“SKYGATE ULTIMATE HOLIDAY” PROMOTION 2013 TERMS AND CONDITIONS
1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Queensland residents aged 18 years old or over. Employees and consultants (and their Immediate Families) of the Promoter and of participating agencies associated with this promotion are ineligible to enter. Immediate Family means any of the following: spouse, ex-spouse, de- facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. Promotion commences at 10.00am (Brisbane local time) on 02/12/13 and entries close at 4.00pm 06/01/2014 (Promotional Period).
4. To be eligible to enter, individuals must, during the Promotional Period, make a purchase from any participating retailer to the value of AU$20.00 or more in the Skygate Precinct (excluding any Ineligible Transaction) (Eligible Transaction). An Ineligible Transaction includes transactions from non- participating retailers and any transaction that includes tobacco or tobacco related items.
5. To enter, individuals must then, during the Promotional Period, complete the entry form, including providing a valid email address, at the official kiosks located near the entrance to Woolworths at The Village Markets and at the DFO food court (at Gate 2). The entrant must keep the receipt as proof of purchase.
6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. Incomplete or indecipherable entries will be deemed invalid.
8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
9. The draw will take place at Proof Research, 48 Wharf Street, Kangaroo Point between 3.00pm – 4:00pm (Brisbane local time) on 10/01/2014. Winners will be notified in writing (email notice acceptable) within two (2) business days of the draw and their names will be published online at www.skygate.com.au on Skygate Ultimate Holiday Competition_Terms and Conditions_2013
17/01/2013. The Promoter’s decision is final and no correspondence will be entered into.
PRIZE
10. The first valid entry randomly selected will win a trip for two (2) adults and two (2) children (between 2 and 11 years) to Nadi, Fiji valued at up to AU$7,300.00 (Prize).
The Prize includes:
(a) four (4) return economy airfare tickets BNE/ NAN /BNE (for 2 adults and 2 children) (Flights);
(b) seven nights (7) accommodation at Sonaisali Island Resort in a Run of House room with Full American Buffet Breakfast for two adults and two kids as well as transfers from Nandi Airport. (Accommodation in Fiji);
(c) luxury transfers to and from Brisbane Airport provided by Black & White Cabs Business Class within the service area for Black & White Cabs Brisbane (Transfers)
11. That part of the Prize that is Flights and Accommodation will be valid until 11/12/2014 subject to availability and nominated black-out periods. That part of the Prize that is Accommodation in Fiji must be taken by 24/12/2014 and is subject to booking availability. If the Prize is taken as a single package (recommended by the Promoter), the Prize must be taken by 11/12/2014 and is subject to booking and flight availability.
12. The voucher for Flights is valid for travel until 11/12/2014. Reservations and ticketing must be done through the Fiji Airways Sydney office at least thirty (30) working days prior to the requested date of departure. Tickets are non- refundable, non-reroutable, non-transferable and have no cash value. Tickets are not valid for travel during Easter and Australian school holidays. Other travel restrictions and blackout periods may apply.
13. The voucher for Accommodation in Fiji is valid to 24/12/2014 for seven (7) consecutive nights’ accommodation including full American buffet breakfast. Reservations must be made at least 60 days prior to the arrival date and are subject to hotel availability. Original voucher must be presented at check-in – copies will not be accepted under any circumstances. Voucher is non- refundable, non-transferable, will not be replaced if lost and has no cash value. The voucher cannot be used in conjunction with any other promotion.
14. Transfers are in the form of a letter entitling the bearer to complimentary travel to and from Brisbane Airport in a Black & White Cabs Business Class taxi up to a maximum value (in total) of AU$250.00. Travel must be within the service area for Black & White Cabs Brisbane. Transfers must be used at time of taking Flights and Accommodation in Brisbane. Letter will not be replaced if lost, is not transferable and has no cash value.
15. Additional spending money, meals, taxes (excluding airline and airport taxes), additional flights, baggage charges, insurance, passports, visas, vaccinations, additional transfers (including airport parking), items of a personal nature, in- room charges and all other ancillary costs are not included. Prize winners and their companions must make their own way to Brisbane, Australia to redeem the Prize. Any and all costs associated with making their own way to Brisbane, Australia are the sole responsibility of the Prize winners and their companions.
16. During the entire duration of a Prize, a nominated parent/guardian must accompany any person under 18 years of age. The Prize winners and their companions must depart from and return to Brisbane Airport, Brisbane Australia and travel together. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The Prize winner may be required to present their credit card at time of accommodation check in.
17. If for any reason the Prize winner does not take the Prize (or an element of the Prize) at the time stipulated by the Promoter, the Prize (or that element of the Prize) will be forfeited and will not be redeemable for cash.
18. In the event the Prize winner is from Brisbane, Australia, the Prize winner will be provided with the opportunity to visit the Brisbane Airport Corporation Pty Limited’s head office, within ten (10) days of the Prize draw, to be presented the Prize.
GENERAL
19. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
20. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
21. Total prize pool value is up to AU$7,300.00. The Accommodation at Sonaisali Resort, Fiji is valued at up to AU$2,550.00. Unless otherwise specified, the Prize (or any part of the Prize) is not transferable or exchangeable and cannot be taken as cash.
22. A draw for any unclaimed prizes may take place on 21/03/2014 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing (email notice acceptable) within two (2) business days of the draw and their names will be published online at
www.skygate.com.au on 29/03/2014. The Promoter’s decision is final and no correspondence will be entered into.
23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
25. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
27. Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter (includingits respective officers, employees and agents)is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
28. As a condition of accepting the Prize, a winner (and their companions where relevant) must sign any legal documentation as and in the form required by
the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
29. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter, Fiji Airways and Sonaisali Island Resort may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending E-Newletters, electronic messages or telephoning the entrant for Brisbane Airport purposes. By entering the promotion, Entrants consent to the use or disclosure of their personal information for this purpose. Entrants should direct any request to opt out, access, update or correct information to the Promoter. The Promoter will comply with these requests within a reasonable period and free of charge to the Entrant.
