App Terms and Conditions
Your use of the App
Provided you comply with these Terms and Conditions (and the terms and conditions referred to below), the Promoter grants you permission to use the App by way of a non-exclusive and non-transferable licence. This means that whilst others may be granted permission to use the App, they may only be granted such permission by the Promoter and not you. For the avoidance of doubt you do not own the App.
The ownership of all intellectual property rights in or relating to the App and the content of the App are the property of the Promoter and/or its licensors. No rights are granted to you other than those expressly granted to you under these Terms and Conditions.
You may use the App for your personal and non-commercial use only.
You understand and accept that the hardware you use to access the App will require certain software in order for the App to work correctly and it is your sole responsibility to ensure that you have the required up-to-date software.
The App may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the Promoter's control.
The Promoter does not charge users for use of the App or when entering a competition via the App. However, mobile network operators may charge their customers' data charges for using the App. Data charges may vary depending on the entrant's mobile network operator and tariff and entrants should contact their mobile network operator for more details.
The App is provided "as is", and your use of it is at your own risk. We do not warrant or make any guarantees that the App will be free from viruses, available or that its contents or operation will be accurate and/or error-free.
Although we take reasonable steps to secure the App, you acknowledge that the internet is not a completely secure medium and we make no warranties, express or implied, that any information or materials you post on or transmit through the App will be safe from unauthorised access or use.
We, our officers, directors, employees, agents and assignees, disclaim, to the fullest extent permitted by law, all express and implied warranties, including, without limitation, any warranties of merchantability, fitness for a particular purpose, title and non-infringement.
Additional Terms and Conditions
The Facebook App is made available via Facebook. Your use of the Facebook App is therefore subject to the relevant Facebook terms and conditions at www.facebook.com/terms.php?ref=pf (the "Facebook Terms").
In the event of a conflict between the Facebook Terms and these Terms and Conditions and/or any Competition Details, the Facebook Terms as applicable will prevail.
Restrictions on use of the App
You must not use the App to do any of the following:
use the App for any improper, unlawful, or immoral purpose;
cause any nuisance by your use of the App or cause the operation of the App to be jeopardised or impaired;
create, host, or transmit any defamatory, offensive, or obscene material, or engage in activities which would cause offence to others on grounds of race, religion, creed, or sex;
harm or attempt to harm minors in any way;
create, host, or transmit any material that threatens or encourages bodily harm or the destruction of property, or would constitute a criminal offence or give rise to civil liability;
create, host, or transmit material which infringes the copyright, trademark, patent, trade secret, privacy, right of publicity, or other intellectual property or proprietary rights of any other party;
create, host, or transmit unsolicited advertising material to other users;
create, host, or transmit any material that harasses another;
make false, misleading, deceptive, or fraudulent offers to sell or buy products, items, or services, or to send chain letters or pyramid schemes or the like;
add, remove, or modify identifying network header information or copyright management information, including author names, publication dates, or clearance agency names, in an effort to deceive or mislead;
access, or to attempt to access, the accounts of others or to penetrate or attempt to penetrate our or a third party's security measures, computer software, hardware, electronic communication systems, or telecommunications systems;
collect, or attempt to collect, personal information about third parties without their knowledge or consent, or to engage in "screen scraping," "database scraping," or any other activity with the purpose of obtaining lists of users or other data;
any activity which adversely affects the ability of other people or systems to use the App or the Internet generally, including, without limitation, flooding and hacking;
resell, repurpose, or redistribute any intellectual property provided by us our contractors or our licensees without our prior written consent;
impersonate any person or entity or using a false name that you are not authorised to use;
encourage, condone, or glamorise under-age drinking, drunk-driving, or excessive consumption of alcoholic beverages; or
except as provided for in these Terms and Conditions, disclose any personally identifiable information about yourself or any other party (e.g. telephone number, geographic address, or any other information from which an individual's identity or contact information can be derived).
Top Rum Competitions Terms and Conditions
Eligibility to enter the Competitions
The Competitions are open only to legal residents of Australia who are aged 18 years or over.
Entrants must also meet any additional eligibility requirements set out in the Competition Details.
The Competitions are not open to employees (and their immediate families (spouse, parent, child or sibling) and household members) of the Promoter, Facebook or their affiliates, subsidiaries, agencies or advisors; and/or anyone else involved in the creation or administration of the Competitions, or their immediate families or household members.
How to enter the Competitions
The opening and closing date and time for each Competition will be specified in the Competition Details. Any entries received after the applicable closing date will be invalid.
To enter a Competition, entrants will need to access the App and complete the registration process.
Once an entrant has registered to use the App, entrants can enter the Competitions by following the steps as described in the promotional material relating to the specific Competition the entrant is entering and as further described in the Competition Details.
The number of entries which may be entered into a Competition will be set out in the relevant Competition Details.
In order to enter a Competition, entrants will be required to provide their name, age, email address and any additional information set out in the Competition Details.
You must not endanger yourself or others, or take any unnecessary risks in order to make an entry to any Competition.
Entrants are solely responsible for any expenses incurred in entering any/all Competitions.
Any entries submitted to the Competitions must have been made solely by the entrant.
You declare that information you provide on entering any/all Competitions is true and correct.
Entries must be made by the authorised account holder of the email address submitted at the time of entry to the relevant Competition.
Submissions
To the extent permitted by law, you hereby assign to the Promoter all intellectual property rights in any/all content (whether audio, video, audio-visual, written, and/or pictorial) which you submit as part of your entry to any/all Competitions. This assignment will be worldwide and royalty-free, without any restriction or limitation in time.
The assignment in paragraph 6.1 above means that once you have submitted your entry to a Competition it will be owned by the Promoter. The Promoter will therefore be entitled to use, reproduce, modify, edit, store and retrieve all Competition entries for any purpose in any way that the Promoter thinks fit and in any possible medium on a perpetual, irrevocable, royalty-free, worldwide basis and will not be required to obtain consent from entrants or make any payment to entrants for such use, reproduction, and/or modification. Entries submitted to Competitions may be used by the Promoter and/or the Promoter's partners and/or talent employed by the Promoter, in all cases in the Promoter's sole and absolute discretion. The Promoter does not promise or guarantee that any entries will be featured in any such way.
To the extent permitted by law, you hereby waive all moral rights or other transferable rights in any content the material to which the entrant is or may at any time in the future be entitled or any similar provisions of law in any jurisdiction.
Content requirements / standards for Competition entries
Entrants warrant and promise that any entries submitted to a Competition are the sole and original creation of the entrant and have not been copied in whole or in part from any other work.
Competition entries must not advertise or promote third parties' or your own goods or services.
Entries must not use third party artistic works, copyrights, trademarks, trade names, logos, similar brand identifying marks, trade secrets or other proprietary rights.
Entries must not refer to drinking alcohol or people who are, or appear to be, under the legal drinking age in the entrant's country of residence.
Entries must not suggest Bundaberg Rum products or alcohol in general make you more confident, popular or attractive or that it is acceptable, glamorous or generally positive to be intoxicated.
Entries must not (a) depict or refer to people conducting themselves in an inappropriate manner, (b) contain any material that would degrade or demean the human form, image or status of women, men or the members of any group based on race, religion, ethnic background, sexual orientation or any other minority status, (c) be offensive towards anyone, or (d) refer any other participant in a Competition.
Entries should not show, imply, encourage or refer to aggression or unruly, irresponsible or anti-social behaviour nor link alcohol with brave, tough or daring behaviour.
Entries should not particularly appeal to under 18s or feature real or fictitious characters who appeal particularly to people under 18.
Obscene, provocative, sexually overt, lewd or otherwise objectionable content or entries which reflect poorly on the Bundaberg Brand brand or any other brands of the Promoter and its affiliates will not be considered, and the determination of the appropriateness of any Competition entry is at the sole discretion of the Promoter.
Entries passing judgment on those who choose not to drink alcohol will be rejected.
Any entry that suggests Bundaberg Rum beverage alcohol products, or any beverage alcohol product, is good for you or has any positive medicinal or therapeutic property because it contains alcohol, or suggests that someone should only consume drinks with a high alcohol content, will be rejected.
Any entry that implies it is acceptable to drink alcohol before or while driving any kind of vehicle, operating any kind of machinery, or while undertaking any activity that requires alertness, concentration, or physical coordination will be rejected.
You must ensure that any materials you submit as part of any Competition do not contain any confidential, secret, or proprietary information. Any information submitted as part of any Competition will be deemed not to be confidential, secret, or proprietary.
Selection of Winners
The number of winners for each Competition will be set out in the Competition Details.
In order to select the winner(s) for each Competition. The Promoter will appoint a panel of judges, at least one of whom shall be independent of the Promoter (the "Judges").
The Judges will choose the winner(s) of each Competition taking account of the criteria set out in the relevant Competition Details.
Entries will only be considered by the Judges as eligible to win the specific Competition into which they were entered.
The selection of the winner(s) will be made at the discretion of the Judges. The Promoter's and the Judges' decisions are final and no correspondence will be entered into.
The date when the winner(s) will be selected will be set out in the Competition Details.
The winner will be contacted via email by the date set out in the Competition Details. The winner may be required to provide valid identity documents as proof of age.
If any winner cannot be contacted by the Promoter or does not meet the criteria referred to in paragraph 8.7 above (including for the avoidance of doubt any criteria set out in the Competition Details), the Promoter reserves the right to choose another winner based on the criteria set out in the relevant Competition Details. The Promoter can repeat this process any number of times until it has selected a satisfactory winner in accordance with these Terms and Conditions.
Please ensure you check your email account regularly (including any junk email folders) to ensure that you can be contacted by the Promoter via email.
The winner of a Competition may be required to participate in publicity. To the extent permitted by law, winners consent to the use by the Promoter and its related companies, for an unlimited time, of their voice, image, photograph, name and likeness for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by the Promoter and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and in entering the Competition, all entrants consent to the same. Winner(s) may be required to sign a release and/or waiver to give effect to this paragraph.
Prizes
A description of the prize for each Competition will be set out in the Competition Details.
Taxes, transfers, hotel incidentals (including the mini bar) and any other expenses not expressly stated in these Terms and Conditions and the relevant Competition Details are not included as part of any prize.
No cash alternative will be offered and prizes are not transferable nor changeable in any manner.
Winner must comply with any directions given to him/her by the Promoter and/or its agents and with all relevant laws, rules, regulations, guidelines, restrictions, and where applicable itineraries. Failure to comply with this paragraph may result forfeiture of the prize.
The Promoter will endeavour to deliver the prize to the winner within twenty eight (28) days from the date of winner confirmation unless stated otherwise in the Competition Details. The Promoter and/or its agents will not be liable where a prize has been lost or stolen following delivery and such prize will not be replaced.
General Terms and Conditions
The Promoter's Responsibility and Liability
The Promoter will not be responsible for the content of any material submitted by entrants to any Competitions and entrants accept that (i) they will be responsible for ensuring that any material submitted does not infringe the rights of any third party (including intellectual property rights) and (ii) they will be liable for any claims, losses, fines, penalties, costs or damages suffered or incurred as a result of any such infringement.
The Promoter will not be responsible for lost, late, damaged, corrupted, illegible, misdirected, or incomplete Competition entries, or for entries not received due to lost, failed delayed or interrupted connections or miscommunications, or to other electronic malfunctions, delays, or errors of any kind in the transmission or receipt of entries.
You agree that, to the extent permissible by law, the Promoter and its affiliates, agents and their employees and directors assume no liability for injuries, losses or damages of any kind to property or persons, resulting in whole or part, directly or indirectly, from entry into any Competition, any acts or omissions of any entrant, or participation in the Competition in any way.
To the fullest extent permitted by law we, our officers, directors, employees, agents and assigns, hereby disclaim all liability for any loss, cost or damage (direct, indirect, consequential, or otherwise) suffered by you as a result of your use of the App or from any computer virus transmitted through the App, or other sites accessed from the App, whether such loss, cost or damage arises from our negligence or otherwise and even if we are expressly informed of the possibility of such loss or damage.
To the fullest extent permitted by law, in no event shall the Promoter's total liability to you for all damages, costs, losses and causes of action in the aggregate (whether in contract, tort, including but not limited to negligence, or otherwise) arising out of or in connection with these Terms and Conditions exceed, in the aggregate, $100.
The Promoter shall not be in breach of these Terms and Conditions, nor liable for delay in performing, or failure to perform, any of its obligations under these Terms and Conditions, if such delay or failure result from events, circumstances or causes beyond its reasonable control.
Nothing in these Terms and Conditions shall exclude the Promoter's liability for death or personal injury as a result of its negligence or fraudulent misrepresentation.
General
The Promoter reserves the right, in its sole discretion, to cancel or suspend all or a portion of any Competition, should viruses, bugs or other causes beyond the control of the Promoter corrupt the administration, security or proper operation of any Competition.
The Promoter reserves the right to withdraw or amend any Competition and the nature of any prize (to an alternative of equal or greater value) in the event that it or its conduct of the Competition is affected or is likely to be affected by any unforeseen circumstances and/or circumstances outside its reasonable control.
These Terms and Conditions constitute the entire agreement between you and us in relation to their subject matter and supersede any and all prior promises, representations, agreements, statements and understandings whatsoever between us.
The failure by the Promoter to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be unenforceable or invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions shall remain in full force and effect.
The Promoter may assign or otherwise transfer its rights and obligations under these Terms and Conditions to third parties.
The Promoter will use entrants' personal information only in accordance with the Privacy Policy available at www.bundabergrum.com.au.
The Competitions will be void where prohibited or restricted by law.
The Promoter reserves the right to change the contents of the App, including these Terms and Conditions at any time, without notice, and such changes shall be effective immediately when they are made available on the App. The date these Terms and Conditions were last updated appears at the bottom of these Terms and Conditions. It is your responsibility to familiarise yourself with these Terms and Conditions on a regular basis to ensure that you are aware of any changes. Your use of the App following any such changes will constitute your acceptance of the revised Terms and Conditions. We recommend that you print and store or save a copy of these Terms and Conditions for future reference.
These Terms and Conditions will be governed by and construed in accordance with the laws of New South Wales. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of New South Wales.
In the event that you have a complaint regarding the App or the operation of any Competition, please contact us via email at Diageo.australia.consumer.care@diageo.com. The Promoter will use all reasonable endeavours to consider any complaints but will not be obliged to reply.

TOP RUM PROMOTION
Competition Details For Top Rum Competition 1.
These are the Competition Details referred to in the Top Rum Terms and Conditions available as set out above. These Competition Details should be read alongside the Top Rum Terms and Conditions. Below are terms and conditions and further details which relate solely to the Top Rum Competition 1 (the "Competition"). Unless stated otherwise, capitalised terms in these Competition Details will have the same meaning as in the Top Rum Terms and Conditions.
Entry to this Competition will be open from 9am on 31 July 2012 and will close at 5pm on 11 September 2012 (Entry Period), subject to the operation of clause 9 below. All times throughout these terms and conditions are based on Sydney local time.
To enter this Competition, each entrant (hereafter 'Squadron Leader', 'you' or 'entrant') will be required to undertake the following via the App during the Entry Period:
In accordance with the instructions provide all requested entry details;
Develop and submit their 'Squadron Name' within 25 characters in length including any spaces;
Create and submit a Squadron emblem based on a gallery of designs on the App;
In accordance with the instructions, nominate a minimum of four (4) friends from their friends on Facebook to form part of their Squadron via the App. To form a Squadron the entrant must have 4 people join their Squadron. The entrant must only nominate friends aged 18 years or over.

Entrants acknowledge that their entry will only be accepted as part of the Competition once their Squadron is completed with 4 friends joining the entrant's Squadron. Places in the Squadron will be on a first come first serve basis. For the sake of clarity, once a Squadron is completed no further friends of the Squadron Leader will be permitted to join their Squadron.
Each entrant is only entitled to enter the Competition on one occasion as a Squadron Leader, but can be a part of another Squadron Leader's team.
The Promoter accepts no responsibility should a Squadron Leader not have a sufficient number of fiends join their Squadron, and therefore gain an entry into the Competition. The Promoter may, but is under no obligation to do so, notify the Squadron Leader that they do not have sufficient friends in the Squadron.
By entering this Competition, entrants agree that they can be contacted in connection with this Competition. Entrants acknowledge that they will be able to select whether or not they receive further communications on future promotions and marketing activities, but selecting this option will not prevent the Promoter contacting the entrant using the details provided for the purpose of this Competition.
Subject to clause 9 below, there will be 6 rounds in the Competition (Rounds). Round 1 closes at 5pm on 7/8/12. Round 2 closes at 5pm on 14/8/12. Round 3 closes at 5pm on 21/8/12. Round 4 closes at 5pm on 28/8/12. Round 5 closes at 5pm on 4/9/12. Round 6 closes at 5pm 11/9/12. If in accordance with cause 1.9 below, Round 7 is required, it will close at 5pm on 18/9/12. All valid entries accepted into the Competition prior to the closing time for a Round will be included in a Round. Winning entries in a Round will not be entered into any subsequent Round, but non-winning entries will roll over into any subsequent Round. Judging for each Round will commence on the following NSW business day after each Round has concluded.
The Judges will choose the winner taking account of the following criteria: creative and original merit of the Squadron names. Subject to the operation of clause 9 below, the best 333 entries in each Round, as determined by the Judges, will win the prize of a 700ml bottle of Bundaberg Original Select Vat Rum valued at RRP$49.99. The winners will be contacted via email on or before 20/9/12.
If there is less number of entries received than the number of prizes to be awarded in a particular Round, then those un-awarded prizes will be entered into the subsequent Round, and an additional number of entries will be selected by the Judges to award those additional prizes in that subsequent Round. If there is less number of entries received than the number of prizes to be awarded in Round 6, the Entry Period will be extended to 5pm on 18/9/12, and an additional round will take place, i.e. Round 7, and those prizes that remain and were not awarded in Round 6 will be awarded in Round 7.
TOP RUM PROMOTION
Competition Details For Top Rum Competition 2.
These are the Competition Details referred to in the Top Rum Terms and Conditions available as set out above. These Competition Details should be read alongside the Top Rum Terms and Conditions. Below are terms and conditions and further details which relate solely to the Top Rum Competition 2 (the "Competition"). Unless stated otherwise, capitalised terms in these Competition Details will have the same meaning as in the Top Rum Terms and Conditions.
Entry to this Competition will be open from 9am on 9/8/12 and will close at 5pm on 15/10/12 (Entry Period). All times throughout these terms and conditions are based on Sydney local time.
In addition to the eligibility requirements as set out in the Top Rum Terms and Conditions, this Competition is only open to winners of the Top Rum Competition 1 who receive an email notifying them that they can enter this Competition from the Promoter with a password.
To enter this Competition, each entrant be required to undertake the following via the App during the Entry Period:
In accordance with the instructions provide all requested entry details, including the relevant password;
In 500 characters or less share their product experience of the prize that they won in Top Run Competition 1 of a 700ml bottle of Bundaberg Original Select Vat Rum.
Each entrant is only entitled to enter this Competition on one occasion.
By entering this Competition, entrants agree that they can be contacted in connection with this Competition.
The Judges will choose the winner taking account of the following criteria: creative and original merit of their product experience. Judging will commence on the following NSW business day after the Competition has concluded. The best entry, as determined by the Judges, will win the prize of $500 Red Balloon Day voucher, which can be redeemed for a Tiger Moth airplane experience or such other experiences as available at Red Balloon Days. Tiger Moth experience is available at limited locations in Australia. Redemption of the voucher is subject to any standard terms and conditions of Red Balloon Day. Any unused portion of the voucher cannot be taken as cash. Any ancillary costs associated with redeeming the voucher are the responsibility of the winner. The winner will be contacted via email to confirm eligibility to accept the prize on or before 19/10/12.
Entrants acknowledge that their entries may be posted on the Promoter's Facebook page, and this does not mean that they'll be selected as the ultimate winner.
