BOSS 40th competition terms and conditions

HOW THIS COMPETITION WORKS

1.1 Jasco Pty Ltd (A.B.N.: 96 000 301 888) of 118-122 Bowden Street, Meadowbank NSW 2114 (the 'Promoter') is giving away a total of two (2) ‘Cool Boss Experience’ prizes plus other Stabilo prizes to celebrate the 40th birthday of the Stabilo BOSS highlighter.

1.2 Register to play the 'BOSS Wanted' internet game, answer the questions in the game to earn experience points and see 'what kind of a BOSS are you?' (the 'Game'). For forty (40) days (from the date of each participant’s individual registration), a new question will be uploaded onto the Game every four (4) days (total of ten questions per Game). Participants who answer at least one (1) question in the Game will be eligible to win a Stabilo prize pack. Participants who answer all ten (10) questions in the Game will be eligible to win a ‘Cool Boss Experience’ prize. Participants will be sent updates on new questions available, deadlines for certain activities for the Game and general information about the Game by email.

1.3 Participation in the competition does not entail any obligation to purchase any products offered by the Promoter.

ELIGIBILITY TO PARTICIPATE 2.1 Participants must be over 18 years of age and must not be employed by the Promoter or its associates.

HOW TO REGISTER

3.1 To register for an account, participants must visit www.boss-wanted.com (the 'Competition Website'), follow the prompts to the registration page, input their requested details including their nick name, gender, a valid email address, provide a valid password and submit the fully completed online registration form between 10am AEDST on 1st January 2011 and 10am AEDST on 18th December 2011. However, participants must register for an account by 10am AEDST on 24th October 2011 to be eligible to win a ‘Cool Boss Experience’ prize.

3.2 Participants can then log onto the Competition Website using their nick name and password to play the Game.

3.3 Limit of one (1) registration per valid email address.

HOW TO EARN EXPERIENCE POINTS

4.1 Once registered, participants will be able to answer the multiple choice questions in the Game to earn experience points. The number of experience points awarded for each question will depend on the answer selected by the participant.

4.2 Participants can also earn experience points by referring up to three (3) friends to enter this competition. To do so, participants must, once registered, follow the prompts online to provide their friend’s unique and valid email address. Each validly referred friend will then receive an email from the Promoter inviting them to enter. Participants warrant that: (a) the individual that they refer the competition to is an Australian resident aged 18 or over who would normally consent to receiving emails from the participant; and (b) the friend’s name and unique email address provided is valid.

4.3 The number of experience points collected does not affect a participant’s chances of winning a prize.

HOW TO BE ELIGIBLE TO WIN A STABILO PRIZE PACK

5.1 Every participant who answered one (1) or more questions in a Game between 1st January 2011 and 18th December 2011, will receive an email from the Promoter on the dates specified in the table below, inviting them to submit an entry to be eligible to win a Stabilo prize pack, for that relevant Stabilo Prize Pack Qualifying Period.
Period 1 – 01/01/2011 to 13/02/2011 (email sent on 21/02/2011);
Period 2 – 14/02/2011 to 17/04/2011 (email sent on 21/04/2011);
Period 3 – 18/04/2011 to 19/06/2011 (email sent on 23/06/2011);
Period 4 – 20/06/2011 to 17/08/2011 (email sent on 24/08/2011);
Period 5 – 18/08/2011 to 18/10/2011 (email sent on 24/10/2011);
Period 6 – 19/10/2011 to 18/12/2011 (email sent on 23/12/2011).

5.2 To enter, participants must reply to the original email received from the Promoter, containing an answer to the question 'Tell us how many Stabilo BOSS colours there are, which one is your favourite and why?' in twenty-five (25) words or less, by the date and time specified on the email.

5.3 Participants can submit as many reply emails as they like in each Stabilo Prize Pack Qualifying Period, however, only the first reply email submitted per participant will be eligible for judging.

5.4 Each entry received in a Stabilo Prize Pack Qualifying Period will be individually judged based on the creative merit of the answer provided to the promotional question.

5.5 The best forty (40) valid entries in each Stabilo Prize Pack Qualifying Period, as determined by the Promoter’s panel of judges, will each win a Stabilo branded 2GB USB stick and a BOSS branded mug, to a total value of $29.90.

HOW TO BE ELIGIBLE TO WIN A COOL BOSS EXPERIENCE 6.1 Every participant who answered all ten (10) questions in a Game between 1st January 2011 and 4th December 2011, will receive an email from the Promoter on the dates specified in the table below, inviting them to submit an entry to be eligible to win a ‘Cool Boss Experience’ prize, for that relevant Cool Boss Experience Qualifying Period. Period 1 – 01/01/2011 to 29/06/2011 (email sent on 04/07/2011); Period 2 – 30/06/2011 to 04/12/2011 (email sent on 08/12/2011).

6.1 To enter, participants must reply to the original email received from the Promoter, containing an answer to the question 'Tell us why you would like to win a Cool Boss Experience?' in twenty-five (25) words or less, by the date and time specified on the email.

6.2 Participants can submit as many reply emails as they like in each Cool Boss Experience Qualifying Period, however, only the first reply email submitted per participant will be eligible for judging.

6.3 Each entry received in a Cool Boss Experience Qualifying Period will be individually judged based on the creative merit of the answer provided to the promotional question.

6.4 The best valid entry in each Cool Boss Experience Qualifying Period, as determined by the Promoter’s panel of judges, will each win a ‘Cool Boss Experience’ prize valued at up to $3,000. The Promoter will liaise with each winner to determine: (a) the exact activities to be experienced during the ‘Cool Boss Experience’ prize; and (b) the exact date of when their ‘Cool Boss Experience’ prize is to be taken. In the event that agreement cannot be reached between a winner and the Promoter, the Promoter reserves the right to determine the exact activities to be experienced by the winner and/or the date the ‘Cool Boss Experience’ prize is taken.

6.5 If a winner wishes to go on a shopping trip as part of the ‘Cool Boss Experience’ prize, the Promoter will award this element of the ‘Cool Boss Experience’ prize as a gift card redeemable at the Promoter’s nominated shopping centre. A maximum value of $500 can be allocated to the shopping trip as part of the ‘Cool Boss Experience’ prize per winner.

6.6 All elements of the ‘Cool Boss Experience’ prize must be redeemed on the same date.

6.7 Any ancillary costs not included as part of the ‘Cool Boss Experience’ prize are not included and will be at the winner’s expense. The ‘Cool Boss Experience’ prizes must be taken by 30th June 2012 and are subject to booking availability. 6.8 By confirming the ‘Cool Boss Experience’ prize, the winner accepts the standard terms and conditions of individual prize and service providers. Each winner may be required to present identification documentation as and in the form required by the Promoter and/or prize and service suppliers in their absolute discretion, including but not limited to a credit card, driver’s license and travel documentation (depending on the activities included with the ‘Cool Boss Experience’ prize). 6.9 The Promoter is not liable for the consequences of any justifiable changes to any activities to be experienced during the ‘Cool Boss Experience’ prize (including delays) or any justified cancellation of any element of the ‘Cool Boss Experience’ prize by the prize and service suppliers.

GENERAL 7.1 Participation in this competition is deemed acceptance of these entry conditions. 7.2 All winners will be notified by email within fourteen (14) days of winner determination. 7.3 By participating in this competition, the participant expressly agrees that his/her name will be published on www.stabilo.com.au in the event that he/she wins a prize. 7.4 If a winner does not respond to the Promoter within the four (4) weeks of the winner notification email being sent to the winner, the winner will forfeit their entitlement to the prize and a reserve winner will win the prize.

7.5 The Promoter reserves the right, at any time, to verify the validity of entries (including details provided on registration and reply emails) and participants (such as a participants identity, age, place of residence) and to disqualify any participant who submits an entry that is not in accordance with these entry conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoters discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 7.6 Incomplete or indecipherable entries will be deemed invalid. 7.7 If there is a dispute as to the identity of a participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the participant.

7.8 The Promoters decision is final and no correspondence will be entered into. 7.9 If for any reason a winner does not accept a prize by the time stipulated by the Promoter, then the prize will be forfeited. 7.10 If a prize (or part of a prize) is unavailable, the winner will receive an equivalent substitute prize (or an equivalent substitute part of the prize). 7.11 There is no cash alternative to or refund for a prize. Entitlement to a prize or substitute prize cannot be transferred.

7.12 As a condition of entering into this competition, each participant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each participant warrants to the Promoter that each entry submitted is an original literary work of the participant that does not infringe the rights of any third party. The participant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Participants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth). 7.13 Participants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without any remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

7.14 If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any participant; or (b) to modify, suspend, terminate or cancel the competition, as appropriate. 7.15 Any cost associated with accessing the promotional website is the participant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows a participant to automatically enter repeatedly is prohibited and will render all entries submitted by that participant invalid. 7.16 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees'). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.

7.17 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or participant; or (g) use/taking of a prize.

7.18 As a condition of accepting a prize, the winner (and any companions of the Cool Boss Experience prize winners) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 7.19 The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the participant. Participants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. 7.20 The laws of Australia apply exclusively. If any of the individual provisions specified above becomes invalid, the validity of the remaining provisions shall not be affected.
