The Everyday Rewards Winter Vegetables promotion - Terms & Conditions of Entry


The Everyday Rewards Winter Vegetables promotion is a promotion conducted under the Other Benefits component of the Everyday Rewards Program.

1. Information on how to enter the Promotion and a description of the prizes that may be won in the Promotion form part of these Terms & Conditions of Entry. Participation in the Promotion constitutes acceptance of these Terms & Conditions of Entry. Entries not complying with these Terms & Conditions of Entry are ineligible and the Promoter reserves its absolute right to disqualify any Cardholder from the Promotion if any entries do not comply with these Terms & Conditions of Entry.

2. The Promotion is open to all Members who have registered for the Everyday Rewards Program. Entry into the Promotion is free.  Directors, management and employees of Salmat Digital Pty Ltd and its agencies directly associated with this Promotion are ineligible to enter.
These Terms & Conditions of Entry will be displayed at everydayrewards.com.au at the commencement of the Promotion.

3. Definitions within this Promotion:

Card means a Registered Everyday Rewards Card issued by the Promoter as part of the Everyday Rewards Program.
Cardholder means a person who holds an Everyday Rewards Card, and who is registered according to the Everyday Rewards Program database. .  
Participating Stores means any Woolworths store across Australia (excluding Tasmania) promoting the Everyday Rewards program.
Promotion means The Everyday Rewards Winter Vegetables promotion governed by these Terms & Conditions of Entry and conducted as a promotion under the Other Benefits component of the Everyday Rewards.
Promotional Period means 00.01 AEST on Monday 15th July to 23.59 AEST on Sunday 11th August 2013.
Promoter Woolworths Limited ABN 88 000 014 675 of 1 Woolworths Way, Bella Vista, NSW, 2153.
Registered means that all mandatory Cardholder information has been correctly completed in the legal name of the Cardholder, according to the Everyday Rewards database.

4. The Promotion commences at 00:01 AEST on Monday 15th July 2013 to 23:59 AEST on Sunday 11th August 2013. (“Promotional Period”)

5. To enter the Promotion purchase any three (3) different types of vegetables from the Fresh Produce department in one transaction at the Participating Stores and present your registered Everyday Rewards card prior to finalising the transaction. One entry will be recorded for every three different vegetable types from the Fresh Produce department purchased in one transaction. For example, the purchase of six different types of vegetables in one transaction will record two entries. Pre-packed mixed vegetable products, such as a soup starter pack, will only be counted as one vegetable type.

6. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

7. The prize winners will be determined by an automated random draw of all valid entries. The prize draw will take place at 10:00am AEST on Thursday 15th August 2013 at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney, NSW 2060.

8. The first valid entry from each state/territory listed below randomly drawn will be the winner of the major prize for that state/territory. The following one hundred (100) valid entries per state/territory randomly drawn will be the winners of the minor prizes. The major prize winners will be contacted by phone and writing within 2 days of the draw and the minor prize winners will be contacted in writing within 2 days of the draw. The major prize winners’ names and states will be published in The Australian newspaper and all winners will be listed on the Everyday Rewards website: www.everydayrewards.com.au on Thursday 22nd August 2013. If a winning entry is invalid, that entry will be discarded and the prize will be awarded by randomly drawing another entry in accordance with these Terms and Conditions of Entry.

9. There will be a total of five (5) major prizes, one in each of the following states/territories:

• New South Wales and Australian Capital Territory combined;
• Queensland;
• Victoria;
• South Australia and Northern Territory combined; and
• Western Australia.

Each major prize is $10,000 worth of Flight Centre Gift Cards, to be used as per the Fight Centre Gift Card terms and conditions available at http://www.flightcentre.com.au/travel-extras/gift-cards/gift-cards-conditions. The total major prize pool value is $50,000.

10. There will be a total of five hundred (500) minor prizes. One hundred (100) will be awarded in each of the states/territories listed above. Each prize is a $100 WISH Gift Card, to be used as per the WISH Gift Card terms and conditions available at www.everydaygiftcards.com.au. The total minor prize pool value is $50,000.
The total prize pool value is $100,000.

11. Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value. Prize is not exchangeable and cannot be taken as cash.

12. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent/guardian on their behalf.

13. If a winner does not claim their prize within 3 months from the date and time of determination of that winner, their entry will be deemed invalid and the Promoter may conduct such further draws at the same place as the original draws as are necessary, subject to any written directions given by regulatory authorities. The unclaimed prize draw will take place at 12:00 noon AEDST on Friday 15 November 2013 at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney NSW 2060. In the event of an unclaimed prize draw, the prize winners will be contacted by in writing within 2 days of the draw. All prize winners of any subsequent draw will have their names and state published in The Australian newspaper on Friday 22 November 2013.

14. The Promoter accepts no responsibility for any tax implications that may arise from winning of the prizes.  Independent financial advice should be sought.

15. Entries must be received within the entry period times and dates as outlined in clause 4. The time of entry will in each case be the time the entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.

16. Any entry that is made on behalf of an Entrant by a third party will be invalid.

17. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

18. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

19. If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.

20. Should an entrant’s contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

21. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

22. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

23. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any written directions given by regulatory authorities.

24. The Promoter reserves the right to disqualify all entries from any Cardholder who is in breach of these Conditions or the Terms  and Conditions of the Everyday Rewards Program, or who manipulates, seeks to manipulate or benefits from manipulating, the entry process or the Promotion.

25. The Promoter and its agencies and companies associated with this Promotion will not be liable for any loss (including but not  limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person's negligence) relating to the Promotion or the awarding or taking of the prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law). The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

26. Certain legislation may imply warranties or conditions or impose other obligations including statutory consumer guarantees which cannot be excluded, restricted or modified except to a limit extent. To the extent permitted by law, the Promoter excludes all guarantees, warranties, conditions or other terms that apply under or are implied by statute, common law or trade custom or usage.

27. If in the conduct of this Promotion the Promoter is liable for a breach of any guarantee, warranty, condition or other term that applies under the Australian Consumer Law or is implied by any other commonwealth, state or territory law that cannot be excluded, the promoter's liability under that legislation is limited, to the extent permitted by law, to the cost of replacement of any benefit or prize won.

28. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given by regulatory authorities.

Salmat Digital Pty Limited, on behalf of the Promoter, is collecting the entrant's personal information for the purpose of conducting and promoting this Promotion (including but not limited to determining and notifying winner). The Promoter may use any personal information that a Registered Cardholder has provided to it for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, first initial and state of residence. The Promoter may disclose the information for those purposes to its related bodies corporate, agencies and contractors (including call centres, advertising agencies and direct mail houses) which the Promoter engages for that purpose. The Promoter is bound by the National Privacy Principles contained in the Privacy Act 1988 (Cth). 32. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into.
