Terms and Conditions

 

1.  Participation

1.1 The NATBUILD (NATIONAL BUILDING SUPPLIERS GROUP), Big Builder Buys Promotion – Win a New Zealand Quad Biking Adventure 2012 will commence at 9.00am AEST on 1 June 2012 and will close at 11:59pm AEDT on 31 July 2012 (Natbuild Big Builder Buys Promotion Period).   

1.2 Entry to the Promotion constitutes acceptance of these Conditions.  All entry, instructions and prize information published by the Promoter form part of these Conditions.

1.3 Entry is only open to Australian residents 18 years and over (as at 01/06/2012) and companies operating within Australia (Eligible Entrants).

1.4 The competition is not open to employees of the Promoter and their immediate families, subcontractors, agencies, suppliers or related corporations associated with the promoter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

1.5 If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

2. Entry 

2.1 To enter, entrants, being either an individual, or in the case of a company, an authorised representative of an eligible company, must:

2.1.1 Purchase, selected Big Builder Buys Promotion product(s) from any participating Natbuild (National Building Suppliers Group) store during the Promotion Period.

2.1.2 And  either:

a) Visit www.bigbuilderbuys.com.au (Big Builder Buys Promotion Website) follow the prompts to the competition entry page, input the requested details and submit the fully completed entry form during the promotional period, between 01/06/2012 and 08/08/2012 inclusive.

b) Input the requested details and submit the fully completed paper registration form obtained in store from Natbuild (National Building Suppliers Group) member stores and post to Locked bag 1600, Artarmon NSW 1570, during the promotional period, between 01/06/2012 and 08/08/2012 inclusive.

2.2 The number of entries into the promotion is determined by the selected Big Builder Buys Promotion product(s) purchased by the Eligible Entrant.

2.3 Entries into the promotion during the months of June and July will be eligible for the Major Prize draw . The last day for receiving entries for the Major Prize draw is 08/08/12.

2.4 The selected Big Builder Buys Promotion products and number of entries earned into the promotion per selected Big Builder Buys Promotion product purchased are as follows:

2.5 Incomplete, indecipherable or illegible entries will be deemed invalid.

2.6   The Promoter takes no responsibility for any lost, stolen, damaged, late or misdirected entries or for any delays or failures in any delivery service or equipment.

3. The Draw

3.1 There will be 1 draw in total, one major prize draw (draw one). The draw will take place at Units 1 and 2, 39 Herbert Street, St Leonards NSW 2065 at 4pm AEDT as per the below dates. The winner will be notified by SMS message and the winner’s name will be published in The Australian as per the below dates. If the winner does not provide a mobile number upon entry, the winner will be contacted on the phone number provided on entry and required to provide the Promoter with an email or mail address to allow the Promoter to provide a written confirmation of the prize won.

The Promoter’s decision is final and no correspondence will be entered into.

3.1 The first valid entry drawn from the Major Prize Draw will win the Major Prize for 4 people, valued up to $16,800 (includes all flight associated taxes), consisting of the following:

Return economy class airfares from the winners’ nearest capital city airport to Queenstown on Air New Zealand for 4 winners;
Return coach/shuttle airport transfers from Queenstown Airport to Queenstown Accommodation
4 night’s 4-star accommodation at Novotel Queenstown Lakeside in Queenstown (2 rooms) with daily breakfast
Unique 2 day / 1 night quad biking adventure with lunches and drinks during quad biking, accommodation and dinner in country pub (excludes alcohol)
Travel Insurance

3.2 The total prize pool for the promotion is up to the value of $16,800. The Major Prize is non-negotiable.  The prize (including any unused portion) cannot be transferred, exchanged or redeemed for cash.  The prize must be taken as offered and cannot be varied by a winner.  In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant State and/or Territory regulatory authority. The Promoter retains the right to substitute the prize with a prize or prizes of equal or greater value (including where a prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.

3.3 Additional spending money, taxes, insurance, transport to and from departure point, items of a personal nature, in-room charges and all other ancillary costs incurred as a result of taking part in the prize are not included.

3.4 The winner and companion/s must possess a valid passport with a minimum of (6) six months validity from the date of scheduled return to Australia. It is the responsibility of the winner and their companion/s to ensure that they have full and correct documentation for travel.

3.5 The prize must be booked before 22/11/12. In the event that the prize is not booked on or before this date, the prize will be deemed unclaimed.

3.6 The prize must be taken between 01/11/12 and 31/05/13 (excluding school holidays and public holidays) and is subject to booking and flight availability. If the activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.

3.7 The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant State and/or Territory regulatory authority.

3.8 The winner and companion must depart from and return to the same departure point and travel together. Once flight dates have been confirmed by the Prize Provider/s no further changes will be allowed. The itinerary is to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. The Prize is subject to the standard terms and conditions of individual prize and service providers. Winner and companions may be required to present a credit card at time of accommodation check in.

3.9 The Promoter, prize provider and activity operators, in their absolute discretion, at all times reserve the right to: (a) prevent any winner and/or their companion/s from participating in the Activity if, at any time, they reasonably believe that they pose a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. (c) vary and/or substitute the prize (or part thereof) without notice with a prize to the equal value and/or specification, subject to any written directions from a State and/or Territory regulatory authority.

3.10 As a condition of accepting the “Big Builder Buys Promotion – Win a New Zealand Quad Biking Adventure 2012” major prize, the winner and companion must sign any legal documentation as and in the form required by the Promoter and/or Prize Providers in their absolute discretion, including but not limited to a legal release and indemnity form.

3.11 The winner and companion/s of the “Big Builder Buys Promotion – Win a New Zealand Quad Biking Adventure 2012” major prize acknowledge that elements of the prize are dangerous and may result in injury or death, and participate at their own risk. To the full extent permitted by law neither the Promoter, and/or any of its employees, contractors and agents or employees of its contractors and agents, and/or companies providing prizes for the Promotion, will be liable for any liability / cost / loss / damage / expense / death / personal injury suffered or incurred or any dispute (including, but not limited to, direct/indirect/consequential loss) arising out of, or in connection with this Promotion.
3.12 The prize values are correct as at April 2012 and the Promoter accepts no responsibility for the variation in prize value over the duration of the promotion.

3.12.1 A draw for the Major Prize, if unclaimed, may also take place on 27/11/12 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified by phone and mail and the winners name published in The Australian on 06/12/12.

4. General

4.1 All entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

4.2 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to modify, suspend, terminate or cancel the promotion, as appropriate and subject to the approval of all relevant State and Territory Lottery Departments.

4.3 The Promoter makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Big Buys Promotion.

4.4 The Promoter reserves the right, at any time, to verify the validity of entrants (including an entrant’s identity, age and place of business and / or residence) and reserves the right to disqualify any participant viewed to be tampering with the entry process or submitting an entry that is not in accordance with the promotion’s terms and conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4.5 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

4.6 All entrants consent to their personal information being collected and stored for the purposes of administering the competition, only and is limited to the Australian regulatory authorities, as required. Entry is conditional upon providing this information. All entries become the property of the Promoter.
