Terms and Conditions WIN A Car Giveaway
1. Definitions
1.1 AEST means Australian Eastern Standard Time.
1.2 Immediate Family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
1.3 Promoter means Get Wines Direct (ABN 41 066 329 203) of PO BOX 61, COTTON TREE QLD 4558
1.4 Promotion means - Get Wines Direct Win A Car Giveaway.
1.5 Promotional Period means the period starting on 01 October 2012 at 9:00am AEST and ending on 31st January 2013 at 11:59pm AEST.
2. Who May Enter
2.1 Entry is open to Australian residents only aged eighteen (18) years or over who hold a current valid Australian driver’s licence.
2.2 Employees of the Promoter and their Immediate Families as well as agencies associated with this promotion are ineligible to enter.
3. Requirements for Entrants
3.1 Participation in this promotion is deemed acceptance of these Terms and Conditions.
3.2 It is compulsory for entrants to provide their full name and email address to enter the promotion.
4. Validity
4.1 To enter, entrants must, during the Promotional Period:
(a) Enter directly via the entry form located at
www.getwinesdirect.com/winacarpromotion (b) Complete your full name and valid e-mail address as prompted on the entry form.
4.2 One (1) entry permitted per person.
4.3 Incomplete / unsubscribed and duplicate entries will be deemed invalid.
4.4 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s sole and unfettered discretion.

5.2 The total prize pool will be up to “Drive Away” price $49,900, which includes the Enhancement Pack (moonroof). This prize must be collected from 157-161 Burnley Street, RICHMOND VIC 3121.
5.3 No prize is transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
5.4 If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
6. Details of Draw
6.1 The winner of the prize will be randomly drawn from eligible entries as described in condition 4 (“Winner”).
6.2 The Draw will take place at the Promoter’s office located at 48 School Road, Maroochydore, Queensland on 6th February 2013 at 1.00pm AEST.
6.3 The winner(s) will be notified on 6th February 2013 following the Draw on the Promoter’s:
(a) Website:
www.getwinesdirect.com\legals.
(b) Facebook feed.
(c) National Press.
(d) Email notification.
6.4 In addition to the Winners being announced in accordance with condition 6.3, the Winner will also be contacted by the Promoter via email following the draw on 6th February 2013.
6.5 A draw for any unclaimed prize will take place at the Promoters’ office 4 months after the date of the initial draw. The winner will be notified in the same manner as condition 6.3 and 6.4 on the applicable date.
7. Method of Claiming Prize
7.1 The respective Winner is not required to be on-site at the draw. Once the Winner is announced, the Promoter will contact the Winner in the manner set out in condition 6.3 and 6.4 to make arrangements for claiming the prize.
7.2 If for any reason a winner does not take a prize at the time stipulated by the Promoter, then the prize will be forfeited and will not be redeemable for cash.
8. Database
8.1 All entries will be entered into a database for future advertising and marketing from Get Wines Direct and it’s sponsorship partners.
8.2 The Promoter may use entrants’ names and addresses for future marketing and promotional purposes unless notified otherwise in writing by the entrant.
8.3 Subject to clause 8.4, the Promoter will classify all entries as confidential and will not disclose any entrants’ details to any other parties, and by entering the competition the entrants to accept email communications from the Promoter until the entrant opts out to receive the email communications from the Promoter.
8.4 The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information.
9. General
9.1 The use of any automated entry sofware or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
9.2 All entries become the property of the Promoter.
9.3 The Promoter reserves the right to alter or amend these Terms and Conditions, and conditions of operation of the Promotion, subject to the approval of the gaming authorities in each State or Territory, where required.
9.4 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by the winner or any entrant; or
(f) use of the prize.
