TERMS AND CONDITIONS

The Promotion
The promotion at Kingston @ Cockburn Central (Promotion) commences at 9:00am 15th September 2012 and concludes at 5.00pm on 5th November 2012 (Promotion Period). The Seller may extend or finish the Promotion Period in its sole discretion once 10 accepted sales are exchanged and unconditional.

Eligible Lot
The Promotion applies to selected lots of the Kingston development (Eligible Lots). The Seller reserves the right to withdraw any Eligible Lot from sale at any time during the Promotion Period. The Promotion is not valid in conjunction with any other offer or promotion by the Seller.

There will be more than 10 Eligible Lots eligible for the Promotion at the outset of the Promotion Period, however the Promotion will close once 10 accepted sales are exchanged and unconditional.

Promotion
The Promotion entitles one purchaser that has purchased a property of an Eligible Lot (the purchaser must be unconditional when the prize is drawn) within the promotion period to receive a cheque 21 days after settlement of the property in the sum of an amount equal to the Purchase Price multiplied by the Set Interest Rate.

The actual sum payable as the prize will be based on the Purchase Price under the Contract. As an example, where a buyer purchases an Eligible Lot during the Promotion Period for $440,000.00, the buyer will be entitled to a sum of $27,632 calculated as follows:

Purchase Price x Set Interest Rate = $440,000.00 x 0.0628

Promotion Benefit    = $27,632.00 (including GST)

Eligibility

4.1 To be eligible to receive the payment, the Buyer must:

(a) enter into a contract of sale with the Seller to purchase an Eligible Lot during the Promotion Period (Contract);

(b)   pay the deposit payable under the Contract on the date for payment under the Contract; and

(c)   effect settlement of the Contract (Settlement) on the settlement date specified in the Contract (Settlement Date) and otherwise comply with all obligations under the Contract.
(together, the Eligibility Criteria).

4.2   Subject to the Buyer satisfying the Eligibility Criteria, the Seller will pay the Buyer the Promotion Benefit by cheque within 21 days after the date of Settlement.

General Terms and Conditions
5.1   The Promotion applies to any Contract entered into during the Promotion Period for any one (1) of the Eligible Lots.

5.2   The Buyer will not be entitled to the sum if Settlement does not occur on the settlement date or due to the default of the Buyer.

5.3 The Promotion is subject to any other terms and conditions set out in the Contract.

5.4 The Set Interest Rate is based on a notional interest rate of 6.28%.

5.5 The Buyer acknowledges that:

(a) the sum does not equate to the effective interest payable by the Buyer on any mortgage taken in respect of the Property; and

(b) this is not an offer of finance and is subject to the terms and conditions contained in this annexure.

5.6 The Promotion cannot be used in conjunction with any other promotion or offer relating to an Eligible Lot, unless otherwise agreed by the Seller.

5.7 The Promotion may be withdrawn, or these terms and conditions amended with approval from the Western Australian Gaming and Wagering Commission at any time during the Promotion Period with or without reference to the Buyer.

5.8   The Promotion will be drawn at 10am on 7th November 2012 at the offices of Australand Holdings Limited, Level 2, 115 Cambridge Street, West Leederville WA 6007.

5.9 Any monetary values expressed in this Annexure are inclusive of GST.

Definitions
In these terms and conditions:

Buyer means the person name as 'the Buyer' in the Contract to which these terms and conditions are annexed.

Contract Date means the date of the Contract to which these terms and conditions are annexed.

Sum means the Purchase Price multiplied by the Set Interest Rate six point two eight percent (6.28%).

Promotion Benefit means the benefit to be paid in accordance with these terms and conditions.

Promotion Period means the period commencing at 9:00am 15th September 2012 and concludes at 5:00pm on 5th November 2012.

Property means the property the subject of the Contract of Sale to which these terms and conditions are annexed.

Purchase Price means the Contract of Price in respect of the eligible lots.

Seller means Australand Holdings Ltd ABN 008 443 696.
