1. The ‘Great Grocery Giveaway’ (Promotion) commences from 9am on Thursday 6 August 2020 until 6pm Sunday 13 September 2020 (AEST) (Promotion Period)
2. The Promotion is promoted by Forest Hill Chase, (Promoter) ABN 81 390 392 465, located at 270 Canterbury Road, Forest Hill, 3131.
3. Instructions on how to enter form part of these Terms and Conditions, and all entrants (Entrants) will be subject to, and will need to adhere to, the terms and conditions as set out by
the Promoter.
4. Information on how to enter and prizes form part of these conditions. Participation in the “Great Grocery Giveaway” promotion (“Promotion”) is deemed acceptance of these Terms
and Conditions. The Promoter reserves the right to amend these terms and conditions at any time.
PROMOTION PERIOD
5. The competition will commence at 9am Thursday 6 August 2020 and conclude at 6pm Sunday 13 September 2020 “the Promotion Period.”
PRIZES
6. The first valid entry drawn and verified in accordance with conditions will win the major prize of: 4 x $500 monthly Forest Hill Chase gift cards.
7. All gift cards will only be valid for 1 month and the date will be specified on the gift card. Gift cards will be issued on the 1st of the month (September 2020, October 2020, November
2020 and December 2020) Any unspent funds will not roll to the following month or transferred to cash.
8. The total value of the major prize is $2,000 (inclusive of GST).
9. The prize is not transferable, refundable or exchangeable, no change will be given and cannot be taken as cash.
10. In the event that any prize (or any part of a prize) becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize (or the relevant part of the
prize) with a prize of equal or greater value.
HOW TO ENTER
11. To receive an entry in this Promotion, eligible individuals must, during the Promotion Period, undertake the following steps:
(i) Spend $50 or more in any single day during the Promotion Period at any of the Participating Retailers at the Participating Centre, excluding any invalid receipts. For clarity,
the Qualifying Spend can be made by multiple purchases at multiple Participating Retailers, however, all purchases must be made at the Participating Centre, on one (1) day,
during the Promotion Period.
(ii) Participating stores include: Colonial Fruit Co., Dench Meat & Chicken, Hills Poultry Chicken, Fish Pier, Plucka Chicken, Bakers Delight, Foodness Asian Supermarket, Long Life
Health Food, Sweet Bee, Yang Yang Asian Grocery, Coles, ALDI, Woolworths, The Reject Shop.
(ii) Fully complete the official entry form on the Forest Hill Chase website www.foresthillchase.com.au during the Promotional Period. Entry form must include their full name, valid
email address and contact phone number.
(iii) Retain their own original valid receipt(s) recording the Qualifying Spend, which must specify the store and date/time of purchase(s) to be presented if they are a winner of the
promotion.
ELIGIBILITY
12. Entry is open to all residents within a 5km radius of Forest Hill Chase who are 18 years and over.
13. The following are ineligible:
(i) employees of the Promoter or employees of the Promoter’s agencies that are associated with the Promotion;
(ii) the spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and
(iii) any person who the Promoter has previously notified is not permitted to enter the Promoter’s promotions.
14. The Promoter reserves the right, at any time, to verify the eligibility of any Participant (including a Participant’s identity, age and place of residence) and to disqualify any Participant
who does not comply strictly with these Terms and Conditions or who tampers with the entry process. Incomplete, indecipherable or illegible entries will be deemed invalid. If requested
by the Promoter, a Participant must provide the Promoter with evidence of eligibility. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of
those rights.
INVALID RECEIPTS
15. The following receipts are not valid receipts for the purpose of the Promotion:
(i) receipt(s) from non-participating retailers and excluded retailers;
(ii) receipt(s) recording bill payments and prescription medicine, mobile phone recharge cards, go card purchase/recharge, home delivery invoices/receipts, lottery tickets, liquor
and tobacco and tobacco related product purchases;
(iii) receipts recording redemption of gift card purchases, store credit, refunds and exchanges;
(iv) ATM or EFTPOS receipts;
(v) credit card or bank statements;
(vi) receipts that the Promoter has reasonably determined to have been tampered with or have been obtained fraudulently or are a reprint of the original receipts. The same purchase
receipt can only be submitted once in the Promotion. The Promoter reserves the right to stamp and/or photocopy each purchase receipt submitted in the Promotion before
returning them.
DRAW DETAILS
16. The winner will be randomly drawn on Monday 14 September 2020. Winners will be contacted directly by phone and announced www.facebook.com/foresthillchase.com.au on
Tuesday 15 September 2020.
17. The Promoter may, but is not obliged to, publish the results of the Promotion. By participating in the Promotion, the Participant gives their consent for their personal details to be
published in the manner prescribed in this clause if they are a winner of the major prize or a runner up prize.
18. The winner will need to present proof of identity as well as a copy of their receipts to claim the prize.
19. The Promoter’s decision is final and binding and no correspondence will be entered into in relation to the conduct of the Promotion or otherwise.
20. If despite every reasonable effort the winner/s of any of prize cannot be contacted, the prize will be forfeited.
OTHER GENERAL TERMS
21. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
22. All Promotion entries are the property of the Promoter.
23. The Promoter Entities shall not be liable (including, without limitation, in negligence) for:
(i) any loss or damage whatsoever that is suffered (including, but not limited to, indirect or consequential loss); or
(ii) any personal injury suffered or sustained, during the course of participating in this Promotion or using the Gift, except for and to the extent that any liability cannot be excluded
by law.
24. Each Participant indemnifies and keeps indemnified the Promoter Entities against all claims, losses, damages, costs and expenses suffered or incurred by the Promoter Entities or
any third parties arising out of the breach of these Terms and Conditions by the Participant, the conduct of the Participant in the Promotion or the use of the Gift by the Participant.
25. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the
Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to any written directions from a regulatory authority (if any) to:
(i) disqualify any Participant; and/or
(ii) modify, suspend, terminate or cancel the Promotion as appropriate.
26. Any decision made by the Forest Hill Chase Marketing Department in respect of the Promotion is final and binding and no correspondence will be entered into.
PRIVACY
27. By partaking in the Promotion, entrants agree that the Promoter may use information provided on an Entry or in connection with claiming the Prize in accordance with Forest Hill
Chase’s Privacy Statement. A copy of Forest Hill Chase’s Privacy Statement can be found at www.foresthillchase.com.au.
28. The Promoter will collect and use the information which the Participant has provided for the following purposes:
(i) carrying out the Promotion; and
(ii) if the Participant has accepted to receive future promotional communications from the Promoter, carrying out marketing and promotions activities including, without limitation,
sending newsletters or publications and/or other marketing and promotional material to the Participant about the Promotions or promotional events (whether or not undertaken by
or about the Promoter or any other person or organisation) and supplying the information to contractors which assist the Promoter to do this.
29. By entering the Promotion, a Participant consents to the collection and use of his or her information in the manner outlined in these Terms and Conditions.
30. If a Participant would prefer that the Promoter does not use the Participant’s details in the away outlined in these Terms and Conditions and/or retain their details, the Participant
should contact the Promoter on (03) 9878 7111. The Promoter will take all reasonable steps to keep personal information secure from misuse, loss or unauthorised use or disclosure.
