1. Information on how to enter the promotion forms part of these terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.
2. The promoter is Qantas Airways Limited (ABN 16 009 661 901) of 10 Bourke Road, Mascot, NSW 2020 (telephone number 0295784184) (Promoter).
3. The promotion commences at 12.01am (AEST) on 16 June 2013 and closes at 11.59pm (AEST) on 31 August 2013 (Promotion Period).
4. Entry into the promotion is open only to Australian and New Zealand residents, excluding a) directors, management, agents, employees (and their immediate families) of the Promoter or Mike Da Silva and Associates (Aust) Pty Ltd ABN 50 003 894 022 (MDSA) and each of their related bodies corporate and b) registered travel companions of employees of the Promoter and its related bodies corporate (Eligible Entrants). If an entrant is under 18 years of age they must first obtain their parent or guardian's permission prior to entering the promotion.
5. Eligible Entrants receive one entry into the competition when, during the Promotion Period, they complete the journey on www.qantas.com/foreveryjourney, submit their details via the registration form on this website and submit their entry. Multiple entries are not permitted.
6. The Promoter is not responsible for any technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
7. The draw will take place at 10:00am (AEST) on 09 September 2013 at the offices of MDSA at 15 Grosvenor Street, Neutral Bay, NSW 2089 and will be conducted by MDSA. The winner will be determined by an automated random draw of all eligible entries. The first five valid entries drawn will be the winners. The results of the draw are final and no correspondence will be entered into.
8. The winners will be notified in writing by email (using the details provided in each winner's Qantas Frequent Flyer online profile or details provided on the entry form at the time of entry) within 2 business days after the draw and their names will be published on qantas.com/foreveryjourneycomp on 09 September 2013 and in The Australian and New Zealand Herald newspapers on 16 September 2013. Each winner is responsible for ensuring that his/her contact details in his/her Qantas Frequent Flyer online profile, or his/her details provided via the entry form on www.qantas.com/foreveryjourney at the time of entry, are accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details.
9. If the prize winner is under the age of 18, before they can claim their prize they must obtain consent from their parent or legal guardian to do so, and must be accompanied during their prize travel by an Australian or New Zealand resident over the age of 18.
10. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant's identity, age and place of residence) and to disqualify any Eligible Entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. There will be 5 prizes. Each prize includes two (2) return economy class tickets, (one for the winner and one for their nominated travelling companion) from each winner's closest capital city airport (whether in Australia or New Zealand) to London (LHR), (flight associated taxes, fees and carrier charges are included) flying Qantas (with a QF flight number on the ticket). Each prize also includes $AUD5,000 of spending money, which will be provided by EFT or cheque depending on the winners' preference.
12. The total maximum value of each prize is $13,882.14 and the maximum value of the total prize pool is AU$69,410.70
based on the recommended retail value as at 22 May 2013. The Promoter accepts no responsibility for any variation in the value of the prizes.
13. All travel to be completed before 30 September 2014 otherwise the entire prize is forfeited. Bookings must be made at least 8 weeks in advance of departure, unless otherwise permitted by the Promoter in its discretion and subject to flight availability. However, each winner is encouraged to book as early as possible to increase the likelihood of availability of prize travel. Flight schedules and accommodation arrangements are subject to change without notice. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. There can be no changes made to travel arrangements once tickets have been issued.
14. Each winner is required to redeem both tickets (for the winner and their nominated travel companion) at the same time, for the same flights, traveling to and from the same locations. If the winner is unable to use both tickets at the same time they will forfeit the additional ticket and no compensation will be given in lieu.
15. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. The prize is not transferable to another person (unless agreed to by the Promoter) or exchangeable for other goods and services and cannot be redeemed for cash. Any element of a prize that is unused will be forfeited.
16. The prize includes GST and taxes included in the price of the ticket. Unless otherwise stated, the prize does not include accommodation, travel insurance, passports, visas, meals, taxes not included in the price of the ticket, ground transportation, other hotel incidentals, gratuities, merchandise or any other costs of a related, ancillary, personal or incidental nature not stated. Compliance with any health or other government requirements is the responsibility of each prize winner and their nominated travel companion. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. Prize travel is subject to Qantas' General Conditions of Carriage.
17. Prize travel is subject to availability at the time of booking. Flights are subject to capacity control and availability may be limited particularly around peak times such as school holidays. Winners and their travel companions will not accrue Qantas Points on the prize travel or any part of the prize. An upgrade cannot be purchased on airfares with cash or Qantas Points.
18. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. The Promoter reserves the right to refuse to allow a winner and/or a winner's nominated travel companions to take part in any or all aspects of a prize, if the Promoter determines, in its absolute discretion, that the person is not in the mental or physical condition necessary to be able to safely participate in the prize.
20. In the event of any entrant being unable to satisfy these terms and conditions or forfeiting or not claiming a prize by 12.00pm (AEST) on 9 December 2013, the Promoter may conduct such further draws on 16 December 2013 at the same time and place as the original draw as are necessary in order to distribute any prizes unclaimed by that date subject however to any written directions given under applicable law. A prize awarded in the unclaimed prize draw must be booked and travelled as set out in clause 14, otherwise the entire prize is forfeited. Any second chance draw prize winner will be notified in writing by email (using the details provided in the winner's Qantas Frequent Flyer online profile or provided via the entry form on www.qantas.com/foreveryjourney at the time of entry) within 2 business days following the draw and their name published at qantas.com/foreveryjourneycompetition and in The Australian and New Zealand Herald newspapers on 20 December 2013. Each winner is responsible for ensuring that his/her contact details in his/her Qantas Frequent Flyer online profile and provided via the entry form on www.qantas.com/foreveryjourney at the time of entry is accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details.
21. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
22. The exclusion of liability in clause 22 does not apply to limit or exclude liability:
a) for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; and the Promoter's Conditions of Carriage and general booking conditions (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions; or
b) to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).
23. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
24. Entry details remain the property of the Promoter. The name and photograph of winners may be used for promotional purposes by the Promoter, unless a winner otherwise notifies the Promoter at the time of accepting a prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes, (including to MDSA and any applicable statutory authorities). Without limiting the foregoing, entrants' personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy Statement, a copy of which is available at available at qantas.com/privacy.
25. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
