TASTE.COM.AU PROMOTIONAL TERMS & CONDITIONS
1. Information on how to enter forms part of these conditions. Entry into the competition constitutes acceptance of these terms and conditions.
2. Entry is only open to
Australian residents 18 years and over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. You must be a member of Taste.com.au to enter.
3. The promotion commences at 9.00AM AEST on 01 November 2012 and
closes at 12.00AM AEST on 30 November 2012 (Promotion Period).
4. To enter, consumers must be a member of Taste.com.au and go online to
www.taste.com.au and answer the question:
"what is your favourite Malaysian dish and why?”5. There will be one major prize winner and one runner up prize winner chosen by a judging panel based on the creativity of the answers. The judging will take place on 05/12/12. The winners will be notified by phone or email. The winner’s names will be published on Taste.com.au from 10/12/12.

There is one prize of seven nights’ accommodation in a one bedroom Deluxe Room for two people at JW Marriott Kuala Lumpur, transfers, a custom half day tour for two with Food Tour Malaysia which includes hotel pick up, meals and beverages and a personal guide, plus return economy airfares for two from any Australian capital city to Kuala Lumpur according to availability and inclusive of departure taxes. The total prize is worth up to $7,600 and is subject to the following conditions: • The prize is valid from 15 December 2012 until 30 May 2013 and is not extendable.
• The prize is non-transferable and cannot be exchangeable for cash.
• Airfare transfers are included.
• The accommodation is subject to availability and black-out/close-out periods may apply.
• The accommodation must be taken in consecutive nights’ stay.
• The hotel voucher must be presented upon check-in or placing the order.
• The hotel voucher is only redeemable against the offer described above to the net amount of $3360. No cash refund will be made if the full amount is not utilised.
• Reservations must be made at least 72 hours prior to arrival.
• The Winner and their travelling companion are responsible for all expenses other than that specified, including but not limited to spending money, transfers, extra meals, drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, insurance, energy surcharges, gratuities, services charges, passports, travel insurance, excess baggage and all other ancillary costs. Travel insurance is the responsibility of the Winner and their travelling companion. The Promoter and the Sponsor are not liable for any costs incurred if the Winner or their travelling companions travel without insurance. A credit card imprint or cash deposit may be required from the Winner at check-in to the hotel, for all incidental charges.
• Obtaining all travel documents such as passports, visas etc that are required for travel to destinations forming part of the Prize is the responsibility of the Winner and their travelling companion.
• Flights leave from the Winner’s nearest capital city. The Winner and their travelling companion must travel on the same flight. Travel arrangements to and from the Winner’s nearest capital city airport (Sydney, Melbourne, Brisbane, Hobart, Darwin, Adelaide and Perth) do not form part of the prize and are the responsibility of the Winner. If the Winner is from ACT, connecting flights from the capital cities in these states to the nearest flight departure capital city will be included in the prize package for the Winner
and travelling companion where required.
7. There is one runner up prize of Thermomix TM31. The total prize (RRP AU $1,939) and is subject to the following conditions:
• Employees (and their immediate families) of Thermomix and the following groups, Independent Consultants, Group Leaders, Branch Managers and Area Managers, and agencies associated with those groups, are ineligible to enter. Immediate or extended family members of those groups are authorised to participate.
• The winner will be awarded a Thermomix TM31 (RRP AU $1,939).
• The maximum total retail value of the prize pool is AU $1,939.
• It is a condition of entry that the winner must receive the prize by personal delivery by a Thermomix Consultant so that use of the product can be demonstrated.
• The Promoter collects entrant’s personal information in order to conduct the promotion, only when they have opted in to receive further information from Thermomix. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use entrant’s names, addresses, telephone numbers and the winner’s name and address and photographs in any media for future promotional, marketing and publicity purposes, in any media worldwide in perpetuity without notice, any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.
8. The maximum total retail value of the prize pool is $9,539. Prize values are based upon recommended retail prices and are correct as of 11 October 2012. The Prize value may vary depending on point of departure and dates of travel. Taste.com.au accepts no responsibility for any variation of the prizes or any change in Prize value between now and the ultimate travel date.
9. The judges' decision is final and no correspondence will be entered into. As stated above the Prize is not exchangeable, transferable or redeemable for cash.
10. Taste.com.au accepts no responsibility for any variation in the value or make-up of the prizes or any event that occurs that is beyond the Promoter's control. The winner also acknowledges that the prizes may be subject to additional terms and conditions imposed by third parties. Taste.com.au does not accept any responsibility and is not liable for additional conditions imposed by third party nor for the breach of those conditions by any person.
11. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions.
12. The Promoter reserves the right to rejudge in the event of any entrant being unable to satisfy these competition conditions or forfeiting or not claiming a prize. If any prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter reserves the right to award the prize to the entry judged as the next most creative entry received. The winner’s names will be published on Taste.com.au from 10/12/12.
13. All entries become the property of Taste.com.au. All entries will be entered into a database and the Taste.com.au may use the entrants' names, addresses, telephone numbers and the winners' names and addresses and photographs for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. Entrants will not be contacted by the third party.
14. Taste.com.au shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law. Taste.com.au shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the internet or telecommunications services.
15. If for any reason this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to disqualify any individual who tampers with the entry process.
16. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to state legislation.
