Visa Entertainment Empire Brisbane Sign-up Promotion Terms and Conditions:

Information on how to enter the Promotion and prizes forms part of these Terms and Conditions. Entries not made in accordance with these Terms and Conditions will be disqualified. Participation in this Promotion is deemed acceptance of these Terms and Conditions. Capitalised terms have the meanings given in these Terms and Conditions unless otherwise provided or the context otherwise requires.
Section 1: Promotion
1. Promotion: Go to www.visaentertainment.com.au (Website) during the Promotion Period (as set out below) and subscribe to receive email updates in order to go in the draw for a chance to win a double pass to see Empire plus a prize pack per ticket with a meet & greet of selected performers on Sunday 9 June in Brisbane only. (Date of event as set out in clause 11 below).

3. Promotion Period: The Promotion will commence at 9:00am (AEST) on Friday 3 May 2013 and will close at 5:00pm (AEST) on Friday 31 May 2013.
Section 2: Eligibility
4. Eligibility: The Promotion is only open to Eligible Entrants. An “Eligible Entrant” is an individual who:
(i) is above 18 years of age; and
(ii) is a Queensland resident; and
(iii) is a current Visa, debit, credit or pre-paid cardholder (Visa Card Holder);
(iv) subscribes to receive email updates at the Website during the Promotion Period or
verifies his/her subscription membership in accordance with clause 8; and
(v) is eligible to take the prize when required (as provided by clause 14); and
(vi) is not otherwise ineligible under clauses 5, 6 or 7 below.
5. Non-Eligibility: Individuals are not eligible to enter the Promotion or win any prize if they are a director, manager or employee of the Promoter, or an agency of the Promoter directly associated with the Promotion, or if they are an immediate family member of such director, manager or employee. Immediate family member includes, without limitation, any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
6. Incorrect contact details: In addition to any other eligibility requirement in these Terms and Conditions, if any contact details provided to the Visa Entertainment email update service via the Website are incorrect, such subscription will not be eligible to qualify for entry to the Promotion. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole and absolute discretion, to determine the identity of the Eligible Entrant.
7. Verification: The Promoter reserves the right, at any time, to verify the validity of entries and the validity of entrants to qualify as Eligible Entrants (including the right to confirm and verify an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Section 3: Entry to the Promotion
8. Eligible Entrants who subscribe to the Visa Entertainment email update service online at the Website during the Promotion Period will automatically receive one (1) entry to the Promotion. Only one (1) entry is permitted per Eligible Entrant and for any entry to be valid, the Eligible Entrant must not cancel or terminate his/her Visa account or subscription to the Visa Entertainment email update service during the Promotion Period.
Section 4: Draw
9. Draws:
There is five (5) Prize Packages to be won for Empire in Brisbane. The first five valid entries drawn will win the Prize Package. The winners will be selected at random from a computer generated listing of entries, which comply with Section 2 and 3 of these Terms and Conditions over the Promotion Period.
All draws will be conducted at 12noon (AEST) on Monday 3 June 2013 by Visa (Australia) at AMP Building, Level 42 50 Bridge Street Sydney.
The Prize Package draw and announcement of the winner will be scrutinised by an independent person. The Promoter’s decision is final and no correspondence will be entered into.
Section 5: Prize
10. Prize Value: The Prize Package consists of two (2) VIP Ringside tickets, two (2) meet & greets, two (2) Empire mugs and two (2) official programs is valued at up to AUD$398.00 each. (Inclusive of taxes). Total prize pool value for the promotion is valued up to AUD$1790
11. Prize
(a) There are five (5) Prize Packages in total. The Prize Package consists of two (2) VIP Ringside tickets;
two (2) Empire mugs and two (2) official programs plus a meet and greet with selected performers*
after the show.
(b) The prize must be taken on the date nominated by the Promoter Sunday 9 June for the 7.00pm
performance in Brisbane Australia, otherwise the entire prize is forfeited. The winner and their companion (if any) must make their own way to and from the Empire Show location nominated by the Promoter. All additional costs not expressly stated, but which may be incurred in acceptance and use of the prize, are the responsibility of the winner and their companion (if any). Such additional costs include, but are not limited to, travel and/or transport to and from the location of the Empire show, airfares, accommodation, transfers, meals and beverages (other than as included in the prize), and spending money. All components of the prize must be taken together and when offered or are forfeited.
(c) Totalmaximumprizepoolvalueisupto$1790.00.Theprizeisnottransferableorexchangeableand cannot be taken as cash. The prize must be taken as offered and cannot be varied.
(d) The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the scheduled event is relocated, postponed, rescheduled or cancelled for any reason whatsoever.
(e) The Promoter accepts no responsibility for any loss incurred in the event that the appearance of selected Empire performers is cancelled or unable to occur for any reason whatsoever. Performer appearances are determined by production schedules and other various factors determined at the complete discretion of the producers of his tour. No correspondence with be entered into.
12. Prize Conditions: The Prize Package is subject to the following conditions:

(a) No exchange or transfer of Prize: The Prize package cannot be exchanged or transferred to any person or redeemed for cash. If for any reason, the Prize Package winner cannot take the prize or any component of the prize, then the prize or prize component will be forfeited and no compensation will be paid in lieu.
(b) Ancillary Costs: Accommodation, flights, spending money, meals, beverages, insurance, passports, visas, vaccinations, transport to and from destinations, items of a personal nature, in- room charges, service charges and all other ancillary costs are not included in the Prize Package unless specified in these Terms and Conditions and are the responsibility of the prize winner.
(c) TravelConditions:Frequentflyerpointswillnotformpartoftheprize.Individualcomponentsof the Prize Package are subject to the terms and conditions of the Prize Package component providers (including, without limitation, relevant airline companies, venue operators and travel companies). The Winner’s companion must be 18 years of age or older.
(d) Taxes: If the prize or receipt of it incurs a tax liability, the prizewinner is liable for payment of such tax.
(e) Prize Availability: In the event that the Prize Winner’s prize package is unavailable for any reason, the Promoter reserves the right to substitute the Prize Package with the alternative option prize package. In the event the Prize package or a component of the Prize is unavailable for any reason, at any time, the Promoter reserves the right to substitute the prize or that prize component with another prize of equal value, subject to the written direction of any relevant regulatory authority, and the prize winner will be notified accordingly.
Section 6: Prize Winner
13. Contact: The Promoter will contact each prize winner by email and by telephone (if a telephone number is provided at the time of entry) by 12noon AEST Tuesday 4 June 2013 to confirm his/her eligibility under these Terms and Conditions and to confirm whether the prize winner wishes to claim his/her prize. The name of the Prizewinner will also be published on the Visa Entertainment website competition page.
14. Claim of Prize: If the Prizewinner wishes to claim his/her prize, he/she must confirm this fact and his/her eligibility to win under these Terms and Conditions by 10:00am AEST Wednesday 5 June 2013. If the winner fails to claim his/her prize by the deadline, the winner will be deemed to have forfeited the prize.
If the winner and/or their companion (if any) are unable to use any element of the prize as stated for whatever reason, including refusal of entry or ejection from the Empire Show or failure to participate in the prize in the manner required, as stated in this condition and in the reasonable opinion of the Promoter, their entry and the balance of the prize will be forfeited with no compensation payable.
15. Redraw: In the event that the Prize winner forfeits the Prize or the Prize remains unclaimed by 10.00am AEST Wednesday 5 June 2013, the Promoter will conduct a redraw, subject to any directions of a relevant regulatory authority, following the same procedure and format as set out in clause 9. The redraw will take place at 12noon AEST Wednesday 5 June 2013 at the same place as the original draw described above. The Promoter will draw a winner as well as a list of additional entrants’ names during the conduct of the redraw.
The Promoter will contact the Prizewinner from the redraw by email and by telephone (if provided at the time of entry) by 5.00pm Wednesday 5 June 2013 to confirm his/her eligibility under these Terms and Conditions and to confirm whether the prizewinner wishes to claim his/her prize. If the Prizewinner from the redraw wishes to claim his/her prize, he/she must confirm this fact and his/her eligibility to win under these Terms and Conditions by 10:00am AEST Thursday 6 June 2013. In the event that this redrawn Prize winner is not eligible or the Prize remains unclaimed, the Promoter will contact the additional entrants from the list of additional entrants (starting with the first additional entrant drawn) and the first
additional entrant contacted by the Promoter who confirms his/her eligibility to accept the Prize will be deemed to be the winner of the Prize. If the Prize is redrawn, the name of the Prizewinner will also be published on the Visa Entertainment website competition page, the Visa Entertainment Facebook page.
16. Winner Publicity: In accepting a prize, a prizewinner agrees to participate in any publicity arrangements made by or on the behalf of the Promoter. A prizewinner further acknowledges and agrees that the Promoter has the right to publicise his/her name, the State or Territory in which the winner ordinarily resides, photograph, likeness and/or voice in any language and in any media (whether now known or later devised) throughout the world in perpetuity without restriction in respect of this Promotion and any products manufactured, distributed and/or supplied by the Promoter, without any payment being made to them.
Section 7: General Conditions
17. Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or misdirected communications.
18. Release: To the fullest extent permissible by law, each entrant in the Promotion including without limitation the Eligible Entrants and the prize winner, releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such entrant in connection with the prize or their participation in the Promotion. The Promoter, its related bodies corporate, its or their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained in connection with this Promotion, the implementation of this Promotion, or the use of any prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website (including the Website), or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to an entrant’s or any other person’s computer related to or resulting from participation in or down-loading any materials in this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
19. Force Majeure: The Promoter will not be responsible for any act, omission, failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, which are not reasonably within the control of the Promoter. In addition if this Promotion is otherwise interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, subject to State legislation and written regulatory directions the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or disqualify any entrant.
20. Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into.
21. Internet Costs: Any cost associated with accessing the Website is the entrant’s responsibility and is dependent on the Internet service provider used.
22. Release: As a condition of accepting a prize, the winner (and his/her companion, if applicable) may be required to sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
23. Privacy Notice: The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise
advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
