TERMS AND CONDITIONS

1. Instructions on how to claim and the gifts form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.

2. Claims are only open to Australian residents.

3. Claimants under 18 years old must have parental/guardian approval to claim and further, the parent/guardian of the claimant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor submitting a claim in this promotion.

4. Employees (and their immediate families) of the Promoter, Coles stores and agencies associated with this promotion are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

5. Promotion opens for purchases at 12.00am AEDST on 13 March 2013 and closes at 11.59pm AEST on 9 April 2013 (“Purchase Period”). Claims open and close for each week on the dates and time specified in the table below (“Claim Period”):

6. To be eligible to claim, individuals must purchase any two (2) Libra pads products in one transaction from any Coles store within Australia during the Purchase Period (“Qualifying Purchase”);

7. To claim, individuals must then complete the following steps during the Claim Period:

(a) visit www.libramagpromo.com.au andfollow the prompts;(b) input the requested details including the barcode number of each of the two (2) Libra pads products purchased and the full Coles receipt number for the Qualifying Purchase; and

(c) submit the fully completed claim form.

The claim form will be disabled, and no details may be submitted, once 2,500 claims for any given week (i.e. between Wednesday and the following Tuesday) of the Purchase Period have been received. The claim form will then be enabled once again at 12.00am AEDST/AEST on the Wednesday of the subsequent week of the Purchase Period, if any.

8. Claimants must retain their original purchase receipt(s) for all claims as proof of purchase. Failure to produce the proof of purchase for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of a claimant’s claims and forfeiture of any right to a gift. Purchase receipt(s) must clearly specify Coles as the store of purchase and that the purchase was made during the Purchase Period but prior to submission of the relevant claim.

9. Where the Promoter requests proof of purchase, the claimant will have until last mail received on Tuesday 16 April 2013 to send in a printed copy of their completed claim form and original purchase receipt. In the event that proof of purchase is not provided to the Promoter by this date, the claimant will forfeit their right to a gift.

10. Incomplete or indecipherable claims will be deemed invalid.

11. Multiple claims permitted, subject to the following: (a) only one claim permitted per Qualifying Purchase; (b) only one claim permitted per transaction (regardless of the number of Libra pad products above two purchased within the transaction); (c) each claim must be submitted separately and in accordance with claim requirements; and (c) a maximum of two (2) claims permitted per household.

12. The first 2,500 valid claims received each week of the Purchase Period (4 weeks in total) will each win their choice of one (1) of the following four (4) magazine subscription gifts:

    * a three (3) month subscription for Good Health magazine valued at $20.85; OR
    * a three (3) month subscription for Shop Til You Drop magazine valued at $22.80; OR

    * a three (3) month subscription for Australian House & Garden magazine valued at $22.50; OR
    * a three (3) month subscription for Cosmopolitan magazine valued at $23.40.

13. Total gift pool value is $234,000.

14. Successful claimants will either receive a redemption code immediately on screen after submission of the claim form or will receive the redemption code via email no later than Tuesday 23 April 2013. Claimants who receive a redemption code immediately after submission of the claim form, will then be automatically transferred to a promotional page where they must input the redemption code, select a magazine title from the choice of four available (as listed above) and submit. Successful claimants who receive a redemption code via email will be provided with a link to the same redemption promotional page mentioned above and must follow the same prompts to redeem a magazine subscription. Once a successful claimant submits their magazine selection and redemption code, they will be sent their nominated magazine subscription to the address provided at the time of submitting their initial claim. Successful claimants who receive the redemption code immediately on screen after submission of their claim form will not be sent the redemption code via email. It is up to these claimants to record the redemption code at the time it is provided, as this will not be re-sent to them.

15. The magazine subscription gift may only be redeemed with the redemption code. Failure to redeem the magazine subscription (using the redemption code provided) by 11.59pm AEST on Tuesday 30 April 2013 will result in forfeiture of any right to a prize.

16. Successful claimants must allow up to 6 to 8 weeks for the delivery of the first issue of the selected magazine, from the end of the Claim Period. Free gifts and tip-ons that may be available with retail copies are not provided with subscriber copies. The offer for any participating title in this promotion is not valid in conjunction with any other subscription offer/promotion for that magazine title. Existing subscribers to any of these publications will have the bonus period added to the end of the existing subscription term. Bauer Media will send a letter of notification prior to the successful claimant’s free subscription period ending. In the event that a successful claimant’s nominated magazine ceases publication, the successful claimant’s subscription will automatically be transferred to a Bauer Media title of similar interest.

17. The Promoter’s decision is final and no correspondence will be entered into.

18. The gift is subject to the standard terms and conditions of individual gift and service providers.

19. If any gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the gift with a gift to the equal value and/or specification, subject to any written directions from a regulatory authority.

20. If for any reason a winner does not take/redeem a prize by the time stipulated by the Promoter, then the prize will be forfeited.

21. Gifts are not transferable or exchangeable and cannot be taken as cash.

22. Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

24. Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used.

25. The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that claimant invalid.

26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a gift.

28. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and as required, to Australian regulatory authorities. Claim is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. Claimants should direct any request to access, update or correct information to the Promoter. All claims become the property of the Promoter.
