Prize Details
Winner receives $1000 credit on their Australian or New Zealand Club Plus card to spend how they wish in any Supercheap Auto store. Winners who are not Club Plus members will also receive a free membership.
Contest Instructions
Simply submit a photo of your sweet sofa set up where you’ll be watching the 2012 Supercheap Auto Bathurst 1000, and you could be this year’s Supercheap Auto Bathurst 1000’ King of the Lounge!
We’ll get V8 Supercar driver Russell Ingall to pick the winner after the race.

PROMOTION

TERMS AND CONDITIONS

1.   Information on how to enter and the prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.   Entry is only open to Australian and New Zealand residents aged 18 years and over who fulfill the entry requirements and these Terms and Conditions (the “Entrant”).

3.   Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, former spouse, de-facto spouse, former de-factor spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4.   The promotion commences at 8:00am (AEST) 05/10/2012 and closes at 5.30pm (AEDST) on 07/10/2012 (“Promotional Period”).

5.   To enter, an Entrant must submit a picture of their room in which they are watching the Supercheap Auto Bathurst 1000 into the competition app hosted on the Supercheap Auto Facebook page during the Promotional Period.

6.   The Promoter reserves the right, at any time, to verify the validity of entries, and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7.   Incomplete, indecipherable or indecent entries will be deemed invalid. Competition images may be removed or reposted by the Promoter.

8.   Copyright

8.1.   Generally under copyright laws the owner of the copyright in images or photographs is the person who created the images or took the photographs. You represent and warrant to the Promoter that you are the owner of the copyright or have the express permission of the owner of the copyright in the images or photographs which you submit to the Promoter.
8.2.   The Promoter claims no ownership rights in any photographs and materials you submit to the Promoter.
8.3.   You grant to the Promoter and to its third party service providers, a perpetual, worldwide, non-exclusive, transferable, royalty-free, copyright licence to copy, reproduce, display, modify, adapt or alter, transmit, and distribute your photographs and materials.
8.4.   You will not make any claim against the Promoter or its third party service suppliers, for any use, publication or copying of the photographs and materials you have submitted to the Promoter and you waive all rights of action or other claims you may have now or in the future against the Promoter in respect of any such use, publication or copying.

9.   Your Infringement of Copyright
9.1.   The Promoter respects the intellectual property rights of others. If the Promoter receives a complaint alleging that you have infringed copyright, the Promoter will refer the complaint to you for resolution. It will be your responsibility to resolve any such complaint. Should you not resolve the complaint satisfactorily and advise the Promoter, in writing, of the resolution within seven (7) days of the date we refer the complaint to you (the “Referral Date”), the Promoter reserve the right, in its absolute discretion, to disqualify your entry.
9.2.   If any person makes any claim against the Promoter or our third party service suppliers, claiming that any of the photographs and materials you submit to the Promoter, or any use of them, infringes any copyright, or other intellectual property or moral right of any person, company or entity, you indemnify the Promoter and its third party service providers against all costs, claims, loss, damage, demands and expenses (including all reasonable legal costs, fees and expenses) arising directly or indirectly out of such claim.

10.   One (1) entry per person / per unique email address permitted, subject to the following:
10.1.   each entry must be submitted separately and in accordance with entry requirements and these Terms and Conditions;
10.2.   only one (1) unique email per entry is permitted;
10.3.   the same email address cannot be used more than once; and
10.4.   any entry from the same email address will be deemed invalid.

11.   If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant for the purposes of this promotion.

12.   The Promoter’s decision is final and no correspondence will be entered into.

13.   King of the Lounge Bathurst Facebook Competition Prize:
13.1.   There will be a total of One (1) x Supercheap Auto Club Plus Card with $1,000 AUS or NZD of credit given to the winner. The winner agrees to:
13.1.1.   the terms and conditions of the Supercheap Auto Club Plus Card; http://media.supercheapauto.com.au/sca/files/user/clubplus/supercheap-auto-club-plus-terms-conditions.pdf
13.1.2.   enter their details into a database which will be assigned to the Supercheap Auto Club Plus Card. If the winner is already a Supercheap Auto Club Plus member, $1000 AUS or NZD will be assigned to their Supercheap Auto Club Plus card.
13.1.3.   if the winner does not agree to join the Supercheap Auto Club Plus, then the prize is forfeited.

13.2.   If the winner is a New Zealand resident, a total of $1,000 NZD will be credited to a Supercheap Auto (NZ) Club Plus card. If the winner is an Australian resident, a total of $1,000 AUS will be credited to a Supercheap Auto Club Plus card.

14.   The King of the Lounge Facebook competition winner will be selected by Supercheap Auto V8 Racecar driver Russell Ingall and announced on the Supercheap Auto Facebook page at circa 7pm, 7th October 2012.

15.   If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

16.   By accepting the prize, the winning entrant agrees to participate in and cooperate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned.

17.   Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between the date of printing and the ultimate prize wins date.

18.   Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

19.   Subject to the unclaimed prize draw clause, if for any reason the winning entrant does not redeem a prize (or part of a prize), and then the prize (or part of that prize) will be forfeited.

20.   Total prize pool value is either $1000 AUS or $1000 NZD as detailed in clause 13.

21.   Prizes are not transferable or exchangeable and cannot be taken as cash.

22.   In addition to clause 8, Entrants consent to the Promoter using their name, likeness and/or image in the event they are the winning entrant (including photograph, film and/or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

23.   If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

23.1.   to disqualify any Entrant; and/or
23.2.   subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

24.   The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.

25.   Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will not be honoured and subject to clauses 26 and 27, the Promoter shall not be liable to any losses and/or damages in excess of the advertised prize pool amount.

26.   Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

27.   Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

27.1.   any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
27.2.   any theft, unauthorised access or third party interference;
27.3.   any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
27.4.   any tax liability incurred by a winning entrant; or (e) use/taking of a prize.

28.   As a condition of accepting a prize, each Entrant must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

29.   The Promoter collects personal information of Entrants in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant and/or its authorized representative. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
