Winner will be drawn on Wednesday, 3rd November 2010 & notified by telelphone on the day of the draw, and in writing within 5 business days.


The name of the winner will be published in the public section of The Australian newspaper on Tuesday, 9th November 2010.

 Thomas & Friends Family Trip to the UK

1. The competition is open to all Spotlight VIP Club members residing in Australia and those persons who during the term of the competition register as Spotlight VIP Club members (Member).

2. An individual may become a Member by registering in a store, by phone on 1300 305 405 (Australia) or online at www.spotlight.com.au (Australia) at no charge.  Members are provided with a Club card and membership number.

3. The competition commences at 9.00am AEST on Friday, 1 October 2010 and closes at 5.00pm AEST on Sunday, 31 October 2010 ("the Promotion Period").

4. During the Promotion Period, upon a purchase in any Spotlight store located in Australia or via the Spotlight Shop at Home Service and presentation of the Member’s VIP Club card/membership number, the value of every purchase of Thomas & Friends® licensed products made by a Member will be recorded.  Based on the accumulated total spent by the Member during the Promotion Period (net of any refunds and/or returns), each Member will receive one entry into the competition for each purchase of at least AUD$30.00 on Thomas & Friends® licensed products during the Promotion Period.  In the case of lay-bys, payments made during the Promotion Period in respect of lay-bys will only count towards the Member’s accumulated total spend only if the lay-by is finalised and completed within the Promotion Period.

5. Entries and purchases will be recorded via the Point of Sale (P.O.S) system.

6. All entries shall become the property of the Promoter and no information as to the quantity of entries shall be provided to any Member. Entry details may be used for future promotional, marketing and publicity purposes unless otherwise advised by the Member.

7. The Promoter, its associated agencies and companies, and employees of the Promoter and its associated agencies and companies, and the immediate families of such employees are ineligible to win the prize.

8. The electronic prize draw will take place at Anisimoff Legal at Level 4, 448 St Kilda Rd Melbourne, Victoria 3004 Australia at 1.00pm AEST on Wednesday, 3 November 2010. The drawn result is final and no correspondence will be entered into.

9. The winner will be notified where possible by telephone on the day of the draw, and in writing as far as practicable within two business days and no more than five business days after the date of the draw. The name of the winner will be published in "The Australian" newspaper on Tuesday, 9 November 2010 and on the internet at the Promoter's website, www.spotlight.com.au.

10. The winner consents to their name, town/suburb of residence and a photo of them being published by the Promoter including being published on its internet site, as a condition of acceptance of the prize. Further information will be published only with the permission of the winner.

11. There will be only one winner. The first eligible entry drawn will win a trip for two adults and two children (under 11 years of age) to London, England for seven nights to attend the Thomas 65th Birthday celebrations at Thomas Land in Tamworth, Staffordshire on Saturday, 4 December 2010. The total value of the prize is up to AUD$12,000.00 (subject to travel dates, airfares, point of departure and accommodation rates at the time of booking). Further details of the prize are provided below.  All other costs not included in the prize package are the winner’s responsibility. These include travel insurance, spending money, meals, taxes, additional insurance, additional transfers, items of a personal nature (including but not limited to additional room charges such as pay per view movies, laundry, room service, mini-bar, telephone calls), any upgrades or additional nights and all other ancillary costs are not included and are the responsibility of the winner. Travel documentation, including passports, visas, any other government taxes and all other ancillary costs are the winner's responsibility.

12. The winner must have or acquire valid travel insurance to redeem the prize.

13. The prize is not redeemable for cash.

14. The prize is subject to availability and is only redeemable within one week of the winner being notified as at least one weeks notice must be given so bookings can be facilitated. No extension is possible. Reservations are subject to availability at the time of reservation.

15. During the entire duration of the prize, any person under 18 years of age must be accompanied by their parent(s) and/or legal guardian(s). Please note that blackout periods may apply during peak periods. The winner may be required to present a credit card at the time of check-in to any hotel.

16. If the prize is not claimed by the winner by 5:00pm Wednesday, 10 November 2010, an unclaimed prize draw will be conducted at Anisimoff Legal at Level 4, 448 St Kilda Rd Melbourne, Victoria 3004 Australia at 1.00pm AEST on Thursday, 11 November 2010 at 1.00pm AEST subject to any regulations in a State or Territory. The drawn result is final and no correspondence will be entered into. The winner will be notified where possible by telephone on the day of the unclaimed prize draw, and in writing as far as practicable within two business days and no more than four business days after the date of the unclaimed prize draw. The name of the winner will be published in "The Australian" newspaper and on the internet at www.spotlight.com.au on Tuesday, 16 November 2010.

17. The prize may only be transferred to a person of the winner's choice if that person is over 18 years of age or to a guardian of that person if that person is under 18 years of age. The Promoter must be notified within two business days and by no later than 5:00pm AEST on Tuesday, 23 November 2010, of any transfer.

18. If for any reason this competition is not capable of running as planned, subject to the approval of those authorities which have issued permits for the conduct of this competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition, including to disqualify any individual who tampers with the entry process.

19. If the prize is awarded to a Member and it later becomes apparent to the Promoter that the Member was in breach of any of these terms and conditions, the Promoter reserves the right to reclaim the prize from the Member and conduct an electronic draw at Anisimoff Legal at Level 4, 448 St Kilda Rd Melbourne, Victoria 3004 Australia on Tuesday, 23 November 2010 at 1.00pm AEST and the first eligible entry drawn will be deemed the winner and awarded the prize. The winner will be notified where possible by telephone on the day of the unclaimed prize draw, and in writing as far as practicable within two business days and no more than three business days after the date of the unclaimed prize draw. The name of the winner will be published in "The Australian" newspaper and on the internet at www.spotlight.com.au on Tuesday, 30 November 2010. The drawn result is final and no correspondence will be entered into.

20. The Promoter assumes no responsibility for any error, omission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries. The Promoter is not responsible for any problems or technical malfunction of any equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation or downloading any materials in this competition.

21. The Promoter will take all necessary steps to ensure that entries are properly recorded and stored, but will accept no liability if an entry is not recorded or is lost. If a VIP card/number is not produced at the time of purchase, then that purchase will not be credited against the Member's accumulated total for the purposes of entering the competition. If the P.O.S System fails or if the VIP number is recorded incorrectly, every effort will be made to record the data not captured at the time of the purchase.

22. The Promoter shall not be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or personal injury suffered or sustained arising from or in connection with the competition, any omission to enter a person into the draw, acceptance of the prize or the prize itself, except for liability which cannot be excluded by law.

PRIZES AND VALUES
The prize, with a total value of up to AUD$12,000.00 (subject to travel dates, airfares, point of departure and accommodation) comprises:

- Return economy airfares for two adults and two children (under 11 years of age) to London, England arriving in London on Wednesday, 1 December 2010 and departing from London on Wednesday, 8 December 2010 (valued at up to AUD$8,000.00);
- Seven nights accommodation, including five nights accommodation at St Mark's Apartment, London and two nights accommodation at Drayton Court Hotel, Tamworth (valued at up to AUD$3,500.00);
- Transfers from airport to the hotel and from the hotel to airport in London (valued at up to AUD$250.00); and
- Four tickets to Thomas Land in Tamworth, Staffordshire on Saturday, 4 December 2010 (valued at AUD$250.00).
