Terms & Conditions
By entering the “Booze Buddy Win the New iPad” competition, you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
1.2 By entering this competition, entrants agree to be bound by these Terms & Conditions (and by any other requirements set out in the promotional material), which may be amended or varied at any time by the Promoter.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia who are 18 years of age and over.
2.2 Employees and immediate families of Booze Buddy (WayNorth Pty. Ltd.) and their associated agencies and companies are not eligible to enter.
3. HOW TO ENTER
3.1 The competition commences at 9:00a.m. on Friday 27th July 2012 and concludes at midnight on Friday 28th December 2012.
3.2 In order to enter, you must first download the Booze Buddy iPhone application from the iTunes App store (insert link here) and from the Settings tab use the “Help Booze Buddy” feature to report an incorrect or missing bottle shop listing during the competition period. When you report a missing or incorrect bottle shop listing using this feature you will be directed to the Booze Buddy website, where you will be able to complete the competition registration form. This competition can also be entered from the Booze Buddy Facebook Fan Page. Correct completion of this form is a requirement for a valid entry.
3.3 Entrants must only enter in their own name. The Promoter reserves the right to request the winner to provide proof of identity and age, proof of residency at the nominated prize delivery address and/or proof of entry validity (if required) in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered and the prize will be reallocated to the runner up.
3.4 Entries must be received by midnight on Friday 31st August 2012 AEST. The time of entry will in each case be the time the entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not received by the Promoter or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.
3.5 To submit a complete and valid online entry to the competition, entrants will be required to provide various personal details including full name, email address, residential address, contact phone number/s, age/date of birth and gender for the purpose of verifying eligibility. Any contact details entered incorrectly shall invalidate the entry. Online entry is free, however internet connection rates apply.
3.6 All entries and any copyright subsisting in the entries become and remain the property of the Promoter.
4. PRIZE
4.1 There will be one winner. The winner will receive one prize, as set out in clause 4.2.
4.2 The prize consists of 1 brand new iPad 32gb WiFi (white or black). Total prize value is $649.00.
4.3 The winner will be mailed their prize and are responsible for providing correct mailing address details to Booze Buddy. The Promoter does not take any responsibility for parcels which are lost or stolen. The prize will be delivered within 2 weeks of the winner being announced, by Australia Post.
4.4 The Promoter will make all reasonable efforts to deliver the prize to the address provided by the winning competition entrant. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.
4.5 If the winner of the prize is under the age of 18, they will forfeit the prize and the prize will be reallocated to the runner up.
4.6 The prize is as stated and is non-transferable or exchangeable. No cash alternatives will be offered. If, due to circumstances beyond the Promoter’s control, the Promoter is unable to provide the stated prize, the Promoter reserves the right to award an alternative prize of equal or greater value.
5. HOW TO WIN
5.1 The entrant who reports the highest number of verified missing and incorrect bottle shop listings within Australia during the competition period will win the new iPad. A web page with an entrant leader board will be available to view during the competition period; leader board information will also be available on the Booze Buddy Facebook Fan Page during the competition period.
5.2 Entrants must allow up to 48 hours before a verified listing will be added to their tally.
5.3 In the instance that there is a tie at the conclusion of the competition period, the competition will be extended to sudden death, whereby the winner will be the first of the tied entrants to report a verified incorrect or missing bottle shop.
5.4 There will be one winner from the total pool of entries received, judged on the criteria set out for the competition: Report the highest number of verified incorrect or missing bottle shop listings within Australia using the Booze Buddy iPhone Application and bbapp.com.au website. Each entrant who has entered the competition over the duration of the competition and has registered all details required (“Qualifying Entrant”) will be eligible.
5.5 The winner will be notified by email on Tuesday 31st December 2012. The winner will also be announced publicly through our Twitter and other social media networks.
5.6 The promoter’s decision is final and the promoter will not enter into any correspondence regarding the result.
5.7 The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, acts of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.
6.2 Booze Buddy (WayNorth Pty. Ltd.) and affiliates and associated agencies and companies will take no responsibility for damage or loss to the prize in transit, or late, lost or misdirected mail.
6.3 Booze Buddy (WayNorth Pty. Ltd.) and affiliates will not be liable for any misadventure, accident, injury, loss or claim that may occur:
a) during the competition
b) whilst undertaking any activity in or connected with their entries into the competition
c) in the participation in any prize
d) as a consequence of late, lost or misdirected mail
e) in relation to failure of an entry to be received by the promoter on account of technical problems or traffic congestion
g) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant’s or any other person’s computer software related to or resulting from participation in this competition
6.4 Booze Buddy (WayNorth Pty. Ltd.) assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.5 If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.
7. PRIVACY STATEMENT
7.1 We will only use and store your personal information for the purposes disclosed to you, including sharing it with any other organisation that helps us provide goods or services to you (e.g. Delivering your prize to you). You will only receive marketing material from us if you check the appropriate boxe(s) on your entry form.
