By entering the Toyota Hybrid Performance Where It Matters Competition (“the Competition”) (AFL Authorised GF Promotion: GFAFL 18/162), you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia 18 years of age or older in Australia where the Channel Seven and its affiliated networks (“Affiliates”) signals are received, who are able to be in Melbourne, Victoria from Friday 28th September 2018 until Sunday 30th September 2018.
2.2 Employees and their immediate families of Seven Network (Operations) Limited (the Promoter), 33 Degrees Worldwide Pty Ltd, Toyota Motor Corporation Australia Limited, Australian Football League (AFL) their associated agencies and companies are not eligible to enter, nor participate in the prize.
3. HOW TO ENTER
3.1 The Competition commences Thursday 6th September at 17.30 (AEST) and concludes on Sunday 23rd September 2018 at 24:00 (AEST) (“the Competition Period”).
3.2 For entry details, viewers must watch the AFL telecast that airs the competition spot on the Seven Network and Affiliates during the Competition Period. The competition spot will display information on how to enter.
3.3 In order to enter the draw, viewers must:

https://www.toyotahybridcomp.com.au and select 1 out of 4 moments they believe to be the best Performance Where It Matters on field during the 2018 Toyota AFL Premiership Season and tell us in 25 words or less why. Entrants must also register their name, email, contact daytime telephone number (including STD area code) and post code.
3.4 Entries must be received within the Competition Period. The time of entry will in each case be the time the online submission is received by Seven Network Operations Limited.
3.5 Entrants (including winners) in the Competition may enter as many times as they like but each entry must be unique and:
(a) be the original independent creation of the entrant; and
(b) be free from any claims, including copyright or trademark claims, by other parties.
3.6 Entry details remain the property of the Promoter and will not be returned to the entrant. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use, distribute, broadcast and sub-licence their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.
4. PRIZES
4.1 There will be one (1) major prize winner who will receive the prize package detailed in clause 4.2 .

Total maximum prize pool value for the prize is up to $7,000.00 Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
4.3 For winner and winner’s companions who are residents of Melbourne or for whom Melbourne is their nearest capital city, commercial domestic return flights will not be included and no cash prize will be awarded in lieu of flights.
4.4 The prize includes GST and taxes included in the price of the ticket. Unless otherwise stated, the prize does not include spending money, travel insurance, ground transportation additional to that described in the prize, flights additional to those described in the prize, accommodation additional to that described in the prize, or any other costs of a personal nature. Compliance with any health or other government requirements is the responsibility of each prize-winner and their companions. Seven Networks Operations Limited and Prize Sponsor makes no representation as to the safety, conditions or other issues that may exist at any destination. Prize travel is subject to the relevant airlines General Conditions of Carriage.
4.5 Prize travel is subject to availability at the time of booking and prize travel is subject to availability of prize travel fares at the time of booking. The winner and their travel companion must arrive and depart on the same date.
4.6 Each prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. It is a condition of accepting a prize that the winner accepts the conditions of use of that prize.
4.7 33 Degrees Worldwide Pty Ltd has a right to determine the airline carrier for the winner and their companions at its discretion based on availability and price.
4.8 33 Degrees Worldwide Pty Ltd has a right to determine accommodation for the winner and their companions at its discretion based on availability and price, and cannot guarantee that each guest will receive their own room if availability and cost does not allow so.
4.9 The winner is responsible for possessing all necessary ID and other documents required for travel. The winner and his/her companions who stay at the accommodation property are subject to the Terms of Service applicable to the relevant property. If the winner cancels his/her stay at the property, he/she will not be entitled to any refund on the whole or any part of the value of the booking.
4.10 The Promoter reserves the right to any remedy, including withdrawal, denial or cancellation of a prize, if fraud, tampering or other violations of this Competition terms and conditions are suspected.
4.11 In the event that an element of a travel, event, concert or other similar prize outlined above is, for any reason, cancelled, postponed or not available, that element(s) of the prize will be considered as forfeited and no cash alternative offer will be granted in lieu of the part of the prize.
4.12 As a condition of entry the winner must be available to travel on Friday, 28th September 2018 to Sunday 30th September (inclusive).
4.13 The winner may select guests of any age however, all guests under 18 years of age must travel with their parent or legal guardian.
4.14 Winner will be required to sign a prize acceptance form including liability and publicity waiver within 24 hours of being notified as the winner to formally accept the prize.
4.15 Guests will be required to sign a prize acceptance form including liability and publicity waiver before the prize booking can be made.
4.16 Winner must finalise the prize booking by 12pm AEST on Tuesday 25th September 2018.
4.17 Prize is a single event holiday and cannot be separated into different holiday vacations.
4.18 All passengers must travel together on the same flights and stay at the same property.
4.19 No compensation or alternative travel plans will be arranged should the winner and/ or their guest miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the winner and travel partner.
4.20 A credit card imprint may be required from the winner at check-in to the hotel for all incidental charges.
4.21 Once booking is confirmed no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion and if permitted will incur a fee of $150 including GST plus supplier charges which is payable by the winner.
4.22 Travel suppliers/airlines to be chosen at the discretion of 33 Degrees Worldwide Pty Ltd (the Prizing Agency).
4.23 Comprehensive travel insurance is highly recommended and at the expense of the winner. If the winner chooses not to purchase travel insurance they will be required to complete a travel insurance waiver form acknowledging that they understand the benefits of travel insurance but decline to take out a policy.
4.24 Unless expressly stated in these terms and conditions all other expenses become the responsibility of the major prize winner and (where applicable) their companion, including but not limited to all meals, spending money, incidentals, mini-bar, laundry, room service, telephone calls and all other ancillary costs. A credit card imprint may be required by hotel or other accommodation providers for incidentals (which are not included in the prize unless otherwise expressly set out in clause 4.2 above. Once the prize is accepted, the prize winner must deal directly with the prize supplier should there be any specific requests, queries, concerns or complications.
4.25 The Promoter and the Prize Sponsor are not responsible for any costs associated with flights that are cancelled or delayed for any reason, including but not limited to accommodation and transfer costs. The Promoter and the Prize Sponsor are not responsible if cancellation or delay of flights causes the prize winners and companion/s to miss the ticketed event that makes up part of this prize.
4.26 Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

4.28 Subject to state permit authority restrictions, the Promoter may amend these terms and conditions in its absolute discretion.
4.29 In accepting the prize the winner agrees to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winner grants the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
4.30 The winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
4.31 It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the Prize Sponsor’s requirements.
4.32 The prize winner must be 18 years of age or older and must provide valid identification to the Promoter.
4.33 This is an event based prize, with the event being conducted on Saturday 29th September 2018. There will be no extension under any circumstances. If the prize is forfeited for any reason it will not be extended.
4.34 Prize is not transferrable or exchangeable with cash. Any unused portion of the prize is not redeemable for cash.
5. HOW TO WIN
5.1 There will be one (1) major prize winner judged from the national pool of online entrants who will win the prize package detailed in clause 4.2. There will be one (1) reserve major prize winner judged at the same time, to be contacted in the event the major prize winner does not claim the prize. Each entrant who has entered the Competition in accordance with these terms and conditions during the Competition Period will be considered. Entries that do not comply with these terms and conditions, may be deemed invalid. All entries will be judged by a judge appointed by the Promoter in its absolute discretion at the offices of Seven Network Operations Limited, 38-42 Pirrama Road, Pyrmont NSW 2009 Australia on Monday 24 September 2018 at 10:00 (AEST). The entrant(s) whose entry is judged as the most creative entryout of all entries received will be deemed the winner. The Competition is a game of skill and chance plays no part in determining the winner.
5.2 The major prize winner will be notified by a phone call within 24 hours of the draw, and a letter or email advising the winner of their prize will also be sent.
5.3 The major prize winner will be required to complete a prize acceptance form including liability and publicity waiver and provide a copy of their official photo ID within 24hrs of being notified as the winner to formally accept the prize. The selected guest will also have to complete a prize acceptance form including liability and publicity waiver and provide a copy of their official photo ID within 24hrs of winner notification to accompany the winner.
5.4 In the event that the first prize winner does not meet the above prize acceptance deadline or cannot be contacted, the next reserve winner judged will have 24hrs (after the 24hrs from the first winner being notified has lapsed) to complete the prize acceptance paperwork.
5.5 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
5.6 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
5.7 The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional draw will be conducted.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation.
6.2 Seven Network (Operations) Limited (the Promoter), 33 Degrees Worldwide Pty Ltd, Toyota Motor Corporation Australia Limited, Australian Football League (AFL) their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 Seven Network (Operations) Limited (the Promoter), 33 Degrees Worldwide Pty Ltd, Toyota Motor Corporation Australia Limited, Australian Football League (AFL) their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the draw;
b) in the acceptance, participation or use of any element(s) of the prize;
c) as a consequence of late, lost or misdirected mail;
d) due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
e) in relation to failure of an online entry to be received by the Promoter on account of technical problems or traffic congestion; or
f) arising from or related to any problem or technical malfunction of any communications network related to or resulting from participation in this promotion.
6.4 The Promoter and Prize Sponsor shall not be responsible for, and excludes all liability for any personal injury, loss or damage whatsoever, arising out of the use of the prize.
6.5 Seven Network (Operations) Limited assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available, subject to state government legislation.
6.6 If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation.
6.7 By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. Neither the Promoter nor the Prize Sponsor are responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel.
6.8 Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
6.9 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Prize Sponsor (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
