TERMS OF ENTRY
Introduction
1. These terms must be read together with the Schedule for this competition. The Schedule defines certain words used in these terms. By entering, entrants accept these terms. To the extent of any inconsistency between the Schedule and these terms, the Schedule prevails.
Entries
2. Entry is open only to residents of the Relevant State/s who comply with the Entry Restrictions (if any). Directors, officers, management, employees and other staff (and the immediate families of directors, officers, management, employees and other staff) of the Promoter or of its related bodies corporate, or of the agencies, suppliers and companies associated with the Promoter are ineligible to enter.
3. The competition will be conducted during the Competition Period.
4. To enter the competition, entrants must follow the Entry Method during the Competition Period.
5. Entrants must be registered members of Our Deal via the Our Deal website, www.ourdeal.com.au in order to submit entries. In order to become a registered member, entrants are directed to www.ourdeal.com.au/signup. Registration as an Our Deal member is conditional upon acceptance of the terms and conditions of the Our Deal website which can be found at www.ourdeal.com.au/terms.
6. Registration as an Our deal member is subject to the Promoter’s privacy policy at www.ourdeal.com.au/privacy. Information that entrants provide will be used for the purposes stated in the privacy policy and to run this competition. The Promoter may use this information for future promotional and marketing purposes regarding its goods/services and to contact entrants via email. The Promoter may disclose personal information to its agents and contractors to assist with running this competition and to communicate with entrants.
7. Entries must be received by the Promoter during the Competition Period. Entrants may submit up to the Maximum Number of Entries. Multiple entries (where permitted) must be submitted separately.
8. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks or services, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Any form of automated entry using any device or software is invalid. Entries via email are deemed to be received at the time of receipt into the Promoter’s database not at the time of transmission by the entrant.
9. All entries and materials submitted to the Promoter in connection with this competition become the property of the Promoter. Each entrant promises that he/she has the right to transfer these things to the promoter. The Promoter may use entries and materials submitted
in any way and in any medium as it sees fit. The Promoter may adapt, modify and change entries and materials submitted as it sees fit.
10. Entrants agree to participate in all promotional activities requested by the Promoter, including publicity and photography in connection with this competition or winning any prize, free of charge. Each entrant consents to the Promoter using his/her name and image in promotional material and each entrant consents to being photographed, filmed, broadcast and recorded in whatever media (“recordings”) for no compensation while taking part in this competition or taking part in or using any prize. The Promoter has the right to use any recordings at any time and to change, modify and adapt any recordings as it sees fit.
11. The Promoter reserves the right to reject and disqualify any entries (including after the draw has taken place):
(a) Which the Promoter considers are offensive, defamatory, objectionable, inappropriate or otherwise infringe any third party’s rights; or
(b) If the entrant is unable or refuses to take part in any part of the competition; or
(c) Which do not comply with any of these terms and conditions; or
(d) From any person who tampers with or benefits from any tampering with the entry process, the operation of the competition or who acts in breach of these terms, acts disruptively or who annoys, abuses, threatens or harasses any other person.
12. If the promoter becomes aware that a winning entrant has not complied fully with these terms after delivery/collection of a prize/s, that entrant will have no entitlement to the prize/s, even if the Promoter has announced them as a winner and that entrant will be required to return, refund or otherwise make restitution of the prize at the Promoter’s direction.
Draw
13. The draw/s (if applicable) will be conducted in accordance with the Draw Details. The prize/s will be awarded to a valid entrant or entrants (as applicable) randomly drawn in accordance with the Prize Details.
14. Winner/s will be notified as set out in the Notification of Winners and their name and State of residence will be published as stated in the Publication Details
Prizes
15. The prize/s are specified in the Prize Details. The total prize pool is specified in the Total Prize Pool.
16. Where a prize involves the winner:
(a) attending an event, if any part of the event is abandoned, called off, varied or postponed for any reason, then at the Promoter’s discretion, the relevant winner forfeits all rights to attend the relevant event and cash or alternative tickets will be substituted for that part of a prize; and/or
(b) meeting or attending a function with a celebrity or other public figure, the Promoter will not be liable for the failure of the winner to meet that person or failure of that person to attend the function for any reason.
17. If the prize includes vouchers (excluding vouchers issued by the Promoter as stipulated in the Promoter’s website terms and conditions which can be found at www.ourdeal.com.au/terms) or tickets, they are only valid for the date or period indicated on the voucher or ticket. Vouchers/tickets are subject to the conditions stipulated on or by the provider of them. If the total value of a voucher is not used at the time of redemption, a new voucher may be, subject to any conditions imposed by the issuer of the voucher, be issued for the balance amount. Any such voucher is valid only for the remainder of the original voucher expiry period. Vouchers cannot be redeemed for further vouchers.
18. If the prize includes vouchers issued by the Promoter as stipulated in the promoter’s terms and conditions, they are issued subject to the Promoter’s terms and conditions which can be found at www.ourdeal.com.au/terms.
19. No prize is transferable or exchangeable. Non-cash prizes cannot be redeemed for cash.
20. If a winner does not take any part of a prize at the time stipulated by the Promoter, then that part of the prize will be forfeited by the winner and cash will not be awarded in lieu.
21. The Promoter’s stated value of prizes shown in the Schedule are recommended retail prices only and provided to the best of the Promoter’s knowledge. The Promoter is not liable for any change in prize value for any reason.
22. If a prize becomes unavailable for any reason, the Promoter may in its discretion, substitute for that prize another prize of equal or higher value (as determined by the Promoter), subject to the approval of the relevant authorities in the Relevant State/s if required. To avoid doubt, the Promoter may substitute cash for any prize, the cash being equal in value to the prize value set out in the Prize Details.
23. Prizes will be posted by registered mail to the winner/s. Prizes will not be insured during transit and risk in the prize/s passes to the winner upon delivery of the prize to Australia Post for posting. Under no circumstances is the Promoter liable for any damage to prize/s during transit/delivery. Winner/s may at any time before posting of prize/s, contact the Promoter in writing and request that the prize not be sent by registered mail but alternatively be made available for collection during normal business hours from the Promoter’s address noted in the Schedule. Prize/s may be claimed in person upon presentation of proof of identity and by the Prize Claim Date and Time.
24. Prize/s posted by registered mail which are returned to sender (ie: not claimed) will be held by the Promoter until the Prize Claim Date and Time and may be collected by the winner during normal business hours from the Promoter’s address noted in the Schedule, upon presentation of proof of identity. The Promoter will use reasonable endeavours to contact the winner of any such initial unclaimed prize which is returned to sender.
25. If any prize is not claimed by the Prize Claim Date and Time, the relevant winner/s entry will be deemed invalid and the Promoter reserves the right to conduct further draws on the Unclaimed Prize Draw Date as are necessary to distribute the prize/s, subject to the requirements of any authority. If required by law or any authority, the winner/s will have their name and state of residence published in accordance with the Unclaimed Prize Draw
Publication Details. If a prize is no longer capable of being redeemed, the new winner/s will receive a new prize, as determined by the Promoter of equivalent value, less any administrative expenses incurred by the Promoter and subject to the approval of the relevant authorities in the Relevant State/s if required. If no Unclaimed Prize Draw is specified, any unclaimed prize/s will be distributed at the Promoter’s discretion.
26. Prizes and participation in this completion are subject to any conditions imposed by the supplier or organisers of the prize/s.
Disclaimer
27. In no event is the Promoter, its agents or its contractors liable for any loss or damage including indirect or consequential loss or damages, (including without limit, any loss of profits, loss of business, loss of revenue, loss of goodwill or opportunity, corruption of data or software, security breach, network intrusion, network downtime or business interruption) however caused, which is suffered or incurred in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law.
28. Without limiting the foregoing, the Promoter, its agents and its contractors make no representation or warranty about the fitness for purpose or suitability of any prize and will not accept responsibility for the quality of fitness for any purpose of any prize or the failure of any prize to be of merchantable quality. If liability under terms implied by law cannot be excluded, the liability of the Promoter and its agents and contractors is limited to re-supplying the relevant goods or services or paying the cost of replacing them.
29. If for any reason any part of this competition cannot be run as planned including because of infection by computer virus, telephone network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend this competition or invalidate affected entries, subject to the approval of the relevant authorities in each Relevant State, if required.
30. The Promoter accepts no liability for any tax implications that may arise from prize winnings. Independent financial advice should be sought.
General
31. The Promoter may in its discretion amend any aspect of this competition or these terms and conditions, subject to applicable law and subject to the approval of the relevant authorities in each Relevant State.
