1. Information on how to enter and the prize forms part of these Conditions of Entry. Entry into the Termiturf Hawaiian Getaway (Promotion) is deemed to be an acceptance of these Conditions of Entry.
2. “Promotion Website" means
www.termiturf.com.au .
3. “Entrant” means the person whose name is listed as the product purchaser.
4. The Promotion commences12.00 am AEST on 24hOctober 2015 and closes at 5.00 pm AEST on 31March 2016(Promotion Period).
4.1. Entry is only open toAustralian residentsaged 18 years and over. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of the Promotion, are ineligible to enter.
5. To enter the Promotion, the Entrant must during the Promotion Period:
5.1. Purchase and pay in full for the Termiturf product to a minimum value of $1,500.00 (GST Inc.) from an approved Termiturf distributor. Proof of purchase will need to be retained by The Entrant and provided upon request. The Entrant will receive one entry into the Promotion.
5.2. Pay in full for the installation, to a minimum value of $1,500.00, of the Termiturf product. The installation can only be performed by anaccredited Termiturf contractor through Termi Home & Commercial (SA) or Termi Home & Commercial (QLD). The Entrant will receive an additional four entries into the Promotion.
5.3. Entrants must register their entry via the Termiturf website and provide proof of their purchase and/ or installation. No other form of registering entries is permitted or eligible. The Promoter may reject website entries if they have been entered using automated entry means.
6. The prize consists of an airfare voucher valued at AUD $3,000.00 for 2 people to Honolulu from the capital city nearest to the winner`s residence, 5 nights` accommodation to the value of AUD $2.000.00 at the Outrigger Hotel, Waikikifor 2 people and AUD$1,000.00 spending money. Airport transfers, taxes, insurance (including travel insurance) and all other ancillary costs are the responsibility of the winner and his / her travelling companion.
7. The Promotion is available only to residents of South Australia and Queensland.
8. Records of the Promoter are final and conclusive as to time of receipt.
9. An entrant can enter more than once.
10. All valid entries received during the PromotionPeriod will be entered into the draw. The random draw will be held at 12.00pm on the 12thApril 2016 at the offices of Termi Home & Commercial, 70 Goodwood Road, Wayville, South Australia 5034.
11. The winner will be notified within 2 days of the draw by a phone call and/ or email, using the details provided in their entry.
12. The name of the winner will be published on the Promotion Website and in The Australian newspaper by 15 April 2016.
13. The Promoter may conduct such further draws at the offices of Termi Home & Commercial, 70 Goodwood Road, Wayville, South Australia 5034as are necessary on 30 June 2016 for an unclaimed prize, subject however to any directions given by any applicable gaming authorities. The winners of any unclaimed prize will be notified by phone or email and details of the winner of any unclaimed prize draw will be published on the Promotion Website and in The Australian newspaper on 8 July 2016.
14. There is one prize only, the first valid entry randomly drawn will win the prize.
15. All components of the prize must be taken together, the prize cannot be used in conjunction with other travel discounts or special offers and frequent flyer points will not be accrued.
16. The value of the prize is accurate and based upon the recommended retail prices at the state of the Promotion. The Promoter accepts no responsibility for any variation in the value of the prize after that date. The prize (including any unused portion) cannot be transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the prize with a prize of equal or greater value (including where the prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.
17. The Promoter`s decision is final, and no correspondence will be entered into, including in the event of a dispute. The prize must be taken as offered and cannot be varied.
18. The Promoter reserves the right to validate and check the authenticity of entries, and to disqualify any entrant for tampering with the entry process, or who submits an entry that is not in accordance with these Conditions of Entry. Any entry made with stolen, forged, mutilated, unrecognised or tampered means will be deemed void.
19. The Promoter and its associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries.
20. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the prizes and these Conditions of Entry, subject to approval of the gaming authorities in each State and Territory where relevant.
21. Any tax liability arising as a result of accepting any prize is the responsibility of the winner.
22. The Promoter and its agents will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize except for any liability which cannot be excluded by law.
23. If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these conditions of entry, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.
24. All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant`s personal information to administer the Promotion, announce the winner and disclose the entrant`s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter`s privacy policy (which is available on request). By entering into this Promotion, each entrant also consents to the Promoter using their personal information for future marketing purposes,unless otherwise advised by the entrant. Entrants must specifically opt in to receiving future marketing if consented to by the entrant. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.

26. It is a condition of accepting the prize that the winner and accompanying person will be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.
27. The prize must be taken completely within 12 months of the date of the drawing of the prize but on winner`s choice of dates subject to booking and flight availability at time of booking The Promoter accepts no responsibility for the cancellation or rescheduling of any flights.
28. The winner and their travelling companion must travel to Honolulu on the same flight and stay in the same room. Length of stay can be extended at the winner`s own expense.
29. If for any reason the winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner.
30. No compensation will be paid if the winner is unable to take the prize. The prize is not transferrable.
31. It is the winner`sand their nominated travel companion`s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at the destination. Any fines, penalties, payment or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the winner and their nominated travel companion.
32. The winner agrees to participate in any news media activities surrounding the Promotion. The Promoter reserves the right to use the winner`s name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity without additional compensation.
