Terms & Conditions: Win a Blu-ray Player with BBC

Acceptance by you
The Win a Blu-ray Player with BBC Promotion (the “Competition”) is provided by Roadshow Entertainment, a division of Roadshow Films Pty Ltd ABN 28 100 746 870 of Level 4, The Village Roadshow Centre, 235 Pyrmont Street, Pyrmont, NSW  2009 (the “Promoter”).  These terms and conditions (including without limitation the information on how to enter, and prize details which we publish in relation to the Competition) apply to the Competition.

By entering the Competition, you acknowledge that you have read and understood, and agree to be bound by these terms and conditions.

Entering the competition
1.   To be eligible to enter the Competition, you must be a permanent resident of Australia and over 18 years of age.  Employees (and immediate family members) of the Promoter and of associated agencies are ineligible to enter the competition. Participants who are under the age of 18 must seek permission from their parent or guardian.
2.   The Competition runs from 9.00am AEDST on 24 November 2011 to 5.00pm AEDST on 31 December 2011  (“Promotional Period”). 
3.   To be eligible to enter the competition you must:
a)    spend over $80.00 in one transaction on any BBC DVD or BBC Blu-ray products from the Australian Broadcasting Corporation (“ABC”) at ABC Shops or online at abcshop.com.au only; and
b)   complete the entry form provided in-store at ABC Shops, or online at abcshop.com.au/competitions, and answer in 25 words of less “How will you entertain the family this Christmas?”
4.   All valid entries submitted during the promotional period will be entered into the promotion.  Multiple entries are permitted. One entry will be awarded per every purchase over $80.00, but each entry must have a separate proof of purchase. 
5.   Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries (including unsuccessful entries) when requested may, in the absolute discretion of the Promoter, result in the invalidation of ALL of an entrant’s entries and forfeiture of any right to the prize.
Prizes
6.   There will be one (1) prize winner for each ABC Shop nationally (including one prize winner for purchases made at www.abcshop.com.au).  There will be a total of fifty-seven (57) prize winners. (This corresponds to the number of ABC Shops nationally at the time of the competition including the ABC Shop Online). 
7.   The prize winners for each ABC Shop across Australia, and for ABC Shop Online, will be judged independently by the managers of each ABC Shop and ABC Shop Online.  The entrant whose entry is judged by the relevant manager to be the most original and creative will win the prize. 
8.   The prize will consist of a Sharp 3D Blu-ray player model number BDHP25X RRP $299. 
9.   The judging will take place at each ABC Shop at 9:00am local time on 5 January 2011. The winner’s details will be published on the website abcshop.com.au/competitions within 5 business days of judging. The promoter will contact the prize winner in writing and by telephone within five (5) business days of winning their prize to confirm their address details and how to collect their prize. 
10.   The entrants whose entries are judged by the manager of each ABC Shop to be the next most original and creative will be recorded by the ABC.  In the event that an invalid entry or ineligible entrant is selected as a winner, or if a prize is forfeited by a winner, or where a prize winner cannot be contacted despite reasonable attempts to contact them, the prize for that ABC Shop will be awarded to the runner-up. 
11.   In the event that an ABC Shop does not receive any entries to the Competition, the Promoter and the ABC will, at their discretion, select a runner-up from a store in the same State/Territory to be the winner of the prize for the relevant ABC Shop.   
12.   This is a game of skill.  Chance plays no part in determining the winner. The judges' decision is final and binding and no correspondence will be entered into.
13.   Any form of automated entry using any other devices or software will be deemed to be invalid. We reserve the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these conditions.
14.   All entries are deemed to be received at the time of receipt into the competition’s database and NOT at the time of transmission by the entrant. The Promoter is not responsible for any time lag in an entry being received into the competition’s database.
15.   Prizes are not transferable and are not redeemable for cash. The Promoter and the ABC’s decision is final and binding - no correspondence will be entered into. 
Disclaimers
16.   The Promoter and the ABC are not responsible for lost, late, incomprehensible or incorrect entries in the competition. We accept no responsibility for any tax implications that may arise from prize winnings in the competition.  You should seek Independent financial advice about such matters.
17.   The Promoter and the ABC will not be liable for any loss or damage whatsoever which is suffered (including without limitation direct, indirect and consequential loss and damages) or for personal injury suffered or sustained as a result of entering or trying to enter the competition or accepting any prize offered as part of the competition, except for any liability which cannot be excluded by law
18.   In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, the Promoter is entitled to cancel, terminate, modify or suspend the competition - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the competition.
19.   If for any reason the competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter is entitled in its sole discretion (subject to any written directions given by the gaming authorities), to cancel, terminate, modify or suspend the competition.
Exclusions and our liability
20.   The law implies various conditions and warranties which might apply to us supplying goods or services to you.  The Promoter excludes all of those conditions and warranties to the fullest extent permitted by law, including without limitation implied warranties of merchantability and fitness for a particular purpose.
21.   Provisions of the Trade Practices Act 1974 and other statutes in some cases either cannot be excluded, restricted or modified; or can only be restricted or modified to a limited extent. If any of those provisions apply, then to the extent permitted our liability under those provisions is limited as set out below. Our liability in relation to goods we supply is limited at our option to: a) replacement of the goods or the supply of equivalent goods; or b) repair of the goods; or c) payment of the cost of replacing the goods or of acquiring equivalent goods; or d) payment of the cost of having the goods repaired; and our liability in relation to services we supply, is limited at our option to: a) the supplying of the services against; or b) the payment of the cost of having the services supplied again.
Virus Warning
22.   In entering the competition, you assume the risks and responsibility for any loss, damage or consequence resulting directly or indirectly from viruses, damage or other defects. 
Termination
23.   The Promoter may terminate or cancel your entry in the competition immediately at our discretion or if you breach any of your obligations under these conditions.
Your personal information
24.    As a result of you entering the competition, the ABC will collect and use certain details and personal information about you, such as your name, email address and phone number in accordance with the ABC’s Privacy Policy available at http://www.abc.net.au/privacy.htm. The ABC and the Promoter may disclose your personal information to their contractors, agents and to State and Territory gaming departments, to assist in conducting this competition.
25.   In respect of the Promoter’s use of your details and personal information, the details contained in your entry are protected by security safeguards as detailed in the Promoter’s Privacy Policy The personal information collected as part of the entry is collected to enable identification of the winner. Your personal information will only be used and disclosed to any third party for these purposes. You can contact our Privacy Officer if you would like details of the personal information that the Promoter may hold about you or if you would like it to be corrected. You indemnify us
26.   You release and agree to keep the Promoter and the ABC indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by us, our directors, employees, agents and representatives arising out of your entry in the competition or any claim by a third party arising from an act or omission by you.
Failure to comply and severability
27.   The Promoter and the ABC are not liable for any failure to comply with these conditions. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force.
Entire agreement and governing law
28.   These conditions constitute the entire agreement between you and us as to its subject matter. By entering the competition, you accept that this agreement is to be interpreted, and any disputes are to be determined by the courts having jurisdiction in New South Wales, in accordance with the laws in force in New South Wales from time to time.
