McDonald Jones Homes Pty Limited (the “Promoter”) is running a promotion titled "Easter Colouring In Competition” (the “Promotion”) to capture the fun and colourful inspirations of our customers and their children. The promotion will be conducted in accordance with the following rules, terms and conditions.

How to enter the Promotion:

1.1 Entry into the promotion is deemed acceptance of these Terms and Conditions.

1.2 Entry is open to NSW and ACT residents aged 18 years or above on behalf of children in their care and residents aged 16 and below with Parental Permission. Employees (and their immediate families) of the Promoter are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

1.3 The winner will be selected randomly from the images uploaded via the Entry Form for the Promotion.

1.4 The Entry Form – Colouring In Sheets will be available on the McDonald Jones Homes Facebook page from Saturday 24 February 2018 at 12.00am AEST to Saturday 24 March 2018 at 12.00am AEST

1.5 To enter the Promotion for a chance to win the Prize or part of the Prize, an entrant must:

1.5.1 Upload (or “Post”) a photograph of their Easter Colouring In sheet completed and provide their contact information, including email address.
and

1.5.2 Complete an entry form located on the competition page and confirm the acceptance of these terms and conditions.

1.6 The photograph uploaded, and any content included in the photograph and post, must comply with Facebook’s terms and conditions including but not limited to no inclusion of nudity, threatening language or infringement of copyright. Entries can be removed at the discretion of McDonald Jones if these terms and conditions are not complied with or if the entry is deemed inappropriate.

Prize:

3.1 There is one prize, being an Easter Hamper to the value of $200. The Prize will be provided to the one randomly selected winner at the discretion of the Promotor, either delivered to the winner’s home, closest Display home or other arrangements coordinated with the winner.

3.2 The winner will be drawn 5pm Monday 26 March 2018 at our Head Office, Level 5, 18 Honeysuckle Drive, Newcastle NSW 2300 and announced on Tuesday 27 March 2018 by 5.00pm AEST on the McDonald Jones Homes Facebook page. The winner will also be contacted by way of Facebook, email and / or telephone.

3.3 If the Promotor is unsure of the identity of an entrant, the Promoter reserves the right to award the prize to another person.

Acknowledgements:

4.1 Entrants of the Promotion acknowledge that:

4.1.1 The Entrant has obtained the permission of all people featured in a photo to take their photo and publish that photo online and post the photo on the competition page;

4.1.2 The prize is not transferrable or exchangeable;

4.1.3 No entry can mention or contain a visual representation of the brand name of any competing home builder or allude to their identity in any way;

4.1.4 No entry can contain imagery that is in bad taste or of a racial, explicit or sexual nature;

4.1.5 McDonald Jones reserves the right to deny entry or remove from the competition any entry which it deems does not meet these requirements at any time and without notice including after the promotion period;

4.1.6 McDonald Jones reserves the right to withdraw entries and / or block Facebook accounts at its complete discretion.

4.1.7 One Entry per person

General:

5.1 The Promoter reserves the right to reject any application, remove any photograph, disqualify any entrant or discount any votes, at its absolute discretion whether or not the entry has been made in accordance with these Terms and Conditions.

5.2 Entrants consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for promotional purposes (including any outcome).
Limitation of Liability:

6.1 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, consumer protection laws in the State and Territories of Australia. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

6.2  As a condition of accepting a prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

Privacy:

7.1 The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information, as required, to Australian regulatory authorities or related entities of the promotor. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

7.2 Other purposes for which we collect Personal Information include (but are not limited to):

7.2.1 Providing you with information about MJH Group products and services as it relates to contract homes, such as construction, finance, conveyancing and interior design.

7.2.2 Promoting and marketing our existing and future products and services to you; and

7.2.3 To better cater for identified needs and the creation of new products and services.

7.3 We may use your Personal Information for other purposes not listed above but which will be made obvious to you at the time we collect the information, or for purposes required or permitted by law.
If we use your Personal Information for direct marketing purposes or direct marketing communications with you, we will give you the option of opting-out of receiving any further such communications.

Copyright:

8.1 The entrant acknowledges and agrees that by entering a photo in the promotion the entrant grants to the promoter an unrestricted, irrevocable, royalty free license to use, publish, reproduce and amend the photo at its complete discretion and that the photograph may be used for commercial purposes.
