TERMS AND CONDITIONS FOR WESTFIELD
“WIN A MAKEOVER ON A GRAND SCALE” PROMOTION
1.
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this “Win a Makeover on a Grand Scale” Promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.
ELIGIBILTY
2.
Subject to condition 3, this Promotion is only open to Australian residents aged 18 years or over who are available to take the prize on 19/04/2011.
3.
The following are ineligible: (i) employees of the Promoter, the Westfield Group or any of the tenants or retailers in the Participating Centres or any of the Promoter’s agencies that are associated with the Promotion; (ii) the spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iii) any person who the Promoter has previously notified is not permitted to enter the Promoter’s promotions.
PROMOTION PERIOD
4.
This Promotion commences at 9.00am local time on 15/03/2011 and ends at 12.00pm local time on 11/04/2011 (“Promotion Period”).
HOW TO ENTER
5.
To be eligible to enter this Promotion, eligible individuals must, during the Promotion Period, submit a fully completed application. To submit an application, eligible individuals must visit www.westfield.com.au/teatreeplaza or www.westfield.com.au/westlakes, follow the prompts to the promotion page and input the requested details including their full name and email address. (“Applicants”). It is a condition of entry that Applicants agree to be signed up to the Westfield Tea Tree Plaza or Westfield West Lakes e-newsletters, based on the website visited in order to enter, and to be used in accordance with the purposes set out in these Terms and Conditions. Once Applicants submit their application, a pre-populated email will automatically be sent to their inbox, including a link in order to complete their application.

To enter the Promotion, Applicants must then, during the Promotion Period, click on the link in the email provided, insert a 25 word or less answer to the following question “Why would you like to win a makeover on a grand scale?” within the body of the email box and attach a recent, clear, colour photograph of themselves taken within the last two (2) months and submit. Attachments must be in jpg, gif, png format, must not be edited, distorted or enhanced in any way and must not exceed 3MB file size.
LIMITS ON ENTRY
7.
Limit of one (1) entry permitted per Applicant.
CRITERIA OF JUDGING
8.
This is a game of skill and chance plays no part in determining any winner. All entries will be judged based on literary and creative merit of the answer to the question. The Promoter reserves the right to select reserves and record them in order of merit in the event that the person who submitted the original entry that is selected is ineligible.
WINNER NOTIFICATION
9.
The provisional winner will be notified by email and telephone. A provisional winner will only be deemed a winner once verified by the Promoter.
PRIZES
10.
The best valid entry, as determined by the judges, will win a makeover prize valued at $1,210. The makeover prize includes the following: a personalised style session; a photo shoot with Westfield Insider, Alyce Cowell, to take place at Silverback Studios, Adelaide; and the winner’s choice of outfits used in the photo shoot to the value of $1,000.
11.
The makeover will take place on 19/04/2011 at Westfield Tea Tree Plaza, which the winner must attend to participate in their photo shoot, as well as receive all other elements of the prize. The prize is subject to Kylie Crabtree and Alyce Cowell’s availability. If the winner is not available to attend on the date and at the location specified they will be deemed invalid and a new winner will be selected from the reserve entries.
12.
The winner is responsible for all costs associated with attending the prize, including but not limited to travel to and from Westfield Tea Tree Plaza.
13.
By accepting the prize, the winner acknowledges and agrees that:
(a)
they must not act in an illegal or inappropriate manner during the course of the prize;
(b)
during the course of the prize they: (i) will follow all reasonable directions of the Promoter; (ii) will not be involved in any illegal or scandalous behaviour which could bring the Promoter or their products into disrepute; and (iii) understand that they may be interviewed, photographed and recorded during the entire duration of the prize;
(c)
that the Promoter may use the content recorded during the prize ("Materials") for any purpose, including for the Promoter's future promotional and marketing purposes without further reference or
compensation to them, including but not limited to, displaying the Materials in any form of media including on digital advertising, WAP sites, outdoor advertising, using it in PR, radio, TV, on Facebook, My Space, and YouTube;
(d)
the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at anytime, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
(e)
where they have any intellectual property rights in the Materials, they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
(f)
they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
(g)
they waive all Moral Rights in the Materials that arise outside Australia;
(h)
they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials; and
(i)
they agree to participate in any further publicity activities for the purposes of promoting this Promotion (including any outcome) as determined by the Promoter in its absolute discretion, including, but not limited to, appearing as talent in a “Style TV” episode to be displayed on westfield.com.au and other digital media as determined by the Promoter.
GENERAL
14.
Incomplete, indecipherable or illegible entries will be deemed invalid.
15.
If there is a dispute as to the identity of an Applicant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Applicant.
16.
If for any reason a winner does not take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
17.
If the prize (or part of the prize) is unavailable due to reasons beyond the control of the Promoter, the Promoter in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
18.
Total prize pool value is $1,210.
19.
Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
20.
Applicants consent to the Promoter using the Applicant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
21.
The Promoter reserves the right, at any time, to verify the validity of entries (including contacting Participating Retailers) and Applicants (including an Applicant’s identity, age and place of residence) and to disqualify any Applicant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
22.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Applicant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
23.
The Promoter’s decision is final and no correspondence will be entered into.
24.
Any cost associated with accessing the promotional website is the Applicant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Applicant to automatically enter repeatedly is prohibited and will render all entries submitted by that Applicant invalid.
25.
Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Westfield Group of companies (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
26.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Westfield Group of companies (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out
of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or correspondence that is late, lost, altered, damaged or misdirected (whether received by the Promoter or not) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Applicant or winner; or (f) use of the prize.
PRIVACY
27.
In order to conduct this Promotion, the Promoter needs to collect personal information about each Applicant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. It is a condition of entry that the Applicant agrees to being entered into the Westfield database. The Promoter and the Westfield Group may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Applicant and for such other purposes as set out in the Westfield Privacy Policy. Applicants should direct any request to access, update or correct information to the Promoter. All personal details of Applicants will be stored at the office of the Promoter and/ or Westfield. Upon the Applicant’s request, all information provided will be removed from our active database. To request details to be removed, please go to http://westfield.com.au/unsubscribe or write to the Digital Marketing Manager, Level 20, 100 William Street, Sydney NSW 2011. Information will be removed as soon as reasonably possible in accordance with our Privacy Policy and applicable laws.
