TERMS
Information on how to enter forms part of the terms of entry. Entry into Koala’s #homemadewithtessandluke Pinterest Competition (Competition) is deemed acceptance of these terms and conditions. The promoter is Koala Sleep Pty Ltd (Koala) whose registered office is at Unit 12, 37-41 O’Riordan Street, Alexandria, NSW 2015, Australia.
WHAT IS THE COMPETITION
The Competition is a game of skill. The best Home: Made with Koala board showing inspo from Australian brands will win.
HOW TO ENTER
Entrants can enter the competition by completing the following steps:
Follow Koala on Pinterest @koala.com;
Creating a Pinterest Board called ‘Home: Made with Koala’
Re-pin at least one Koala’s Pin with the description “contest” so we know you want to enter the competition.
Start pinning up to 10 other pins of any of your favourite local Australian brands to the Board;
When complete DM us your board: homemade@koala.com.
ELIGIBILITY TO ENTER
The Competition is open to residents of Australia aged 18 years or over, except for employees of Koala and their close relatives, and anyone otherwise connected with the organisation or judging of the competition.
Koala reserves the right to verify eligibility of all entrants. Koala also reserves the right to disqualify and remove any entries based on suspicion of infringement of any third party rights or if Koala has reasonable grounds to believe that the entrant has breached these Terms and Conditions.
COMPETITION PERIOD
The competition commences on at 09:00 AEST on Tuesday 1 July 2020 and closes on at 23:59 AEST on 31 July 2020 (Competition Period). The Competition may be advertised on Koala’s website, Pinterest and other social media sites.
This competition is not sponsored, endorsed or administered by Pinterest or any other social media platforms. These terms and conditions are in addition to Pinterest Terms of Service.
Entries must be received prior to the end of the Competition Period to be included in judging to win the Prize. Each valid entry received over the duration of the Competition Period will be entered into the judging. Each entrant may only submit one entry.
The time of entry will in each case be the time the online entry DM’ed to
homemade@koala.com. Koala and associated agencies accept no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
PROHIBITED CONTENT
Entries must not contain images, words or content that is offensive, rude, defamatory or racist or breaches Pinterest Community Guidelines. Any entry which the judges deem inappropriate will be invalid. The Entrant agrees to indemnify Koala.
HOW ENTRIES WILL BE JUDGED
This is a game of skill; chance plays no part in determining the winner. Incomprehensible and incomplete entries will be deemed invalid.
The judge will be the creative team at Koala (Judge). The Winner will be judged from all entries received throughout the Competition Period and one prize winner will be selected by the Judge at 10:00 AEST on 3 August 2020. The Winner will be the entrant who, in the sole opinion of the Judge, has submitted an entry with the most inspirational board. The Judge’s decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
KOALA’S RIGHTS
Entrants retain rights of ownership of their boards and any original pins, however in consideration of Koala providing the Competition, entrants specifically grant Koala a non-exclusive, transferable, sub-licensable, royalty free, worldwide licence to moderate and use the entered Board for any of Koala’s promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. Koala is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
Koala reserves the right, at any time, to verify the validity of entries and entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.
ENTRANT’S OBLIGATIONS
Entrant must personally submit their entry - entrants submitted by agents or third parties will not be accepted. Entrants must ensure that any images they upload to Pinterest comply with Pinterest’s copyright policy. Entrant warrants they have obtained the relevant copyright permission to submit their entry for the purposes of this Competition. Entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
WINNER AND PRIZE
Winner will be contacted via a direct message on their Pinterest account or a comment on their winning entry within three days of the competition closing date. Winner must respond to the direct message or comment within three days to claim their prize. All reasonable attempts will be made to contact the Winner. If the Prize remains unclaimed by the Winner or unallocated or forfeited for any reason, by 10 August 2020 at 09:30 AEST, the Prize will be re-allocated to the entrant who has submitted the entry which next best meets the judging criteria.
Once claimed, the Winner’s details will be published in a method determined by Koala. It is a condition of accepting the prize the Winner may be required to sign a legal release in a form determined by Koala in its sole discretion. In consideration for Koala awarding the prize to the Winner, the Winner hereby permits the Winner’s entries to be used by Koala in its advertising or marketing, in any media whatsoever through the world and the Winners will not be entitled to any fee for such use.
The Prize consists of a 3 seater Koala sofa, a tall and narrow Koala bookshelf and the Mette Vase and Iver Spot Cushion from Inartisan. Total prize is valued $1,900.
No cash or other alternatives will be offered. The prizes are not transferable..
PRIVACY
Entrants consent to Koala collecting their personal information for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying the Winner and prize fulfilment). Your personal information may be disclosed to any regulatory authority or third party or published as required as a result of entering this competition and as required as a condition of running the Competition. If you are not willing for this to occur you cannot participate in the Competition.
Personal information disclosed to Koala will be handled in accordance with Koala’s Privacy Policy.
OTHER
Koala shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
Koala is not responsible for any incorrect or inaccurate information, either caused by the user or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of Koala, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, Koala reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to government legislation.
