We Love Mums – Consumer Promotion TERMS & CONDITIONS

   1. Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.

The Promoter is Target Australia Pty Ltd Target Australia Pty Ltd ABN 75 004 250 944 of 12-14 Thompson Road, North Geelong, Vic 3215 (‘the Promoter”).

Eligibility

   2. Entry is open to Australian residents, excluding directors, management, employees (and their immediate families) of the Promoter and its associated agencies, their employees and members of their immediate families. Participants aged under 18 years must seek the consent of their parent or legal guardian before entering the promotion. Participants should be aware that a breach of this consent requirement will result in the participant being disqualified.
   3. The person who is being nominated into the We Love Mums promotion may include, but is not limited to a person who is a mother, mother-in-law, guardian, legal guardian, step-mother, foster mother, adopted mother, grandmother, de-facto partner, wife or aunt.
   4. The Promoter reserves the right, at any time, to verify the validity of entries and personal details concerning the participants (including a participant's identity, occupation, age and place of residence) and to disqualify any participant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights under these terms and conditions at any stage does not constitute a waiver of those rights.
   5. The promotion commences at 12:01 am (AEST) on Monday 4th April 2011 and closes at 11.59 pm (AEST) on Thursday 28th April 2011 (Promotion Period). Only entries that are received during the Promotion Period will be eligible for entry. Final judging will take place at Target Australia Pty Ltd, 12- 14 Thompsons Road, North Geelong VIC 3215 on Monday 2nd May 2011.

Promotion and Nomination

   6. To enter the promotion participants must visit www.target.com.au and follow the links to the promotional page and enter the required details including the details of the person they nominate in the We Love Mums promotion and then either;
         1. Upload an image and 25 words or less in the required fields outlining details about who they are nominating in the We Love Mums promotion and why. Pictures must be no bigger than 5mb in size and text no longer than 25 words.

OR

         2. Upload a 30 second video including details about who they are nominating in the We Love Mums promotion and why. Videos must be no bigger than 20mb in size.

   6. Participants may use photo/video editing software to ensure they are entering the correct file size and the correct file format. All image details must be correct at the time of entry. Participants are unable to edit once the image/video has been submitted.
   7. Entries are limited to one entry per person
   8. Incomplete, indecipherable, or illegible entries will be deemed invalid and will be rejected. The Promoter reserves the right to disqualify any entry where it reasonably suspects that such materials are prohibited by these Terms and Conditions, any relevant law, or are otherwise deemed inappropriate. This is at the Promoter's absolute discretion and discussions will not be entered into.
   9. Images that are considered unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive, contain objectionable content or are otherwise inappropriate will be deemed invalid and rejected. The Promoter, in its absolute discretion, reserves the right to notify relevant authorities including law enforcement bodies and provide them with the objectionable image and the participant's personal information.
  10. The Promoter is not responsible for any lost, late or misdirected entries.
  11. Each participant warrants to the Promoter that: (a) each entry submitted (including the participant's photograph/video/text) is an original artistic work of the participant that does not infringe the rights of any third party, including but not limited to, copyright, trademarks, trade secrets, privacy, publicity, personal or proprietary rights; and (b) they have made the nominee aware that their photograph/video has been entered into a promotion. The participant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of these warranties. Participants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968.
  12. As a condition of entering this promotion, all participants grant the Promoter the right to use the image/video/text they submitted to promote this and future Target promotions for a period of three years from the promotion closing date.
  13. In entering the promotion, all participants assume the risks and responsibility for any loss, damage or consequence resulting directly or indirectly from viruses, damage or other defects.
  14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any participant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  15. The use of any automated entry software or any other mechanical or electronic means that allows a participant to automatically enter repeatedly is prohibited and will render all entries submitted by that participant invalid.
  16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry, photograph or video or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these terms and conditions; (e) any tax liability incurred by a winner or participant; or (f) use of a prize.
  17. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory and enforcement authorities. The Promoter in its absolute discretion will store some of the participants' entries (photograph/video/text) at an external hosting site, which may be used by the Promoter at a later date for promotional purposes, and the participant consents to such collection by the external hosting site. Entry is conditional on providing this information. Any changes in contact details are the participant’s responsibility. Participants should direct any request to update or correct contact details, in writing to the Promoter. All personal information received will be dealt with in accordance with the National Privacy Principles under the Privacy Act.
  18. This promotion is a game of skill and chance plays no part in determining the winners. The winning entries will be judged by an independent panel of Judges from Target. No correspondence will be entered in to.

PRIZES:

  20. There are a total of 6 prizes to be won.
  21. The total prize pool is $20,000.
  22. Five entries will be selected by the judging panel, deemed as finalists and awarded a $2,000 Target Gift Card.
  23. One winning entry will be judged from the 5 finalists and awarded an additional $10,000 Target Gift Card.
  24. Target Gift cards will be awarded in the name of the winning Mother that has been nominated only.
  25. Conditions of Gift Card Use: Lost or stolen gift cards will not be replaced or refunded.  To be used for purchase of goods and services at Target or Target Country only.  Target Gift Cards are not to be used in sub lets or licensees or “Shop from home” purchases.   26. The 5 finalists will be contacted before Tuesday 3rd of May 2011 and will be required to travel to Sydney on Thursday morning 5th May 2011 with the person who nominated them.
  27. Finalists must agree to participate in a styling session in Sydney on Thursday 5th May and will be revealed on Channel Seven’s The Morning Show on Friday 6th May 2011. Accommodation, transport, transfers and meal costs (to and while in Sydney) are included as part of the prize and will be selected and allocated at the Promoter’s discretion.
         1. If a finalist or nominee is unable to travel on the required dates and will not be at home on Sunday 8th of May 2011 then the prize will be forfeited and the next best entry will be contacted.
         2. Finalists may be required to sign documentation in order to appear on the Morning Show.
         3. Finalists also agree to participate in marketing and promotional activity as required by the promoter.
         4. The promoter takes no responsibility for any additional costs incurred by the finalist or the person who nominated them.
  28. Finalists must also agree to be at their home address on the morning of Sunday May 8, 2011 between 6am and midday AEST, when the major prize winner will receive a surprise visit from Channel Seven’s Weekend Sunrise television crew and be revealed on live television. The winner’s family may also be required for an interview.
  29. The Promoter reserves the right to forfeit prize/s in the event of a participant or nominee being unable to satisfy these promotion terms and conditions or not claiming a prize.
  30. For any prize that remains unclaimed on Monday 6th June 2011 they will become void and no correspondence will be entered into. No further winners will be announced.
