Conditions of Entry - Nicorette Fitness First Offer (the “Promotion”)

Information and instructions on how to enter and prizes form part of these Conditions of Entry. Entry into the Promotion is deemed acceptance of these Conditions of Entry.
Entry is open to Australian residents aged 18 years or over (“Eligible Entrant”). Purchase of a Nicorette® product is not required for entry into the Promotion
Pharmacists and qualified healthcare professionals as well as directors and employees of the Promoter and any of its’ agencies associated with this Promotion (and each of their immediate families) are ineligible to enter.
The Promotion commences on 03/01/12 at 00:01 (AEDST) and concludes on 29/02/12 at 23:59 (AEDST) (“Promotion Period”).
To enter the major prize draw and to win a prize instantly, an Eligible Entrant must, during the Promotion Period, complete the following steps:
(a) Collect their entry card from a participating pharmacy with a unique code hidden under the silver latex panel then,

(b) visit www.nicoretteoffer.com.au and complete the online entry form as required including submitting their unique code from their entry card.

The first 100,000 entries received will be randomly awarded a prize from the

instant win prize pool and automatically entered into the major prize draw.

There will be 100,000 unique codes printed for this promotion.

An Eligible Entrant can submit multiple entries, however only one (1) entry is permitted per entry card / unique code. Only one prize type of the instant win will be awarded per winner.
The instant win prize pool consists of 20 x 1 month Fitness First Platinum Memberships valued at $116 and 99,980 x Fitness First one-week starter passes valued at $29.95. Participants will be notified immediately upon completion of their online entry that they are an instant winner and provided with instructions on how to claim their prize.
All entries received will be entered into the major prize draw conducted at 10:00am on 02/03/12 at Oxygen Marketing, Level 1, 16 Palmer Parade Cremorne VIC 3121. The first valid entry drawn from each State group (VIC/TAS, NSW/ACT, SA/NT, QLD, WA) will each win a 6 month Fitness First membership valued at $700.
Total prize pool value is $3,000,221 RRP (INC GST); correct at the time of printing.
The one (1) month and six (6) month Platinum memberships are valid at any Fitness First club in Australia, for non-members only 16 years and over. Not valid with any other offer. Recipient is entitled to use one certificate only. Memberships must be activated within 6 months from the date of issue and the one-week starter passes must be activated within 1 month from the date of issue. Standard conditions of membership apply (see in club for details). Winners can transfer their Membership and Starter Passes with notice to the Promoter.
Entries must be received by the Promoter by 23:59 (AEDST) on 29/02/12. Illegible, late, incomplete or incorrect entries will be invalid and therefore ineligible to enter the promotion or win a prize.
Each entrant is responsible for paying for the costs associated with entering the promotion.
The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and proof of entry validity in order to claim any prize. Proof of identification, residency and entry validity considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
The Promoter reserves the right to verify the validity of entries and to disqualify: (a) any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements; (b) any entrant who tampers with the entry process; (c) any entrant who submits an entry that is not in accordance with these Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter.
The Promoter accepts no responsibility for any late, lost or misdirected entries including fax messages not received by the Promoter or delays in the delivery of the fax due to technical disruptions, network congestion or for any other reason.
The Promoter’s decision is final and no correspondence will be entered into. If a prize, or element of a prize, is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value for that prize, or element of it, subject to the approval of any relevant authority. If a winning entry is deemed not to comply with these Conditions of Entry, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in the unclaimed prize draw in accordance with Condition 22.
Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit. By accepting a prize, the winner agrees to participate in and co-operate if required by the Promoter with all reasonable media editorial requests relating to the promotion, including but not limited to, being interviewed and photographed and/or filmed.
Dollar values are in Australian dollars. Prizes are not transferable or exchangeable and cannot be redeemed for cash. In the event for any reason a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize.
The Promoter accepts no responsibility for any tax implications that may arise from winning of the prizes. Independent financial advice should be sought.
Major prize winners will be notified by telephone and all winners will be notified in writing (email) within 2 days of the draw. Major prize draw winners’ will have their name and State/Territory of residence published in the public notice section of the Australian newspaper on 09/03/12.
Should an entrant’s contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
In the event a membership prize remains unawarded or unclaimed at the conclusion of the Promotion, the Promoter may conduct a second chance draw from all entries who have not previously won a membership prize at 11:00am on 8/05/12 at Oxygen Marketing, Level 1, 16 Palmer Parade Cremorne VIC 3121 in order to distribute any unawarded or unclaimed membership prize at that date, subject to any written directions given by any relevant authority. All second chance winners will be contacted by telephone and in writing within two (2) days of the draw and their names and State or Territory of residence will be published in the Public Notices section of The Australian newspaper on 15/05/12.
Programming and other quality control errors will not invalidate an otherwise valid prize claim. Printing errors or other quality control matters outside the control of the individual player shall not be used as the sole basis for refusing to award a prize.
Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.
The Promoter and its agencies and companies associated with this Promotion shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect, special or consequential loss or loss of profits) or for any personal injury or death which is suffered or sustained (including without limitation to that caused by any person’s negligence) arising out of or in connection with this Promotion or the awarding or taking of the prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).

Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth). The Promoter and its’ associated agencies and companies are not responsible for any incorrect or inaccurate information, either caused or provided by the entrant, or for any of the equipment associated with or utilized in this Promotion, for any technical error, or for any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries, and reserves the right to take any action that may be available.
If the Promotion is not capable of being conducted due to circumstances beyond the Promoter’s control, including due to any technical or communications problems, the Promoter reserves the right to amend, suspend or cancel the Promotion subject to approval from any relevant authority.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Entrants’ personal information (“PI”) will be collected to enable the Promoter and its agencies to administer and promote this promotion and its winners. The PI of entrants may be provided to others assisting in the conduct of the promotion, including suppliers and deliverers. If the PI requested is not provided, the entrant may not participate in the promotion. By entering this promotion the entrant consents to the use of their PI as described.
