TERMS AND CONDITIONS

Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is only open to Australian and New Zealand residents 18 years and over and companies operating within Australia and New Zealand. Employees (and their immediate families) of the Promoter, its related companies and agencies associated with this promotion are ineligible to enter.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

To enter, entrants, being either an individual, or in the case of a company, an authorised representative of an eligible company, must visit www.hp.com.au/snowchaser in Australia and www.hp.co.nz/snowchaser in NZ to input the requested details and submit the fully completed entry form during the promotional period, between 1/8/2011 and 31/10/11 inclusive.

Incomplete, indecipherable or illegible entries will be deemed invalid.

Only one entry permitted per person or company.

Promotion commences 01/08/11. Entries close 11:59pm AEDST on 31/10/11. There will be one draw in total on 1 November 2011. The draw will take place at CROSSMARK Australia, Units 1 and 2, 39 Herbert Street, St Leonards NSW 2065 at 2pm AEDST as per the below dates. Winners will be notified by mail and the winner’s name will be published on the competition website, and in The Australian newspaper, on 14 November 2011. The Promoter’s decision is final and no correspondence will be entered into.

The first valid entry drawn will receive a AUD$30,000 (including GST) Flight Centre Gift Voucher to be used for Flight Centre travel services of the Prize winner’s choice.

Prize is subject to the standard terms and conditions of individual prize and service providers.

If the winner of the Prize is a company, the Prize will be awarded to the authorised representative of the respective winning company, whose name appears on the winning entry.

If the winner of the Prize is from New Zealand, the Prize will be awarded with a NZ Flight Centre Voucher converted to NZ dollars for the value of AUD$30,000 at the market currency rate at time of drawing.

If for any reason a winner does not take an element of the prize at the time stipulated by the Promoter, then the Prize or that element of the Prize will be forfeited.

If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

Liability for any tax on any Prize provided to Participants from this promotion will be the sole responsibility of the Participant. It is recommended that Participants should contact their own accountant or taxation advisor in this regard.

Total prize pool value is up to AUD$30,000, or any unused portion of the Prize, is not transferable or exchangeable.

A draw for the Prize, if unclaimed, may take place on 01/02/12 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified by mail and the winner’s name will be published in The Australian newspaper, on hp.com.au/snowchaser and hp.co.nz/snowchaser before 12/02/12.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize.

The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian and New Zealand regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant provided that an entrant can unsubscribe later if he or she or it does not want to receive any further marketing material. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
