TERMS AND CONDITIONS
1. The promoter is The Herald & Weekly Times Pty Ltd (ABN 49 004 113 937) of 40 City Road Southbank, Victoria 3006. This promotion is in no way associated with Samsung.
2. Instructions on how to enter form part of the conditions of entry. The judge’s decision is final and no correspondence will be entered into.
3. Entry is only open to residents of Victoria. Employees of the Promoter and their immediate families, directors, management, related companies, and their agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
4. Melbourne vs. Richmond Game: The competition commences at 12 noon (AEDT) on Saturday April 14, 2012 and concludes at 23:59pm (AEDT) on Saturday April 14, 2012. (“the Competition Period”).
5. To enter, entrants must send an SMS to 0458 222 999 with their email address. SMS costs 55 cents including GST. Entrants will then receive an email from HWT inviting them to take up a free 3 month Herald Sun Digital Pass. The free 3 month Herald Sun Digital Pass provides complimentary access via a secure login to all areas of the Herald Sun website, mobile site and tablet application for a period of 93 days commencing immediately upon successful registration. No payment required. One complimentary Digital Pass is permitted during the offer period. The offer must be activated by registration before 30th June 2012. Competition entrants who have previously subscribed to a free 2 month digital pass will be eligible to register for the free 3 month Herald Sun Digital Pass. In the event that an entrant who has registered for a 2 month pass subsequently registers for the free 3 month pass, his or her 3 month pass will supersede the 2 month pass. Entrants who have previously subscribed to a 12 month digital pass will not be required to sign up for a 3 month digital pass.
6. The SMS entry mechanic is only open to entrants with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. 7. Entrants (including winners) in the competition may enter as many times as they like, however only one prize per person will be awarded. SMS entries via internet or computer generation are invalid and will not be accepted.
8. Each SMS entry will be charged at a premium rate, namely $0.55 (including GST), which covers the entry and reply message.
9. The time of entry will, in each case, be the time that the SMS is received by Mocom Pty Ltd.
10. The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.
11. Incomprehensible and incomplete entries will be deemed invalid.
12. The first valid entry drawn at random from the entire pool of entrants who entered during the Competition period will be the prize winner. The draw will take place at The Herald & Weekly Times, 40 City Rd Southbank at 2pm on Thursday April 19, 2012.
13. The winner will be notified by phone and email within two days of the draw. The winner’s details will be published in the Public Notices section of the Herald Sun on Friday April 20, 2012.

Total Prize pool valued at $649.00.
14. The prize must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for cash or other goods or services. If the prize is not utilised it will be forfeited.
15. The prize value is based on the recommended retail price at the time of printing and may vary at the time of redemption. The Promoter accepts no responsibility for changes in prize value between now and the ultimate prize redemption date.
16. Where any prize is unavailable for any reason, the Promoter reserves the right to substitute that prize for a prize of equal value at the publishing date.
17. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions of entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
18. If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.
19. Except for any liability that cannot be excluded by law, the Promoter (including their officers, employees and agents) exclude all liability (including negligence) for any personal injury, loss or damage (including loss or opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to, where arising out of the following:
a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b) any theft, unauthorised access or third party interference;
c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d) any variation in prize value to that stated in these conditions of entry;
e) any tax liability incurred by a winner or entrant;
f) the broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person; and/or
g) participation in the prize, including attendance at the venue.
20. The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
21. The Promoter collects your personal information to enable us to invite you to take up your free 3 month Herald Sun Digital Pass and to assist us in providing the goods or services you have requested, to process your competition entries, and to improve our products and services. We or any of our Australian related companies may be in touch by any means (including by SMS or email) at any time in the future to let you know about goods, services or promotions which may be of interest to you. We may also share your information with other persons or entities that assist us in providing our services, running competitions or with other companies who provide prizes for competitions or reader offers.
