HOW TO ENTER

To be eligible to enter, individuals must obtain a missing word which can be found within promotional advertising featured in participating publications.

To enter, individuals must, during the promotional period, visit www.chikahealth.com.au, follow the prompts to the competition entry page, entrants must then either,

(a); input the requested details including the entire missing word and submit the fully completed entry form, or

(b); send an SMS to 19 33 33 containing the requested details including the entire missing word, name, postcode and email address. Premium SMS cost is 25c.

TERMS AND CONDITIONS

1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

3.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4.Incomplete or indecipherable entries will be deemed invalid.

5.Multiple entries permitted. Each entry must be submitted separately and in accordance with entry requirements.

6.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

7.Promotion commences 12.01am AEDST on 21/03/11 and final entries close 5pm AEST on 07/08/11.

8.There will be twenty (20) weekly prize draws conducted for this promotion. Entries close for each weekly prize draw at 5pm AEST/AEDST (as the case requires) every Sunday between 27/03/11 and 07/08/11. Non-winning entries in each weekly prize draw will roll over into any subsequent weekly prize draws. All weekly draws will take place at 12pm AEST/AEDST (as the case requires) at 11 Harris Street, Pyrmont, NSW 2009 on every Monday between 28/03/11 and 08/08/11 (except in the case of public holidays, in which case the draw will take place the following business day).

9.Winners of weekly draws will be notified by email or SMS according to the method of entry within two (2) days of the relevant weekly draw. Winners will have their names published on www.chikahealth.com.au within two (2) weeks after the applicable draw with the first publication on 11/04/11 and the last on 22/08/11.

10.SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.

11.The first two (2) valid and correct entries drawn in each weekly draw will win a Universal Visa Gift Card valued at $250.00.

12.Any ancillary costs associated with redeeming the Universal Visa Gift Card are not included. Any unused balance of the Universal Visa Gift Card will not be awarded as cash. Redemption of the Universal Visa Gift Card is subject to any terms and conditions of the issuer.

13.If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

14.Total prize pool value is $10,000.00. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

15.A draw for any unclaimed prizes may take place on 08/11/11 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing within two (2) days of the draw and winners’ names will be published on www.chikahealth.com.au commencing on 22/11/11.

16.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

17.Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

18.Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

19.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e); any tax liability incurred by a winner or entrant; or (f) use of the prize.

20.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
