TERMS & CONDITIONS

1. Information on how to enter and the prize form part of these Terms and Conditions of Entry.

2. Entry is only open to permanent residents of Australia who, by entering the promotion, agree to assigning their rights and interests in their entry to the Promoter in accordance with these Terms and Conditions. Multiple entries will be accepted but each entry must be submitted separately. The Promoter's employees and their immediate families and its agencies, and companies associated with the promotion are ineligible to enter. Incomplete or incomprehensible entries will be ineligible.

Eligible entrants must answer the question in the promotions section on the Music Australia Guide website, and answer the following qualifying question: In which year did Hendrix first record a version of Hound Dog for BBC radio audiences?

3. The promotion commences on Friday 17th December 2010 and concludes on Thursday 23rd December 2010 at 12pm (AEST). All entries must be emailed via the Music Australia Guide website during the promotional period.

4. Eligible entrants must provide their full name, address, postcode and telephone number (“personal information”) so they can be notified if they are selected as winners.

5. The Promoter reserves the right to verify the validity of any entry. Information considered suitable for verification is at the Promoter's discretion and may include proof of identity and residency. The Promoter may require the prize winner to sign a declaration confirming their eligibility to enter and accept the prize.

6. The Promoter reserves the right to disqualify any entrant whose entry does not comply with these Terms and Conditions, or who tampers with the entry process or the operation of the promotion or website, or who acts in a disruptive manner or with the intent to annoy, abuse, threaten or harass any other person.

7. All entries received in accordance with these Terms and Conditions will be read and considered by a judge. The promotion is a promotion of skill. Chance plays no part in determining the prize winner.

8. A judge will decide the winning entry. The entry judged to be the most creative will be the prize winner. The judge's decision is final and no correspondence will be entered into.

9. The final judging will take place at 12pm (AEST) on Thursday 23rd December 2010 at the offices of Geoff Slattery Publishing, AFL House, 140 Harbour Esplanade, Docklands, Victoria.

10. The winning entry will receive a copy of West Coast Seattle Boy, valued at approximately $19.95.

11. The prize value is the recommended retail value as provided by the supplier and is correct at the time of printing. The Promoter does not accept any responsibility for any changes in the prize value.

12. The Promoter does not accept any responsibility if the prize is lost or damaged in transit. If the prize or any element of a prize is unavailable for any reason (including but not limited to loss or damage), the Promoter reserves the right to award in lieu a similar prize to the equal recommended retail value, subject to applicable legislation.

13. The prize, or any unused portions of the prize, cannot be transferred, exchanged or taken as, or redeemed for, cash.

14. If the prize winner does not take delivery of their prize or any element of their prize at the time stipulated by the Promoter with reasonable notice, then their prize will be forfeited by that prize winner and cash will not be awarded in lieu of their prize or any element of their prize.

15. The name of the prize winner/prize winners will be posted on the MAG website, musicaustraliaguide.com, on Thursday 23rd December 2010.

16. Tax implications may arise from winning the prize and the prize winner should seek independent legal and financial advice before accepting the prize.

17. The Promoter shall not be liable for any loss or damage suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained (including through negligence) in connection with or arising from the promotion or any prize, except for any liability which cannot be excluded by law.

18. The Promoter does not give any warranty or guarantee about the accuracy of any information contained on or accessed through any website.

19. The Promoter is not responsible for any privacy practices of any website except for a website it owns and operates.

20. The Promoter does not endorse, approve or recommend the owners or operators of any website, or any information, graphics, materials, products or services referred to or contained on any website, unless and to the extent the Promoter expressly states otherwise.

21. The Promoter is not responsible for any incorrect or inaccurate information caused by website users or by any of the equipment or programming associated with or used in the promotion, or by any technical error that may occur during the administration of the promotion.

22. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any combination of these things or any injury or damage to entrants or any other person's computer related to or resulting from entering in or down-loading any material in or concerning the promotion.

23. The Promoter is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

24. The Promoter does not accept any responsibility for late, lost or misdirected entries or unclaimed prizes.

25. If the promotion is not capable of running as planned for any reason (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the Promoter's control which affects the security, fairness, integrity or proper conduct of the promotion), the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.

26. In consideration of being eligible to enter the promotion, each entrant assigns to the Promoter absolutely all their rights and interests in their entry and in the copyright and similar forms of protection in their entry throughout the world for the term of that copyright including all extensions and renewals so the copyright vests in the Promoter immediately on its creation. The Promoter may use any entrant's entry in any media for any purpose it determines (including but not limited to promotional, marketing and publicity purposes) without notice to the entrant or payment or other compensation to the entrant, including sending electronic messages. All entries become the property of the Promoter and will not be returned to entrants.
27. To the extent permitted by applicable law, each entrant unconditionally gives the Promoter their consent to any act or omission that would otherwise infringe on any moral rights they may have in and in relation to their entry (whether occurring before or after consent is given), their waiver of all moral rights they may have in and in relation to their entry, and their undertaking that they will not institute, maintain or support any claim or proceeding for infringement of any moral rights they may have in and in relation to their entry.

28. The Promoter collects all entrants' personal information for the purpose of conducting the promotion. The Promoter may use any entrant's personal information in any media for any purpose it determines (including but not limited to promotional, marketing and publicity purposes) without notice to the entrant or payment or other compensation to the entrant, including sending electronic messages. In addition to possible disclosure of entrants' personal information by the Promoter under the preceding paragraph, the Promoter may disclose entrants' personal information if and to the extent required by law, or if entrants consent to the Promoter disclosing their personal information to any or all prize vendors by ticking the box above marked “yes you may share my details with the prize vendors”.

29. All personal information will be stored at the Promoter's office. A request to access, update or correct any personal information should be directed to the Promoter.
