Menulog mobile application (the “Competition App”);

submit an order to purchase products via the Competition Website or the Competition App from a Participating Venue; and
c.enter the code “Bachie”at the time of submitting the order,
(each an “Eligible Purchase”).

Entrants may submit multiple entries. However, only one entry is permitted per Eligible Purchase.
Limit applies of one Prize per person.

All entrants must retain, as proof of an Eligible Purchase, their original receipt for the order they submitted in order to enter the competition. The Promoter may, as a precondition to a winner claiming a Prize, require the original receipt to be produced.

TERMS AND CONDITIONS:

1. These terms and conditions contain information on how to enter this competition and the prizes
available. Entries must comply with these terms and conditions to be valid.
2. The Promoter is Menulog Pty Ltd (ACN 120 943 615) Level 23, 227 Elizabeth Street Sydney NSW 2000,
telephone no. 1300 664 335 (the “Promoter”).
3. The competition will run from 12.00 AEST Monday, 5 September 2016 until 23.59 AEDT Monday, 3
October 2016 (the “Promotional Period”). Entries received after 23.59 AEDT Monday, 3 October
2016 will not be accepted. Entries are deemed to be received at the time of receipt by the Promoter,
not at the time of electronic transmission by the entrant.
4. The competition is open to individual residents of Australia aged 18 or over, except:
a. directors, management and employees (and their respective Immediate Families) of the
Promoter; and
b. the Promoter's retailers, suppliers, associated companies and agencies who are associated
with this competition including Participating Venues, Network Ten Pty Limited (ACN 052 515
250) and their directors, management and employees (and their respective Immediate
Families).
Immediate Family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild
(whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle,
aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
Participating Venue means any venue which provides products via the website
www.menulog.com.au and/or any Menulog mobile application.
5. To enter this competition you must, during the Promotional Period:
a. either visit the website www.menulog.com.au (the “Competition Website”) or use any
Menulog mobile application (the “Competition App”);
b. submit an order to purchase products via the Competition Website or the Competition App
from a Participating Venue; and
c. enter the code “Bachie” at the time of submitting the order,
(each an “Eligible Purchase”).
6. Entrants may submit multiple entries. However, only one entry is permitted per Eligible Purchase. Limit
applies of one Prize per person.
7. All entrants must retain, as proof of an Eligible Purchase, their original receipt for the order they
submitted in order to enter the competition. The Promoter may, as a precondition to a winner claiming
a Prize, require the original receipt to be produced.
8. The Promoter takes no responsibility should a person not have the software, hardware or mobile plan
that permits access to, and use of, the Competition Website or the Competition App. Any costs
associated with accessing the Internet, downloading data on a mobile device, or using any device to
access and use the Competition Website and/or the Competition App is the sole responsibility of the
entrant and is dependent on the Internet/mobile service provider used.
9. There will be five (5) Prizes in total to be won, one Prize for each one of five prize draw areas, being
(a) New South Wales / Australian Capital Territory, (b) Victoria / Tasmania, (c) Queensland, (d) South
Australia / Northern Territory and (e) Western Australia. Entrants who are residents of a particular
prize draw area will only be entered into the Prize draw for the Prize for that prize draw area (e.g. an
entrant who is a resident of NSW will only be entered into the Prize draw for the NSW / ACT Prize).
10. The Prizes are:
a. The NSW / ACT Prize comprises, for the winner and a travel guest aged 18 years or over
chosen by the winner (the “Travel Guest”):

i. 1 night twin-share accommodation at the Shangri-La Hotel in Sydney in a Deluxe
Harbour View room (or similar) including breakfast;
ii. 20 minute private sunset helicopter flight over Sydney;
iii. dinner at Quay Restaurant (8 course tasting menu with accompanying wines); and
iv. 1 hour Signature Aroma Journey Massage at CHI, the Spa at the Shangri-La Hotel in
Sydney.
b. The Vic / Tas Prize comprises, for the winner and the Travel Guest:
i. 1 night twin-share accommodation at the Woodman Estate on the Mornington Peninsula
in a Spa Suite (or similar) including breakfast and late check out at 11am;
ii. access to rowboats on the lake at the Woodman Estate;
iii. pass to bathe in the Bathhouse pools at the Peninsula Hot Springs;
iv. dinner at The Brasserie at the Woodman Estate (2 course a la carte); and
v. 2 hour private twilight horseback beach ride along St Andrews Beach.
c. The Qld Prize comprises, for the winner and the Travel Guest:
i. 1 night twin-share accommodation at the Sofitel Gold Coast Broadbeach in a Luxury
King Spa Room (or similar) including breakfast;
ii. 2 hour sunset sailboat cruise departing from Main Beach with sparkling wine, fresh
seafood dinner and dessert;
iii. return ground transfers to and from the hotel to O'Reilly's Grand Homestead;
iv. 30 minute hot air balloon ride at O'Reilly's Grand Homestead with breakfast and
champagne and including expert interpretive commentary and hot air balloon ride
commemorative certificate;
v. access to O'Reilly's Grand Homestead and Vineyard; and
vi. A$200.00 spending money (for the winner only).
d. The SA / NT Prize comprises, for the winner and the Travel Guest:
i. 1 night twin-share accommodation at the Playford Hotel Adelaide in a Studio Spa King
Suite (or similar) including breakfast;
ii. 65 minute daytime coastal beaches scenic flight;
iii. chocolate tasting and tour at the Haigh's Chocolate Factory, with A$100.00 spending
money (for the winner only) to spend at the Haigh's Chocolate Factory;
iv. 1 hour gondola ride along the River Torrens including glass of wine;
v. return ground transfers to and from the Playford Hotel Adelaide to Windy Point; and
vi. dinner at Windy Point Restaurant (7 course degustation menu with matched wines).
e. The WA Prize comprises, for the winner and the Travel Guest:
i. 1 night twin-share accommodation at the Pullman Bunker Bay Resort in a Studio Lake
View King room (or similar) including breakfast;
ii. return helicopter flight to a private beach in the Margaret River Region (with flexible
drop off and pick up time);
iii. gourmet picnic hamper and sparkling wine on ice to be enjoyed at the private beach;
iv. treatment of the winner's choice of up to the value of A$200.00 (in total for both
people) at Vie Spa; and
v. dinner at Other Side of the Moon Restaurant (a la carte up to the value of A$200.00 in
total for both people).
11. The RRP of each Prize is A$2,800.00. The total Prize pool for the competition is RRP A$14,000.00.
Stated Prize values are the recommended retail value (including GST) in Australian dollars, are
provided by the supplier and are correct at the time of printing.
12. All costs not expressly listed in paragraph 10 above, including but not limited to taxes (excluding GST),
fuel, frequent flyer points, meals and beverages (unless specified), in-room charges, transfers (unless
specified), travel and other insurance, incidentals, items of a personal nature and any and all other
ancillary expenses are the responsibility of the winner and the Travel Guest.
13. Each Prize is a single event trip for the winner and the Travel Guest, and cannot be separated into
separate trips or components. The winner and the Travel Guest must depart from and return to the
same departure point, and travel together at all times. The Prizes do not include transport to or from
any locations referred to in the Prizes (unless otherwise specified), either at departure or upon return.
14. The winner and/or the Travel Guest may be required to present a credit card at the time of
accommodation check-in.
15. The Prizes must be taken on the dates specified in paragraph 10 above, and cannot be taken at any
other time.
16. All travel, accommodation and activities are subject to availability at all times. Accommodation may be
dependent on specific room category availability with accommodation partner. All bookings regarding
the Prizes must be made by the winner via Free-2-Travel Holidays Pty Ltd or its agents, and may be
restricted to itineraries, hotels, rooms and any other service providers or prize suppliers chosen by the
Promoter in its absolute discretion. Prizes must be taken by Sunday, 8 October 2017, otherwise Prizes
will be deemed to be forfeited. Block out periods include all Australian School & Public Holidays along
with all other special event periods. All bookings must be made a minimum of 45 days in advance of
requested departure dates. Redeeming the Prizes is conditional on acceptance of the terms and
conditions of Free-2-Travel Holidays Pty Ltd in accordance with normal travel practices. The Promoter
may refuse any requested changes. The winner and the Travel Guest will be solely responsible for the
payment of any change, amendment or cancellation fees incurred as a result of the winner and/or the
Travel Guest changing or cancelling a booking. Any unused portions of the Prizes will be forfeited.
17. The winner of a Prize must immediately provide a copy of these terms and conditions to his or her
chosen Travel Guest. By agreeing to participate in the Prize, each Travel Guest agrees to be bound by
these terms and conditions in the same manner, and to the same extent, as the winner.
18. The winners will be drawn at random at 14.00 AEDT on Monday, 24 October 2016 at the Promoter's
offices at Level 23, 227 Elizabeth Street Sydney NSW 2000 from all eligible entries received prior to the
close of the competition. Winners will be determined by a random manual draw process.
a. The first valid entry drawn from all eligible entries received from entrants who are residents in
NSW and ACT will receive the NSW / ACT Prize.
b. The first valid entry drawn from all eligible entries received from entrants who are residents in
Vic and Tas will receive the Vic / Tas Prize.
c. The first valid entry drawn from all eligible entries received from entrants who are residents in
Qld will receive the Qld Prize.
d. The first valid entry drawn from all eligible entries received from entrants who are residents in
SA / NT will receive the SA / NT Prize.
e. The first valid entry drawn from all eligible entries received from entrants who are residents in
WA will receive the WA Prize.
19. The winners will be notified by email within two days from the draw date and provided with instructions
on how to claim the Prizes.
20. Prize winners' names and residential addresses will be published on the Competition Website within
seven days from the draw date.
21. The winners have until 9.00 AEDT on Tuesday, 24 January 2017 to confirm acceptance of their Prize in
accordance with the instructions provided; otherwise, he or she will be taken to have forfeited his or
her right to any Prize.
22. In the event that a Prize winner cannot be identified or contacted by 9.00 AEDT on Tuesday, 24
January 2017, despite all reasonable attempts to do so by the Promoter, or a Prize is unclaimed by that
time for any other reason whatsoever (including because the winner has forfeited his or her right to
that Prize, the Prize winner does not accept and claim the Prize in accordance with these terms and
conditions, the winner or the winning entry does not comply with these terms and conditions, or
otherwise), the Promoter will conduct a second chance draw at 14.00 AEDT on Tuesday, 24 January
2017 at the Promoter's offices at Level 23, 227 Elizabeth Street Sydney NSW 2000 in order to
determine a second chance winner for that Prize in the same manner as the original Prize draw
(subject to any written directions from a regulatory authority).
23. The second chance Prize winners will be notified by email within two days from the draw date and
provided with instructions on how to claim the Prizes.
24. Second chance Prize winners' names and residential addresses will be published on the Competition
Website within seven days from the draw date.
25. The second chance Prize winner(s) has until 9.00 AEDT on Thursday, 24 August 2017 to confirm
acceptance of their Prize in accordance with the instructions provided; otherwise, he or she will be
taken to have forfeited his or her right to any Prize.
26. The Promoter will make all reasonable attempts to identify and contact each second chance Prize
winner.
27. In the event that a second chance Prize winner cannot be identified or contacted by 9.00 AEDT on
Thursday, 24 August 2017, despite all reasonable attempts to do so by the Promoter, or a Prize is
unclaimed by that time for any other reason whatsoever (including because the second chance winner
has forfeited his or her right to that Prize, the second chance Prize winner does not accept and claim
the Prize in accordance with these terms and conditions, the second chance winner or the second
chance winning entry does not comply with these terms and conditions, or otherwise), the Promoter
may dispose of that Prize as it sees fit (subject to any written directions from a regulatory authority).
28. Before any Prize is awarded, the Promoter may require the winner and the Travel Guest to sign an
agreement or deed to release the Promoter and its associated companies (and one or more of the
service providers or prize suppliers associated with the competition) from, and indemnify the Promoter
and its associated companies (and one or more of the service providers or prize suppliers associated
with the competition) against, any loss, damage or injury arising from the use or participation in any
component of the Prize, except to the extent any loss, damage or injury is due to the negligence or
willful misconduct of the Promoter.
29. The Prizes must be collected by the winners by making bookings in accordance with paragraph 16
above. Neither the Promoter nor any prize suppliers are responsible for delivery of the Prizes to the
winners.
30. Redemption, participation in and acceptance of a Prize is subject to the terms and conditions of any
service provider or prize supplier associated with the competition. The Promoter and all service
providers and prize suppliers associated with the competition expressly reserve the right to eject the
winner and the Travel Guest for any inappropriate behaviour while participating in any element of a
Prize.
31. The winners will be responsible for ensuring they are able to accept the Prize as set out, including any
expenses and arrangements involved in collecting and using the Prizes, and in accordance with these
terms and conditions. Prizes, or any portions of Prizes, are not refundable, exchangeable, replaceable,
redeemable, or transferable for cash under any circumstances. Prizes, or components of Prizes, are
subject to availability and the Promoter reserves the right to substitute any Prize, or component of a
Prize, with a Prize of equal or greater RRP value, subject to any written directions from a relevant
regulatory authority. Winners will not be entitled to any additional compensation in the event that the
Prize (or component thereof) has been substituted at equal or greater RRP value.
32. To the extent permitted by law, the Promoter accepts no responsibility for:
a. any late, lost or misdirected entries or other communications; or
b. any Internet traffic congestion or problems with, or technical malfunction of, any hardware or
software, including but not limited to any damage to the hardware or software of any entrant
or other persons related to participation in the competition.
33. The Promoter reserves the right to reject any inappropriate entries or entries that do not enter into the
spirit of the competition or entries which otherwise do not comply with these terms and conditions, at
its sole discretion.
34. The competition is run by the Promoter and is in no way sponsored, endorsed or administered by any
social media site used to promote this competition, including Facebook and Twitter. To the extent
permitted by law, each entrant, winner and his or her Travel Guest completely release any social media
site used to promote this competition from any and all liability in relation to the competition.
35. The Promoter’s decision is final and binding in all matters relating to the competition and no
correspondence will be entered into.
36. To the extent permitted by law, including the Australian Consumer Law, the Promoter and its
associated companies (including their officers, employees and agents) will not be responsible for any
acts of god, acts of terrorism or war (declared or undeclared), state of emergency, disaster, technical
failures, security breaches, tampering, unauthorised intervention, fraud, computer viruses or other
events beyond the Promoter's control which affect the proper or reasonably anticipated conduct or
administration of the competition, or prevent the awarding of a Prize in accordance with these terms
and conditions. If such an event occurs, the Promoter reserves the right to cancel, terminate, modify or
suspend the competition, subject to any written directions from a relevant regulatory authority.
37. Nothing in these terms and conditions limits, excludes or modifies the statutory consumer guarantees
provided under the Australian Consumer Law in the Competition and Consumer Act 2010 (Cth), or any
other implied warranties under any legislation in Australia. Except for any liability that cannot be
excluded by law, the Promoter and its associated companies (including their officers, employees and
agents) excludes all liability (including for negligence), for any personal injury or any loss or damage

(whether direct, indirect, special or consequential) arising in any way out of the competition, including
but not limited to where such injury, loss or damage arises out of: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised
access or third party interference; (c) any entry or Prize claim that is lost, altered, damaged or
misdirected due to any reason beyond the Promoter's reasonable control; (d) any variation in Prize
value to that stated in these terms and conditions; (e) any tax liability incurred by an entrant, a winner
or a Travel Guest; (f) participation in the competition or any component of a Prize by an entrant, a
winner or a Travel Guest; (g) the conduct, act or omission of any service provider or prize supplier
associated with the competition; (h) cancellation or postponement of any portion of the Prize for any
reason beyond the Promoter's reasonable control.
38. The Promoter reserves the right to request verification of age, identity, residential address and any
other information from any entrant, winner or Travel Guest relevant to entry into or participation in the
competition. Verification is at the discretion of the Promoter, whose decision is final. The Promoter
reserves the right to disqualify any individual who provides false information, fails to provide
information, conspires with others to gain an unfair advantage or who is otherwise involved in any way
in manipulating, interfering or tampering with the competition. Entry forms are void if stolen, forged,
mutilated or tampered with in any way.
39. By submitting an entry, each entrant grants the Promoter a worldwide, non-exclusive, royalty-free
licence (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish,
transmit, display and distribute such entry or any adaptation thereof (or any part of any such entry or
of any such adaptation), in any and all media or distribution methods whether now known or later
developed, without any restrictions and without any payment to the entrant or other consideration of
any kind.
40. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they
are a winner (including photograph, film and/or recording of the same) in any media for an unlimited
period of time without remuneration for the purpose of promoting the competition (including any
outcome) and/or promoting any products manufactured, distributed and/or supplied or services
provided by the Promoter. Entrants also consent to the publication of their names and residential
addresses in accordance with paragraphs 20 and 24 above, in the event they are winners of a Prize.
41. Entries remain the property of the Promoter.The Promoter will handle entrants' personal information in
accordance with these terms and conditions and the Promoter's privacy policy available at
https://www.menulog.com.au/menulog_privacy. By providing their personal information to the
Promoter, each entrant consents to the collection, use, storage and disclosure of that information as
described in the Promoter's privacy policy and these terms and conditions.
42. The Promoter collects personal information about the entrants in order to:
a. conduct and process the competition;
b. promote the competition and the Promoter's products and services to which the competition
relates;
c. to provide entrants with information about the Promoter's products and services and the
products and services of the Promoter's carefully selected and trusted business partners and
related bodies corporate; and
d. for purposes otherwise set out in the Promoter's privacy policy at
https://www.menulog.com.au/menulog_privacy.
The Promoter may collect this information directly from entrants or from third parties.
43. The Promoter may disclose entrants' personal information to third parties that help to process, promote
and conduct the competition (including local lottery authorities, media, providers of the Prizes,
information technology suppliers, communication suppliers and to our carefully selected and trusted
business partners), or as required by Law or a Governmental Agency. If the entrants do not provide
this information, they will not be able to participate in the competition.
44. Each entrant acknowledges that the Promoter may use and disclose their personal information to offer
the entrant products and services that the Promoter believes may interest the entrant. The Promoter
may also disclose the entrants' personal information to the Promoter's related companies or to other
trusted business partners so that they can tell the entrants about their products and services, and to
other companies who assist the Promoter to market its products and services. If an entrant does not
want to receive marketing offers by email or in hard copy, the entrant can contact the Promoter the
entrant can contact the Promoter by emailing enquiries@menulog.com.au or by calling 1300 664 335.

45. The Promoter's privacy policy explains: (i) how the Promoter stores and uses, and how entrants may
access and correct their personal information; (ii) how entrants can lodge a complaint regarding the
handling of their personal information; and (iii) how the Promoter will handle any complaint. If entrants
would like any further information about the Promoter's privacy policies or practices, please contact the
Promoter by emailing enquiries@menulog.com.au or by calling 1300 664 335.
46. Submitting an entry as described above will be deemed acceptance of these terms and conditions.
47. All standard terms and conditions from time to time for use of the Promoter’s website and services
apply for further information please go to: https://www.menulog.com.au/menulog_terms_of_use.
48. These terms and conditions and any dispute or claim (including a non-contractual dispute or claim)
arising out of or in connection with these terms and conditions shall be governed by the laws of New
South Wales and subject to the non-exclusive jurisdiction of the courts of that State.
