entries in the Prize Draw if they are eligible for bonus entries providing they satisfy the bonus entry criteria.
ENTRIES
8. Entries must be received during the Promotion Period and any email received after the Promotion Period will not be counted as a valid entry.
9. Eligible Entrants can only enter the Promotion once unless they are eligible for a bonus entry/entries. The Promoter is not responsible for any technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise. The time of entry will be deemed to be the time the entry is received by the Promoter.
10. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
11. Online entries: Costs associated with accessing the Promotional Website remain an Entrant’s responsibility and may vary depending on the Entrant’s usage plan, mobile carrier or Internet service provider.
12. If an Entrant uses mobile Internet to participate in this Promotion : Entrants must be identified as having a clear relationship with the end mobile device and have the bill payer’s consent to use mobile Internet to participate in the Promotion or their entry will be deemed invalid. Accessing mobile content including web-based content may incur data charges. Entrants will need to refer to the terms of their carrier contracts for details and costs as costs vary from plan to plan. The charges for all data services will appear on each Entrant's next mobile phone bill and/or Internet bill (as applicable). All general queries relating to carrier rates or mobile or Internet bills should be directed to the Entrants' mobile phone carrier or internet service provider (as applicable).
13. SMS entries: SMS entries must be sent from a mobile phone handset and be identified by a MSISDN (unique mobile SIM number) for security reasons to be eligible. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received. Entrants must have the bill payer’s permission to enter this Promotion or their entry will be deemed invalid. In the event of a dispute regarding a prize awarded to an SMS Entrant, the prize will be awarded to the owner of the relevant mobile phone number. Standard carriers' SMS costs will apply. Standard carrier SMS costs remain the responsibility of each Entrant and are dependent on the carrier used and an Entrant’s mobile phone plan. Any SMS Entries submitted after the Promotional Period has closed will not be included in the Promotion and will incur the standard carrier SMS charge per message sent. The charges for all SMS Entry services will appear on the Entrant’s next mobile phone bill. All general queries relating to mobile bills should be directed to the Entrant’s mobile or telephone carrier. Mobile standard SMS service provided by Salmat Digital Pty Limited. If an Entrant has opted in to receive SMS communications from the Promoter and wants to unsubscribe from receiving SMS communications , they must follow the instructions that will be contained within any SMS marketing communication that they receive from the Promoter.
14. A free reply SMS will be sent to each Entrant who successfully submits an Entry by SMS immediately after their Entry has been received by the Promoter. The free reply SMS will confirm their Entry has been successfully received and advise that their Entry has been entered into the applicable draws. By entering this Promotion, Entrants who enter via SMS consent to receiving this electronic message.
BONUS ENTRIES
15. Entrants are eligible to enter multiple times during this Promotion by providing a valid “Hire Schedule Number” from the Promoter in the Entry Form at time of entry. Entrants will also receive 1 bonus entry each time a valid Hire Schedule Number is entered. Each Hire Schedule number is only valid for one entry and one bonus entry. A new Hire Schedule Number must be entered each time to complete an eligible entry.
16. To obtain a Hire Schedule Number entrants must make an “Eligible Hire” from the Promoter as follows:
a. Make an Eligible Hire: Hire one or more equipment items from the Promoter (in one transaction, under a signed hire schedule) (an Eligible Hire). Entrants must sign a new Hire Schedule with the Promoter and act in accordance with the Promoter’s Terms of Hire and Special Conditions throughout the Promotional Period. For the avoidance of doubt, the purchase of consumables or sale items or the hire of the Promoter’s equipment by other hire companies or by equipment manufacturers does not constitute an Eligible Hire for the purpose of this Promotion. Upon making an Eligible Hire, Entrants will be issued with a hire schedule number located on the top right corner of the first page of the hire schedule (“Schedule Number”).
b. An Eligible Hire can be made in 1 of the following ways:
i. In-store: by visiting a participating Promoter branch in Australia during business hours; or
ii. By phone: by calling 13 15 52 anytime and following the prompts in the manner required.
17. Proof of Eligible Hire required: Each Entrant must retain and may be required to present proof of the Eligible Hire in order to claim a prize. If an Entrant is unable to provide proof of Eligible Hire for the Entry made within the required timeframes, then all Entries of that Entrant will be ineligible and deemed invalid. Proof of Eligible Hire includes showing the original and providing a photocopy of the hire schedule for the Eligible Hire made during the Promotional Period. Hire schedules must clearly state how the Eligible Hire was made and must indicate that the Eligible Hire was made during the Promotional Period but prior to submission of entry.
PRIZES
Major Prize
18. The first valid and eligible entry drawn will be deemed the “Major Prize Winner” and will receive a trip to the “2018 Formula 1 Rolex Australian Grand Prix” event, held at Melbourne, Victoria, from 23 rd to 25 th March 2018 (“Event”), including the following:
a. 2 tickets to the “Supercars Club Suite” corporate hospitality facility on both Saturday 24 th March and Sunday 25 th March 2018 (including food and beverage catering);
b. Flights and accommodation for 2 people for 3 nights: Friday 23 rd, Saturday 24 th and Sunday 25 th March 2018. Accommodation is based on twin share, 4 Star or better, within short travel distance to the Event. Includes economy return flights from any Australian capital city to Melbourne; and
c. Selected Event merchandise.
19. Total Major Prize value: up to $5,700.00 including GST, depending on the Major Prize Winner’s point of departure.
20. Entrants must be over 18 to accept and/or participate in the Major Prize.
21. All other costs associated with the Major Prize, including but not limited to any additional travel, insurance, transfer costs, additional meals, additional taxes, insurance and other ancillary costs are the responsibility of the Major Prize winner and his/her companion, as incurred. The Major Prize is subject to any additional terms and conditions specified by the prize supplier(s).
22. Entrants (and their companion) acknowledge that there are inherent risks in some aspects of the Major Prize and that taking the Major Prize involves participating in dangerous activities. By entering this Promotion and/or accepting the Major Prize, Entrants and their companions accept that risk.
Minor Prizes
23. Minor Prizes: There are 4 minor prizes, each of which are 2 x general admission passes to the Event valued at $165.00 including GST each;
24. Total Minor Prize pack value is $1,320.00 including GST.
25. All tickets are subject to the Event “Attendance Conditions” (including but not limited to ground security and ticketing), including expiration dates, accommodation/transport/services/transfers and in particular, health, behaviour, age and safety requirements and are not replaceable if lost, stolen or damaged details found at
www.supercars.com26. No compensation will be payable if a winner, or their companion (if any), are unable to use any element of the Minor Prizes as stated for whatever reason, including refusal of entry or ejection from the Event or participation in certain activities for health, age, behaviour or safety reasons. Any part of a prize that is not taken for any reason is forfeited. Winners attending the Event do so at their own risk. All ancillary costs or accessories not expressly provided in the Minor Prizes are the responsibility of the winner.
27. Total maximum Prize pool value is up to $7,020 including GST, depending on the Major Prize Winner’s point of departure. The prizes are not transferable or exchangeable and cannot be redeemed for cash. The prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. In the event for any reason a Prize Winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the Prize Winner and cash will not be supplied in lieu of that element of the prize.
28. The prize draw will take place at 12 Noon AEDT (21/12/2017 at RBE Promotions & Activations PTY LTD, 33 Oxford St Nundah QLD 4012.
29. The winners will be notified by telephone and in writing within 2 business days of winning a prize and all winner’s names and postcodes will appear on the Promotional Website by 5.00pm AEST on 22/12/2017 Winner’s names and postcode will also appear in The Australian on 4/01/18.
30. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible Eligible Entrant is drawn. The Promoter’s decision is final and no correspondence will be entered into.
GENERAL
31. The Promoter reserves the right to redraw in the event of an Entrant being unable to satisfy these promotion terms and conditions of entry or forfeiting or not claiming a prize. The Promoter will use all reasonable efforts to contact each winner using the contact details provided in his/her entry form, however a prize will be considered forfeited if a winner cannot be contacted after 2 days from the date of the original draw.
32. The Promoter reserves the right, at any time, to verify the validity of entries. The Promoter reserves the right to request that the winners provide proof of identity and place of residency in order to claim their prize. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
33. The Promoter reserves the right to disqualify any Entrant who is in breach of these terms and conditions of entry or who manipulates, seeks to manipulate or benefits from manipulating, the entry process or the promotion.
34. The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the Promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; (iv) acceptance and/or use of any prize and/or any loss or damage whatsoever arising out of the use of the prizes. Applicable manufacturers and/or distributors should be contacted in regards to all prize warranty claims and/or any loss or damage whatsoever arising out of the use of the prizes.
35. If this Promotion is not capable of running as planned for any reason beyond the Promoter’s reasonable control, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes, subject to any written directions made under applicable State or Territory legislation.
36. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in this Promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid.
37. The Promoter reserves the right to request verification of age, identity and residential address of the winners, and any other information relevant to entry or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this promotion
38. By entering in the manner set out in Clause 9, Eligible Entrants confirm and warrant that their entry is original and does not infringe the intellectual property rights of any third party.
39. Entrants agree that the Promoter may use the contents of their entry in company publications, such as promotional material.
40. The Promoter may communicate or advertise this Promotion using Facebook. However, the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each Entrant completely releases Facebook from any and all liability.
41. Entry details remain the property of the Promoter. The name and photograph of each winner may be used for promotional purposes by the Promoter, unless a winner otherwise notifies the Promoter prior to accepting a prize. Entrants consent to the Promoter collecting and using personal information provided in connection with this Promotion for the purposes of facilitating the conduct of the Promotion, confirming eligibility in this promotion and awarding any prizes. The Promoter may also use the information to assist it in improving products and services and to contact Entrants in the future in regard to other products and services. The Promoter may share your information with other persons or entities that assist us in performing the above activities or with any company that provides prizes for this Promotion. By entering this Promotion, Entrants consent to:
a. the Promoter’s use of their personal information including information provided in the hire of the Promoter’s product or service, to confirm the Entrant’s eligibility to participate in this Promotion; and,
b. the Promoter’s use of the information in the entry in accordance with the Promoter’s Privacy Policy, a copy of which is available at

You can contact us to gain access to your personal information by writing to The Privacy Officer, Coates Hire Limited, Level 6, 241 O’Riordan Street, Mascot, NSW, 2020. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Independent tax and financial advice should be sought.
42. Any attempt, deliberate or otherwise, to cause malicious damage or interference with this Promotion, or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
43. Entrants are reminded and AGREE, ACCEPT AND ACKNOWLEDGE that motor racing, AND certain activities associated therewith (including, without limitation, participation in THE PRIZE) are dangerous and accidents can happen.
Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and participation in the Prize is at the entrants’ own risk. Entrants acknowledge that the risks associated with participating in the Prize include but are not limited to the risk of suffering harm as a result of cars (or parts of them) colliding with other cars, persons or property. Entrants acknowledge that participating in the Prize has a degree of danger and, to the extent permitted by law (in particular section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic) and section 139A of the Competition and Consumer Act 2010 (Cth)), hereby exclude, release and forever discharge Supercars the Crown in right of the State of Victoria, the Minister administering the Act, the Minister administering the Crown Land (Reserves) Act 1978 (Vic), Supercar sponsors and all other persons involved in the organisation, conduct and promotion of the Event and Prize including officials, marshals, rescue and medical staff, the competitors and drivers (such parties to include where relevant all directors, officers, employees, agents, contractors and affiliated companies and their respective personnel) ( Associated Entities ) from all liability for claims, loss, damage, costs or expenses arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with participation in Recreational Services (as defined below) including the Prize (or any element of the Prize) and attendance at the Event.
To the extent permitted by law (in particular section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic) and section 139A of the Competition and Consumer Act 2010 (Cth)), entrants acknowledge that, to the extent to which they participate in the Prize in:
a) a sporting activity or similar leisure time pursuit; or
b) an activity that:
c) involves a significant degree of physical exertion or physical risk; and
d) is undertaken for the purposes of recreation, enjoyment or leisure,
( Recreational Services ), including, without limitation, participation in the Prize, the Associated Entities do not make any warranty that the Recreational Services including the Prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the Prize, will be fit for the purposes for which they are supplied. Entrants acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law.
WARNING: If you participate in these activities your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 (Vic) if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in the Conditions of Entry.
NOTE: The change to your rights as set out in this notice, does not apply if your death or injury is due to gross negligence on the supplier’s part. “Gross negligence” is defined in the Australian Consumer Law and Fair Trading Regulations 2012.
For the purpose of this Condition 21 “the supplier” will mean and include the Associated Entities.
Without limiting any other release or limitation of liability contained in the Conditions of Entry, the Associated Entities will not be liable for any indirect or consequential loss suffered by any entrant caused by any acts or omissions of the Associated Entities, their directors, employees, agents and contractors arising out of or in relation to the Prize.
Nothing in this Condition 21 or these Conditions of Entry generally affects your rights under the Competition and Consumer Act 2010 (Cth), Australian Consumer Law and Fair Trading Act 2012 (Vic) or similar legislation regarding implied conditions and warranties to the extent that such implied conditions and warranties cannot be excluded by law.
