“KING OF GROMS” PROMOTION
 TERMS AND CONDITIONS OF ENTRY

1. Information on how to enter and prizes form part of the Conditions of Entry. Entry into the “Kings of Groms” Competition is deemed acceptance of these Terms and Conditions of Entry

2. The Promoter is Designworks Clothing Company Pty Ltd (ACN 113 900 057) of 11 Hall Street, East Hawthorn, VICTORIA 3123 (“the Promoter”).

3. The promotion commences on 15 September 2011 at 9am and continues until 5pm on 30 December 2011 (“Promotional Period”).

Method of Entry

4. Entry is only open to Australian residents who are 12 years old or younger and have registered their entry on www.worldindustries.com/kingofthegroms (“Eligible Participants”). Employees of the Promoter and their immediate family members, related bodies corporate and agencies of the Promoter are ineligible to enter. “Immediate family” means spouse, parent, child or sibling, whether or not they live in the same household as the employee. Entrants must have prior permission from their parent or guardian to enter.

5. Eligible Participants must register as a user of the World Industries website and click on the links to complete an online entry form and upload their entry or send a DVD with a manual form available from either Target stores or online via mail.

6. To complete their entry, Eligible Participants must film a video of himself/herself for 60 seconds performing on their skateboard wearing World Industries Clothing. This video must be uploaded to www.worldindustries.com/kingofthegroms or sent on DVD to 8-14 Hall St, Hawthorn East, VIC, 3123 within the Promotional Period and all relevant forms.

7. Eligible Participants must include their full name, email address, suburb, postcode and contact phone number. Entries submitted by Eligible Participants must be received by the Promoter prior to the competition close. Entrants must take precautions to avoid any risk of injury, damage, or loss when filming their entry. Entrants must use appropriate safety gear and avoid dangerous tricks when collating their entry.

8. Only one entry per email address may be submitted. All entries become and remain the property of the Promoter.

Grand Prize

9. The two winners of the Grand Prize will receive:
 • Entry to the 9th Annual Grand Final of the “King of Groms” Competition (World Industries Global is a sponsor);
• A trip for 1 adult & 1 child to the US for participation in the event, including flights and 7 days accommodation in the US;
 • Attendance at the World Industries week in the lead up to the event (accompanied by a Designworks/World Industries representative);
 • A 12 month apparel sponsorship [value $500]

Total Grand Prize Value is AU$ [7,500] (GST included).

10. By entering this competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize- winner to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.

Accommodation is twin share standard room. Travel arrangements to and from the winner’s home and their nearest capital city airport do not form part of the prize unless expressly stated in these terms & conditions and are the responsibility of the winner and their travelling companions. The travel prize cannot be used as part payment for another airfare package. Frequent flyer miles cannot be accrued on this prize. Flights and accommodation are subject to availability at the time of booking and cannot be exchanged for other destinations. Travel restrictions & blackout dates apply. Prizes cannot be taken during peak periods or school holidays, and winners must provide all suppliers with a minimum of 21 days advance notice of intention to travel. Embargo restrictions apply during certain periods. Bookings are subject to conditions & availability (including but not limited to capacity limitations and other restrictions).

12. Compliance with any health or other government requirements is the responsibility of the prize winner and their travel companions. All prize travel will be subject to the carrier’s General Conditions of Carriage. The Promoter and carrier make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including local government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade at www.smartraveller.gov.au. Prizes for travel for a particular event or attraction must be taken to coincide with the event or the times and dates during which the attraction is available.

GAME OF SKILL

13. The winner will be determined by a panel at the Promoter’s head office (8 -14 Hall Street, East Hawthorn, VICTORIA 3123) at 11am on 16 January 2012. The winner will be determined based on what the panel decides is the most creative entry. The winners will be notified by phone and/or email/mail.

 This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged, based upon creative merit. All entries must be the original independent creation of the entrant and free of any claims that they infringe any third party rights. Entries must not have been used to win prizes in any other competitions.

The judges reserve the right to disqualify any entrant submitting an entry which, in the opinion of the judges, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The judges’ decision will be final and no correspondence will be entered into.

General Terms

14. Entrants must submit ONLY their own original video entries. Video entries cannot be previously published in any forum worldwide. All entries become the property of the Promoter and cannot be returned. Entries that are found to have been derived from the designs of a third party will be considered invalid and, if awarded a prize, that prize must be returned to the Promoter. The winner may be required to sign a statutory declaration regarding the originality of the entry. Without limiting the generality, the Promoter reserves the right to take legal action against anyone found to have breached this term. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation are reserved.

15. All video entries submitted become the property of the Promoter and Target Australia. Entrants acknowledge that their entry and all material included will be the property of the Promoter and Target Australia. As a condition of entering into this promotion, each entrant assigns all of their rights, title and interest (including copyright) in and to their entry to the Promoter (and Target Australia) from the time of entry. The Promoter (and Target Australia) may use video entries for promotional purposes or any other purpose it sees fit. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

16. All personal details become the property of the Promoter and Target Australia. The Promoter collects personal information about Eligible Participants to enable you to participate in this promotion and this information is collected in accordance with the National Privacy Laws. The Promoter may disclose your personal information to other companies associated with this Promotion.

17. By entering this competition, Eligible Participants understand and agree that the Promoter and Target Australia Pty Ltd (ABN 75 004 250 944) may use your personal details for compiling its customer database and contacting you for future promotional, marketing and publicity purposes. In each communication sent to you by the Promoter or Target Australia Pty Ltd (ABN 75 004 250 944) you will be given the opportunity to opt out of further marketing. If you do not want to be contacted you must opt out by using the method outlined in the communication sent to you. If you have a complaint about a message sent to you please contact the sender of the message.

18. The Promoter reserves the right to request that the winners sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

19. In accepting and participating in prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.

20. The Grand Prize is not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in the value of the prize. If for any reason a prize is not available, the Promoter reserves the right to substitute another item for it, in its sole discretion, of equal or higher value.

21. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.

22. The Promoter reserves the right to amend these Conditions of Entry if this competition cannot be run as originally planned. The Promoter may also cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.

23. The Promoter and their associated agencies and companies will not be liable or responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems of the phone or of any phone network, or any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur; whilst undertaking any travel won on or connected with their entry; in the participation in any prize; as a consequence of late, lost or misdirected mail, email; due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; any injury or damage to entrant’s or any other person’s computer software or phone; or any combination thereof, related to or resulting from participation or sending or receiving of any communication or of any materials in this competition.

24. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion and any other circumstances or matter related to the “You Tell Us” section (or any of them).

25. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and its associated companies and the agencies used in any promotion (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical or communication difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; © any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any misadventure, accident, loss or damage that may occur in the awarding of a prize or the taking of the prize by a winner (including while taking any travel); (f) any injury or damage to an entrant’s (or any other person’s) computing system or phone (or both) related to or resulting from participation or from sending or receiving any communications or any materials in a competition; (g) any tax liability incurred by a winner or Entrant; or (h) use of a prize.
