    STANDARD TERMS

1.1                    Information on how to enter forms part of the terms and conditions of entry.

 

    2.                       WHO CAN ENTER?

2.1                    Subject to clause 2.3, entry is open to residents of Australia, 18 years if age or older, where the Channel Seven (and affiliates) television signal is received.

2.2                    Employees and their immediate families of Seven Network (Operations) Ltd, Virgin Australia Airlines Pty Ltd (Virgin Australia), Ansible Pty Ltd, and their associated agencies and companies associated with this promotion are not eligible to enter.



 

    3.                       HOW TO ENTER

3.1                    The competition commences on Saturday 3 November 2018 at 00:01 AEDT and concludes on Sunday 11 November 2018 at 23:59 AEDT (“the Competition Period”).

3.2                    Entrants will be required to complete the entry form at https://www.facebook.com/7horseracing/ including but not limited to their first and last name, address, contact details, email address and in twenty five (25) words or less, choose which of the four nominated moments is their favourite Melbourne Cup Carnival Moment is and why.

a)                        Nominated Memorable Moments

i)                    Makybe Diva’s 3rd  consecutive win in 2005

ii)                  Prince of Penzance 100 to 1 win in 2015

iii)                 Red Cadeux V Dunaden finish in 2011

iv)                 2002 Damien Oliver winning for his brother on Media Puzzle.

3.3                    Any cost associated with accessing the promotional websites is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

3.4                    Entrants in the Competition may only enter the Competition once during the competition period.

3.5                    This competition is a game of skill and chance plays no part in determining the Winner.

 

    4.                       PRIZE DETAILS

4.1                    There will be one (1) Winner who will receive the following prize package:

TOTAL MAXIMUM PRIZE POOL VALUE $43,950.00

Total maximum prize pool value for the prize is $43,950.00. Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.

4.3                In accepting the prize the Winner agrees to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the Winners grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the Winners will not be entitled to any fee for such use.

4.4                The Winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

4.5                It is a condition of accepting the prize that the Winner and their companion must comply with all the conditions of use of the prize and the Promoter’s requirements.

4.6                The prize is valid until 30 October 2019 and is subject to availability. Blackout dates may apply (including but not limited to 20 December 2018 – 30 January 2019, Easter 2019).

4.7                The Winner and their companion must travel from Melbourne.  Any transit costs associated with reaching Melbourne are the responsibility of the prize Winner and companion.  The Winner and their companion must travel at the same time.

4.8                In the event that an element of the prize outlined in the above is cancelled or postponed for any reason, the Promoter reserves the right to substitute with a similar product of equal or greater value.  If the Winner forfeits a specified element, no cash alternative offer will be granted in lieu of the part of the prize.  In the event that weather conditions prevent operation of the yacht, at the determination of the Captain and yacht safety requirements, this portion of the prize will be cancelled and the Winner will not be offered any cash or alternative offer in lieu of the part of this portion of the prize.  Food and beverage is not included in the cruising options and any expenses are at the responsibility of the Winner and their companion.

4.9                A credit card imprint or cash deposit will be required from the Winner at check-in to the hotel, for all incidental charges.

4.10             Prizes are not redeemable for cash and are not transferrable or exchangeable.

4.11             By accepting the Prize, the Winner must comply with these terms and conditions and Virgin Australia’s conditions of carriage which are located on the Virgin Australia website at www.virginaustralia.com.  To redeem the2x return Business class Melbourne to Queenstown flights, the Winner(s) must contact Virgin Australia to book flights on Prize.Winners@virginaustralia.com. This team operates Monday – Friday 09:00 – 17:00 AEST. If for any reason, the Winner does not, once the flights have been booked, notify Virgin Australia at least 24 hours prior to scheduled departure that they are unable to take the booked flight at the time stipulated, their Prize will be forfeited and cannot be redeemed for cash. Tickets are non-transferable (i.e. no name changes allowed after booking). All bookings need to be made at least 7 days prior to travel. The Prize flights will not earn Velocity points. The Prize cannot be redeemed for cash.

4.12             To redeem the 2x nights’ accommodation, the Winner (s) must contact Eichardt’s hotel reservations on +6434410450 or stay@eichardts.com to discuss preferred accommodation dates.

4.13             The winner and winner’s companion must hold a valid Velocity membership account or sign up to Velocity to receive the Velocity Points prize. The Velocity points will be credited to the Winner’s account and Winners travel companions account within 45 days of the winner being contacted. Points will be allocated to the Velocity Member’s Account and Winner’s travel companion account only. Value is based on a sample of the Velocity Frequent Flyer Points options that could be obtained by redeeming the prize through the Velocity Frequent Flyer Points program at the time of this Promotion. The estimate of value is provided for the purposes of licensing this promotion only – the value of the Velocity Frequent Flyer Points will vary depending on how and when the Velocity Points are redeemed by the Winner through the Velocity Frequent Flyer Points program. Use of points is subject to the Velocity Members Terms and Conditions, which are located on the Velocity Frequent Flyer website at: https://www.velocityfrequentflyer.com/content/TermsConditions/Velocity

4.14             Further terms and conditions apply, as stipulated on the Prize Certificate.  It is the Winner’s responsibility to ensure that they have requisite visas, vaccinations, valid documentation (including but not limited to valid passports and visas) which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Winner. The Winner is responsible for all other expenses including spending money, meals, drinks, transfers, laundry charges, activities, incidentals, taxes, energy surcharges, gratuities, service charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.  Seven Network (Operations) Limited and Virgin Australia makes no representation as to the safety, conditions or other issues that may exist at any destination or as part of the prize.

4.15             The Winner must sign a prize acceptance and release form at the time of accepting the prize.

4.16            Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

4.17            This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions.     5.                   HOW TO WIN

5.1                There will be One (1) Winner.  Each entrant who has entered the Competition in accordance with these terms and conditions during the Competition Period registering all details required by 23:59 AEDT Sunday 11 November 2018 (“Qualifying Entrant”) will be entered for judging.  Entries that do not comply with any of the terms and conditions, may be deemed invalid and a further judging will be conducted in its place.  The judging will take place at Seven Network (Operations) Limited, 38-42 Pirrama Road, Pyrmont NSW 2009 on Friday 16 November 2018 from 10:00 AEDT.

5.2                The Winner will be the entry that is judged by the panel of judges as the most creative and original entry received.

5.3                The Winner will be notified by a phone call from the Promoter on the day of the judging, and a letter advising the Winner of their prize will also be express posted. The Winner’s entry details will be published on https://www.facebook.com/7horseracing/ from Monday 19 November 2018.  The Promoter’s decision is final and the Promoter will not enter into any correspondence regarding the result.

5.4                All reasonable attempts will be made to contact the Winner.  If the Prize remains unclaimed by the Winner or unallocated or forfeited for any reason, by 23:59 AEST on Wednesday 19 December 2018, the Prize will be re-allocated to the entrant that has submitted the entry which best meets the judging criteria not including the entrant who failed to claim their prize.  This Unclaimed Prize Determination will take place at Seven Network (Operations) Limited on Thursday 20 December 2018 from 10:00 AEDT.  The Winner will be notified by a phone call from the Promoter on the day of the judging, and a letter advising the Winner of their prize will also be express posted. The Winner’s entry details will be published on https://www.facebook.com/7horseracing/ from Friday 21 December 2018.  The Promoter’s decision is final and the Promoter will not enter into any correspondence regarding the result.

 

6.             NO LIABILITY

6.1                In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions.

6.2          Seven Network (Operations) Limited, Ansible Pty Ltd, Virgin Australia Airlines Pty Ltd (Virgin Australia) and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.3          Seven Network (Operations) Limited, Ansible Pty Ltd, Virgin Australia Airlines Pty Ltd (Virgin Australia) and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

a)     during the draw;

b)    in the acceptance, participation or use of any element(s) of the prize;

c)     as a consequence of late, lost or misdirected mail;

d)    due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;

e)     in relation to failure of an SMS entry message to be received by the Promoter on account of technical problems or traffic congestion; or

f)     arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion.

6.4          Seven Network (Operations) Limited and its associated agencies and companies assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.

6.5          If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition.

6.6          By entering the competition, and by collecting a prize, the Winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the Winner is travelling. It is the responsibility of the prize-Winner to enquire about local issues and conditions at destinations prior to travel.

7.             PROMOTER AND SPONSOR’S DETAILS

7.2          The Sponsor is Virgin Australia Airlines Pty Ltd (Virgin Australia) (ABN 36 090 670 965) of 56 Edmondstone Road, Bowen Hills QLD 4006.

7.3          Entry details remain the property of the Promoter.  Seven Network (Operations) Limited (ABN 65 052 845 262) and its related entities (“Seven”), is collecting your personal information for the purpose of conducting and promoting this Competition, including for the purpose of identifying and notifying the Winner and understanding our audiences.  Seven will otherwise handle your personal information in accordance with Seven’s Privacy Policy which is available on our website at http://www.sevenwestmedia.com.au/privacy-policies (and which contains information regarding how you can access your personal information, correct it and/ or make a complaint about our handling of your personal information).  By providing your personal information below, you agree to the terms of the Privacy Policy.  Without limiting the foregoing, Seven may disclose the entrant’s personal information to its related entities, business partners and external service providers for research and profiling purposes as well as other purposes reasonably related to the entrant’s relationship with Seven.  In addition, by entering this competition, you consent to Seven using your personal information for the purpose of Seven and its related entities sending you information regarding programs, products and services available through them and/ or through their business partners, and to Seven from time to time sharing your personal information with carefully selected business partners for the purpose of them sending you such information directly.  We will always provide you with the ability to opt out of those communications. www.sevenwestmedia.com.au

7.4          The personal information provided by entrants for this Promotion will be disclosed to Virgin Australia Airlines Pty Limited and its related companies for the purposes providing any prize to you.  If Virgin Australia cannot collect your personal information, it will not be able to provide you with a prize. Virgin Australia may also disclose your personal information to and/or collect your personal information from its related companies (including Velocity Frequent Flyer Pty Ltd and Velocity Rewards Pty Ltd) and third parties who provide (or help Virgin Australia provide) products and services related to a prize.
