ENTRY INTO THE COMPETITION

1.   Entry into the LifeStyle YOU Channel’s “Something Borrowed” competition (the “Competition”) is open to all residents of Australia. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). The Competition is conducted in conjunction with Hoyts Cinemas. Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions.

2.   The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter.

3.   Competition begins at 12.01am (AEST) on Monday 18 April 2011 and closes at 11:59pm (AEST) on Wednesday 4 May 2011 (the “Competition Period”).

4.   To enter the Competition and be eligible to win, entrants must:

(a)   Go to www.lifestyleyou.com.au/win;
(b)   Complete the online entry form; and
(c)   Answer in 25 words or less answer the question “Whether you would choose your best friend or the love of your life and why?” (the “Competition Question”).

5.   To be eligible for entry, entrants must be residents of Australia and all entries must include the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth. All entries must be original and must not incorporate material which has been previously published. Incomplete entries or those which, in the opinion of the Promoter, includes (but is not limited to) any objectionable content, profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is each entrant’s responsibility to inform the Promoter if his/her residential address, email address or phone number changes during the Competition Period.

6.   Only one entry per person per day is permitted during the Competition Period will be permitted, however, the answer to the Competition Question in each entry by the same entrant must be unique and original. In the sole discretion of the Promoter, if the Promoter reasonably believes that an entrant has infringed the intellectual property rights of any third party, that entrant will be disqualified without notice. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice.

7.   Any person, or a person from a household, that has won a prize with a value equal to or greater than $5,000 in value from another competition run by the Promoter at any time during the period of 18 April 2010 to 17 April 2011 (inclusive) is not eligible to enter this Competition.

PRIZE

8.   There is 1 x Major Prize and 5 x Runner-Up Prizes to be won in total:

a)   The Major Prize is valued at $3,234 and consists of:

i.   return economy flights for the Major Prize winner and a guest from the Major Prize winner’s nearest capital city to the Gold Coast, Queensland, valued at $1,600 maximum;
ii.   return transfers for two people from the Gold Coast airport to the Major Prize winner’s hotel, Sheraton Mirage Hotel & Spa, valued at $200 maximum;
iii.   2 nights twin-share hotel accommodation at the Sheraton Mirage Hotel & Spa, valued at $800 maximum;
iv.   luxury spa session for two people at the Golden Door Spa & Health Club at the Sheraton Mirage Hotel & Spa, valued at $600 maximum; and
v.   a Hoyts double pass to the film “Something Borrowed”, valued at $34

(the “Major Prize”)

b)   Each Runner-Up Prize is valued at $187.65 and consists of the following:

i.   1 Almay gift pack which includes:
•   1x Almay Wakeup Makeup in neutral, valued at $29.95;
•   1x Almay Intense i-Color™ Mascara in black, $20.95;
•   1x Almay Intense i-Color™ Smoky-i™ Kits for brown eyes, valued at $20.95;
•   1x Almay Intense i-Color™ kohl eyeliner in midnight black at $19.95;
•   1x Almay Eye makeup remover pads - Oil Free, valued at $9.95;
•   1x Almay Powder Blush in Pink, valued at 26.95;
•   1x Stylish cosmetics bag;
ii.   a “Something Borrowed” film tie-in book, valued at $24.95; and
iii.   a Hoyts double pass to the film “Something Borrowed” valued at $34.00

(the “Runner-Up Prize/s”).

9.   The Major Prize and the Runner Up Prizes are together referred to as the “Prizes”.

10.   The total maximum Prize pool value is $4172.25 (1 x Major Prize at $3,234 and 5 x Runner-Up Prizes valued at $187.65 each). The Prize value is the recommended retail value as provided by the supplier and is correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars.

11.   The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize/s. The contents of the Prizes will be at the Promoter’s sole discretion. The Prizes (including any tickets or passes) are subject to availability and the terms and conditions of the entities’ supplying the Prizes.

12.   Only one Prize per household will be awarded.

13.   All elements of the Major Prize are subject to availability at time of booking and cannot be used during any public holidays. The whole of the Major Prize must be used within 12 months of the closing of the Competition.

JUDGING AND AWARD OF PRIZE

14.   The Competition will be judged on the basis of creativity at the LifeStyle Channels, Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Monday 9 May 2011 at 10.00am (AEST). Chance plays no part in the selection of the Prize winners. The Prize winners will be notified via phone on Wednesday 11 May 2011 and their names published on the LifeStyle YOU Channel website from Monday 16 May 2011. The Prizes must be claimed within 14 days of the publication of the Prize winners.

AGE

15.   In the event that the Major Prize winner is less than 18 years of age at the time the Major Prize is to be used, the Major Prize winner must be accompanied by his/her parent or legal guardian. The parent or legal guardian must accompany the Major Prize winner at all times throughout the conduct of the Major Prize. The parent or legal guardian will be considered as the travelling companion (‘Guest”) of the Major Prize winner (i.e. the Major Prize Winner will only be able to bring their parent or legal guardian as their Guest).

TRAVEL

16.   It is the sole responsibility of the Major Prize winner and his/her Guest to ensure that their personal documentation (including but not limited to passports, Visas etc) is valid. Any expenditure incurred as a result of not meeting such requirements is the sole responsibility of the Major Prize winner and his/her Guest. Travel insurance is advisable for the Major Prize winner and his/her Guest, though all such arrangements are the sole responsibility of the Major Prize winner and his/her Guest,

17.   In the event that the Major Prize winner is a resident of the Gold Coast, Queensland (which shall be determined at the absolute discretion of the Promoter), the respective flight component of the Major Prize will be forfeited in full and no substitute will be offered.

18.   All ancillary costs and expenses incurred in taking and using the Major Prize (including but not limited to mini bar, spending money, gratuities, telephone calls, food, beverages, insurance and taxes) are the sole responsibility of the Major Prize winner and his/her Guest, unless expressly stated as being part of the Major Prize.

19.   Prize winners are advised that tax implications may arise from their Prize winnings and they should seek independent financial advice prior to acceptance of their Prize.

20.   It is a condition of accepting the Prize that the Prize winners and their guests may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

21.   The Promoter reserves the right to refuse to allow the Major Prize winner or his/her Guest to take part in any or all aspects of the Major Prize if the Promoter determines, in its absolute discretion, that the Major Prize winner or his/her Guest is not in the mental or physical condition necessary to be able safely to participate in the Major Prize.

GENERAL

22.   All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize winner cannot provide suitable proof, that Prize winner will forfeit the Prize in whole and no substitute will be offered.

23.   By entering the Competition, each entrant warrants that their entry is their own original work, and that they own all rights, including copyright in their entry. Each entrant indemnifies the Promoter in the event that this warranty is false.

24.   No responsibility will be taken by the Promoter, Country Music Channel, FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning the Prize.

25.   The Promoter reserves the right, in its absolute discretion, to disqualify:
a)   any entry which, in the opinion of the Promoter, includes any objectionable content, profanity or is potentially insulting, inflammatory or defamatory; and
b)   any individual who tampers with the entry process, submits an entry that is not in accordance with these terms and conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of the Promoter.
26.   The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel or vary the Competition or to vary or cancel the award of the Prizes including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):
a)   Prize winner does not satisfy the Competition entry requirements; or
b)   the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control.
27.   In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not:
a)   be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and
b)   be required to conduct the Competition at any other time.
28.   No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
29.   A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.
30.   Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition.
12.   The Promoter collects entrants’ personal information for the purpose of conducting and promoting the Competition (including, but not limited to, determining and notifying winners). Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation. Entrants are also advised that from time to time, the Promoter may disclose your personal information to third parties (including, but not limited to, third party prize providers) for the purpose of administering prizes or for other purposes contemplated in these terms and conditions.
31.   All entries become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy which is available at www.lifestyle.com.au By entering the Competition, the Prize winners agree to the use of their name, image, audio-visual recording and/or photograph/s, without compensation, and agree that the Promoter will own copyright in any such images, audio-visual recordings and photograph/s.
