Terms and Conditions
By entering the “Kochie’s Business Builders – Boot Camp” competition (the “Competition”), you are agreeing to the following terms and conditions:

1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.

2. WHO CAN ENTER?
2.1 Subject to Clause 2.3, entry is open to all residents in Australia aged 18 or over who are employed by a small to medium sized business with a valid Australian Business Number and a maximum of 1000 employees (“Eligible Entrant”).
2.2 Directors, officers, management and employees and their immediate families of PINSTRIPE MEDIA Pty Ltd (the “Promoter”), Qantas Airways Ltd and Jetstar Airways Pty Ltd (the “Sponsors”), their associated companies and agencies and registered travel companions of Qantas or Jetstar employees are not eligible to enter.
2.3 Entry is not open to individuals employed by a travel wholesaler, travel agent, airline, transport provider or tour operator business.
2.4 Eligible Entrants must be available for travel between Wednesday 06/04/2011 and Saturday 09/04/2011.

3. HOW TO ENTER
3.1 The Competition will commence Thursday 17/03/2011 at 6:00am (AEDT) and conclude at 5:00pm (AEDT) on Thursday 31/03/2011(the “Competition Period”).

3.2 In order to enter, Eligible Entrants must during the Competition Period:
log-on to the following website:http://au.tv.yahoo.com/sunrise and register their name, position, business name, ABN, business address (including postcode), business phone number, business email address, and answer the following question in 25 words or less:“How will attending Boot Camp assist your business?” (“Prize Question”); and ensure their entry is:
i) the original and independent creation of the Eligible Entrant; and
ii) free from any claims by other parties, including but not limited to trademark or copyright claims.

3.3 Entrants in the Competition may enter one (1) time per calendar week the Competition is held and there may only be one entry per business represented. Multiple entries will be disqualified.

3.4 In the event of a dispute as to any entry, the individual, company or legal entity assigned the email address used for the entry will be deemed to be the Entrant.
3.5 The time of entry will be the time of receipt of the Eligible Entry by the Competition’s online database. Entrants will receive a confirmation page from the Competition’s online database once the online entry form has been received.
3.6 Entry details remain the property of the Promoter and will not be returned to the entrant. Competition entrants agree to grant the Promoter a perpetual non-exclusive licence to use their entries in any and all media worldwide and a fee will not be payable to the winner for such use.
3.7 The Promoter reserves the right in its sole discretion to reject bulk entries or non-genuine entries.

4. PRIZES
4.1 There will be two (2) prize winners (“Winner”) each week that the Competition is run, a total of four (4) prizes.
4.2 Each Winner will receive one (1) prize (“Prize”) consisting of:
i) Return Qantas or Jetstar Economy airfare for the Winner from their nearest capital city to Sydney. Air carrier will be selected at the sole discretion of the Promoter;
ii) Accommodation in a Standard Room at a four-star hotel in Sydney (number of nights will be determined based on departure city);
iii) One (1) Total Boot Camp Combo ticket which includes entry to Day 1 and Day 2 of the Boot Camp conference and entry to the Small Business Celebration Night.
The total weekly Prize value is a maximum of AUD5,000. The total prize pool for the Competition is a maximum of AUD10,000.
Prize values are based on the recommended retail price at the date the relevant Prize is awarded. The Promoter accepts no responsibility for any variation in the value fo the prizes.
4.3 Prizes are not transferable and cannot be redeemed for cash. The prize winner should seek independent financial advice about any tax implications that may arise from the Prize.
4.4 The Promoter is solely responsible for the fulfilment of the Prize to the Winner.

5. HOW TO WIN
5.1 All Eligible Entries received each week will be judged at the Promoters office at Unit 3, 20 Cliff Street, Milsons Point NSW 2061, on each Thursday, starting 17/03/2011 and ending 31/03/2011. All submitted entries (except those selected as prize winners) will be judged as a total pool each week of the promotion, for the whole duration of the Competition Period. Entries are not restricted for judging to the week they were entered.
5.2 The Prize will be awarded to the Eligible Entry whose answers are judged to be the two (2) most creative, original and interesting from all entries received in that week. This is a game of skill. There is no element of chance in judging the Competition or in the determination of the Prize Winner.
5.3 Each Winner will be selected by a panel of judges appointed by the Sponsor and the Promoter.
5.4 Each Winner will be notified by telephone or email by 5:00pm (AEDT) on the same Thursday the Winner is selected. The winner will also be announced on the Sunrise website.
5.5 The judges decision in relation to the Promoter’s determination and notification of the Winner (including any decisions as to the Prize distribution) is final and the Sponsor will not enter into any correspondence regarding the result.
5.6 It is also a condition of accepting a Prize that the Winner must comply with all of the terms and conditions of use of the Prize and the Sponsor's requirements in relation to it. To the extent of any inconsistency with these Terms and Conditions, the terms and conditions of the Prize and of the Sponsor prevail.
6 The prize does not include travel insurance, passports, visas, meals, taxes not included in the price of the ticket, ground transportation or any other costs of a personal nature not stated. Compliance with any health or other government requirements is the responsibility of each prize-winner. Prize travel is subject to Qantas’ General Conditions of Carriage, or Jetstar’s Conditions of Carriage, as applicable to the flights boarded by the winners.
6.1 Winners will not accrue Qantas Frequent Flyer points on the prize travel or accommodation. An upgrade cannot be purchased on airfares with cash or Qantas Frequent Flyer points.

6. NO LIABILITY
6.1 Subject to any restrictions in law, the liability of the Promoter and/or the Sponsor however such liability arises, including but not limited to liability arising by breach of any condition or warranty implied by statute or of this agreement or of any duty of tort (including negligence) is limited to the total value of the weekly Prize ie AUD3,375.
6.2 The Promoter, the Sponsor and their associated agencies and companies will take no responsibility for Prizes that are damaged or lost in transit or mail that is late, lost or misdirected or for the level of advice provided as part of the Prize or any reliance on such advice.
6.3 The Promoter, the Sponsor and their associated agencies and companies will not be liable for any accident, injury, misadventure, loss (including but not limited to consequential loss) or claim suffered or brought by an entrant:
(a) during the judging;
(b) in the participation of a Prize;
(c) as a consequence of late, lost or misdirected mail;
(d) as a consequence of any technical failure or fault in relation to the use of the websites referred to in these terms and conditions (including but not limited to the failure to upload information and entries on such website or the failure to receive confirmation in relation to entries); or
(e) due to the broadcast of the Program and the publication of any material, including any statements made by any staff member, journalist, other entrants or any other person; and
(f) to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in the above paragraphs, liability is limited to the maximum extent allowable by law.
6.4 The Promoter, the Sponsor and its affiliates assume no responsibility for any error (human or otherwise), omission, interruption, deletion, defect, delay in the operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.5 If, for any reason, this Competition is not capable of being conducted as planned, including, but not limited to, reasons such as tampering, unauthorised intervention, fraud, technical failures or other causes beyond the control of the Promoter which corrupt or affect the administration of security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who interferes with the correct entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state legislation.
6.6 In the case of an intervention of an outside act, agent or event which significantly hinders or prevents the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, storms, natural disasters, acts of God, civil unrest, strike, war, acts of terrorism, the Promoter may in its absolute discretion, cancel the Competition and recommence it from the start on the same conditions.
6.7 Notwithstanding anything in these terms and conditions, the Sponsor reserves the right at any time in its sole discretion to:
(a) Cancel or modify the Competition or any part of the Competition;
(b) Determine and/or vary these terms and conditions without prior notification, including but not limited to the eligibility criteria for the Competition, the selection of the winner, and the timing and venue of any act to be done, and all entrants, and Winners shall be bound by such determination and/or amendments; and
(c) Substitute, withdraw or cancel the Prize without prior notice and without having to disclose any reason thereof and without payment of any compensation whatsoever.

7. THE PROMOTER’S DETAILS
7.1 The Promoter is Pinstripe Media Pty Ltd, ACN 115 619 764 of Unit 3, 20 Cliff Street, Milsons Point, NSW, 2061.
7.2 The Sponsor is Qantas Airways Ltd (ABN 16 009 661 901) of 203 Coward Street, Mascot, NSW, 2020 and Jetstar Airways Pty Ltd (ABN 33 069 720 243) of Level 4, 222 Bourke Street Melbourne VIC 3000.
7.3 By entering this Competition you agree to the Promoter’s use of your personal information. All entries become the property of the Promoter and your name may be included on a database. By entering this Competition you also agree to that the Promoter may share your personal information with the Sponsor, and you acknowledge that the Sponsor is solely responsible for its use of that information.
