TERMS AND CONDITIONS
1. The promoter is The Herald & Weekly Times Pty Ltd (ABN 49 004 113 937)
of 40 City Road Southbank, Victoria 3006.
2. Instructions on how to enter form part of the conditions of entry. Entry
into the competition is deemed acceptance of these terms and conditions.
3. Entry is only open to residents of Victoria. Employees of the Promoter and
their immediate families, directors, management, related companies, and
their agencies associated with this promotion are ineligible. Immediate
family means any of the following: spouse, ex-spouse, de-facto spouse,
child or step-child (whether by natural or by adoption), parent, stepparent,
grandparent, step-grandparent, uncle, aunt, niece, nephew,
brother, sister, step-brother, step-sister or first cousin
4. To enter, readers must SMS 1999 1116 with their name, address, and
phone number. Competition SMS cost 55 cents including GST.
5. The competition commences at 12.01am (AEDT) on 20/12/11 and finishes
at 11.59pm (AEDT) the same day.
6. Multiple entries accepted provided that each entry is submitted separately
in accordance with the entry instructions. However only one prize per
phone number will be awarded.
7. The SMS entry mechanic is only open to readers with an SMS compatible
mobile phone connected to a service provider which permits text
messaging to the promotional SMS number. It is recommended that
entrants check with their individual service provider in this regard. For
SMS help call 1300 131 276.
8. SMS entries via internet or computer generation are invalid and will not be
accepted.
9. The time of entry will in each case be the time the SMS message is
received by Salmat IDR, Level 2, 116 Miller St, North Sydney, NSW 2160.
10. The Promoter, its agents, affiliates or representatives will not be liable for
any lost, late or misdirected entries.
11. Fifty winners will be drawn at 10.00am (AEDT) on 21/12/11 at Salmat
IDR, Level 2, 116 Miller St, North Sydney, NSW 2160.
12. Winners will be notified in writing and their passes will be mailed out
within two weeks.
13. There will be fifty (50) prize winners. Each winner will receive:
• A family in-season pass to the movie Alvin and the Chipmunks 3:
Chipwrecked valued at $64.00.
Total prize pool valued at $3400.
14. If the winner of any prize is under the age of 16 years, the prize will be
awarded to the winner’s nominated parent or guardian. Entrants under
the age of 16 years must obtain the prior permission of a parent or
guardian who is over the age of 16 years before entering the competition.
15. Any additional charges are the responsibility of the winner. The Promoter
accepts no responsibility for any variation in the prize value.
16. Conditions of use apply to the passes.
• The tickets will be valid from January 1, until season completion.
• Winners will be required to present their ticket at the box office which
will entitle them to two free adult tickets and two free children tickets to
one session of the movie Alvin and the Chipmunks 3: Chipwrecked while
it is screening in cinemas.
• Tickets will not be valid Tuesdays (or cinema discount days), after 5pm
on Fridays, Saturdays, Sundays or at any time on Public Holidays.
• Tickets must be taken as offered & are not transferable, exchangeable
or redeemable for cash.
• Seating is subject to availability. This pass does not guarantee
admission.
• Tickets are valid at participating Hoyts Cinemas, Village Cinemas,
Reading Cinemas, EVENT, Greater Union, Birch, Carroll & Coyle
Cinemas.
• Not valid at Village Cinemas Gold Class, Village Cinemas VMAX, Village
Cinemas Digital 3D, Reading Cinemas Gold Lounge,Titan XC or 3D
sessions, EVENT Cinemas Gold Class, Vmax and 3D, Greater Union +
Birch Carroll & Coyle Gold Class, VMAX and 3D, Hoyts Directors Suite, La
Premiere, Hoyts 3D cinemas, xtremescreen cinemas, Bean Bag cinemas
Hoyts IMAX, or The Halfpipe.
• Not valid with No Free Ticket listings
• Check movie classification, age restrictions may apply.
17. The Promoter accepts no responsibility if the event is cancelled, or the
date is re-scheduled for any reason whatsoever. If the prize or any part of
the prize becomes unavailable for reasons beyond the Promoters’ control,
the Promoter will endeavour but is not obliged to provide a substitute prize
of equivalent value.
18. In the event that a winner does not take the prize at the time and place
stipulated, then the prize will be forfeited by the winner and cash will not
be awarded in lieu of the prize. Prizes must be taken as offered and cannot
be varied. Any unused portion of the prize is not-transferable, nonrefundable
and non-redeemable for other goods or services and cannot be
taken as cash.
19. The Promoter reserves the right to verify the validity of entries and to
disqualify any entry which, in the opinion of the Promoter, includes
objectionable content, profanity, potentially insulting, inflammatory or
defamatory statements, disqualify any entrant who tampers with the entry
process, who submits an entry that is not in accordance with these terms
and conditions of entry, or who has, in the opinion of the Promoter,
engaged in conduct in entering the promotion which is fraudulent,
misleading, deceptive or generally damaging to the goodwill or reputation
of the promotion and/or Promoter. The Promoter reserves the right to
disqualify a winner if the Promoter becomes aware that the winner and/or
the winner’s entry is of a type described in this clause.
20. If for any reason, this competition is not capable of running as planned,
including due to infection by computer virus, bugs, tampering,
unauthorised intervention, fraud, technical failures or any other causes
beyond the reasonable control of the Promoter which corrupt or affect the
administration, security, fairness, integrity or proper conduct of this
promotion, the Promoter reserves the right, in its sole discretion, to
disqualify any individual who tampers with the entry process, take any
action that may be available and to cancel, terminate, modify or suspend
the competition subject to any written directions given under State
Legislation.
21. Except for any liability that cannot be excluded by law, the Promoter
(including its officers, employees and agents) excludes all liability
(including negligence) for any personal injury, loss or damage (including
loss or opportunity) whether direct, indirect, special or consequential,
arising in any way out of the promotion, including but not limited to,
where arising out of the following:
a) any technical difficulties or equipment malfunction (whether or
not under the Promoter’s control);
b) any theft, unauthorised access or third party interference;
c) any entry or prize claim that is late, lost, altered, damaged or
misdirected (whether or not after receipt by the Promoter) due to
any reason beyond the reasonable control of the Promoter;
d) any variation in prize value to that stated in these conditions of
entry;
e) any tax liability incurred by a winner or entrant;
f) the broadcast of any program relating to the competition or the
publication of any material, including statements made by any
compere, staff member, journalist, other entrants or any other
person; and/or
g) participation in the prize.
22. The Promoter reserves the right, in its sole discretion, to disqualify any
individual who the Promoter has reason to believe has breached any of
these conditions, or engaged in any unlawful or other improper misconduct
calculated to jeopardise the fair and proper conduct of the promotion. The
Promoter’s legal rights to recover damages or other compensation from
such an offender are reserved.
23. The Promoter collects entrants’/claimants’ personal information in order to
conduct the promotion. If the information requested is not provided, the
entrant/claimant may not participate in the promotion. The Promoter may
share entrants’/claimants’ information with persons or entities assisting in
the conduct of the promotion and with companies who are prize partners.
By participating in the promotion, unless otherwise advised, each
entrant/claimant also agrees that the Promoter may use this information
to contact the entrant/claimant by any means (including SMS or e-mail) at
any time in the future to let them know about goods, services and
promotions which may be of interest to them without any further
reference, payment or other compensation to the entrant/claimant. If you
