Terms and Conditions
1.     This competition is a promotion run by
Fresh Broadcasters Incorporated T/A Fresh FM, Shop 3 Cinema Place, Adelaide, South Australia 5000,  ABN 72 762 191 178;
Ixia Pty Ltd T/A City Holden, 223 Grenfell Street, Adelaide, South Australia 5000, ABN 67 007 891 518, LVD 2063;
and City of Adelaide / Rundle Mall Management Authority, Level 2, 7 James Place, Adelaide, South Australia 5000, ABN 209 037 625 72;
 ("The Promoters").
2.     Entries and information on prizes and how to enter form part of these terms and conditions ("Terms"). Entries not completed in accordance with these Terms are ineligible. Participation in this competition constitutes acceptance of these Terms.
3.     Entrants must be aged 16 years and over and be the holder of a current Australian drivers licence to be eligible to enter.
4.     Employees and their immediate families of the Promoters, related entities and agents of the Promoters are ineligible to enter.
5.     The competition commences 8 November 2010 at 4pm and closes 6pm on 17 December 2010 (“The Promotion Period”). The competition will be randomly drawn at 6.30pm on 17 December 2010 under the Gawler Place canopy in Rundle Mall (at the intersection of Gawler Place and Rundle Mall, Adelaide, South Australia 5000)
6.     The winner will receive a Holden Barina Spark CDX (“The Promotional Vehicle”), 5-door hatch, 5-speed manual transmission vehicle Moroccan Blue colour, valued at $16,790 including GST, dealer delivery, government stamp duty and balance of 3 months registration and compulsory third party insurance. Ongoing insurance and registration will be the responsibility of the prize winner. Any change in the value of the prize between the publishing date and the date that the prizes are claimed is not the responsibility of the Promoters.
7.     Entrants must visit The Promotional Vehicle sometime during the promotion period and fill out an authorised entry form. The location of the vehicle will be advertised daily on Fresh 92.7 and on www.fresh927.com.au. A ‘key-word’ will be placed inside The Car so that it is clearly visible. Entrants will be required to write the predetermined ‘key-word’ on their authorised entry form. Entrants must then also obtain a second predetermined ‘key-word’ from City Holden, 223 Grenfell Street Adelaide and write it on the authorised entry form for it to be eligible for the draw. No fee is payable to enter the competition.
8.     There will be one winner in this competition that will be chosen at random from all eligible entries received. If the first entry drawn is deemed ineligible, indecipherable or illegible, another entry will be drawn, and so on until a winner is announced. The Promoters’ decision is final and no correspondence will be entered into.
9.     Entrants may enter the competition as many times as they like during the promotion period.
10.   The prize is not transferable, exchangeable or redeemable for cash.
11.   The winner will be notified by phone with The Promotional Vehicle presented to the winner in person at a later mutually convenient time and date. Competition results will be broadcast on Fresh 92.7, published in The Advertiser newspaper Friday 24 December 2010 and on www.fresh927.com.au following the presentation of the prize. The winner will receive the prize in person and will be required to participate in a photo, video and/or film session and acknowledge that the promoters have the right to use such publicity photos, videos and/or films in any medium and in any reasonable manner they see fit at no charge to the promoters.
12.   The promoters may publicise, broadcast or otherwise disclose a competitor’s name, character, likeness, statements or any recording of their voice in advertising or promotional activities concerning the competition and may promote or advertise that the winner has won the contest.
13.   Identification which includes a photograph will be required (examples include drivers licence/passport/student card where photo included) when claiming and collecting their prize.
14.   Winners under the age of 18 must be accompanied by a parent or guardian when claiming and collecting their prize.
15.   If a competition winner is unable to be contacted within 4 weeks of the draw (14 January 2011) either by phone or mail, a redraw will occur. In the event that a redraw is required it will be held at 1pm on 17 January 2011 at Fresh 92.7 offices, Shop 3 Cinema Place, Adelaide, South Australia 5000, and the redraw winner will be notified by phone or mail.
16.   All entries become the property of the Promoter. No responsibility is accepted for late, lost or misdirected entries.
17.   The information that entrants provide will be used by the Promoters for the purpose of conducting the competition. The information may also be used to periodically keep entrants informed about the goods and services provided by the Promoters, related entities and its service providers, unless the entrant informs The Promoters otherwise by way of ticking a ‘Do Not Contact’ option on the authorised entry form. By entering this competition entrants consent to the use of their contact details for the purposes described in this clause.
18.   If for any reason this competition is not capable of being conducted by the Promoters as intended, whether because of computer virus, mobile phone failure, bugs, tampering, unauthorised intervention, fraud, technical failures, war, terrorism or any other cause beyond the reasonable control of the Promoters which in the Promoters’ opinion affects the administration of the competition, security, fairness or integrity, the Promoters may in their sole discretion, cancel, modify or suspend the competition, subject to the approval of the gaming authority in South Australia as may be required.
19.   The Promoters will not be liable for any loss or damage or for any personal injury sustained as a result of taking the prize or entering into this competition. The Promoters makes no representations or warranties as to the quality, suitability or merchantability or any goods or services offered as prizes. To the extent permitted by law, the Promoters are not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner.
