“SUBWAY® TENNIS PROMOTION” COMPETITION TERMS AND CONDITIONS:

These terms and conditions of entry, including information on how to participate and prize details (Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.
The Promoter (“Promoter”) is Subway Franchisee Advertising Fund of Australia Pty. Ltd (“SFAFA”) (ABN 21 071 190 317) of Level 1, 42 Amelia Street, Fortitude Valley, Queensland 4006. Whereas SFAFA is the promoter of the Promotion, Ripe Solutions, (“Administrator”) located at: www.ripesolutions.com.au, is running and administering the SUBWAY® TENNIS PROMOTION. Participating SUBWAY® restaurants are listed at: www.subway.com.au (Participating Store).

The Promotion will be open from start of trading at each Participating Store on 06/01/14 and close at 11:59pm (AEDST) on 09/02/14 (Promotion Period)

•All references to dollars or “$” are references to Australian dollars.

•Entry in the Promotion is open to all Australian residents:

aged 18 years and over; and

under 18 years of age, who have obtained their parent or guardian’s consent to enter the Promotion on these Terms and whose parent or guardian have agreed to these Terms,
•excluding:
management, employees, directors and contractors of the Promoter, its related entities or other agencies, firms or companies associated with the Promotion (including suppliers of prizes);
management, employees, directors and contractors of Subway Systems Australia Pty Ltd, Doctor’s Associates Inc., Subway Franchisee Advertising Fund of Australia Pty Ltd, Subway® franchisees and their related entities;
a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraphs 5(c) or 5(d) of these Terms;
persons who have won a prize or prizes valued either individually or collectively at more than AU$5,000 (including GST) from the Promoter, or in any promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period;
persons who have used or attempted to use any more than one name in order to qualify to win a contest run by or on behalf of the Promoter except in the case of a legal change of name; and
persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,
•(Eligible Entrants). The persons referred to in paragraph 5(e) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.

•HOW TO ENTER:

•To be eligible to enter the Promotion, Eligible Entrants must purchase any SUBWAY® sandwich and a Mount Franklin beverage in a single transaction from a Participating Store during the Promotion Period and retain their purchase receipt (Qualifying Purchase).

•To enter the Promotion, Eligible Entrants must then, during the Promotion period visit www.subway.com.au and follow the links to the Promotion entry page located at: www.subway.com.au/tennis.

Existing Subway Eat Fresh® Club members must login, using their log in details, and then;
Indicate what store the Qualifying Purchase was made at;
Indicate the date and time of purchase as per their purchase receipt; and
accept these Terms.


•Non Subway Eat Fresh® Club members must complete the online entry form and include;
all personal details required, including their name, address, contact
•telephone number and email address;
Indicate what store the Qualifying Purchase was made at;
Indicate the date and time of purchase as per their purchase receipt; and
accept these Terms.
• Non Subway Eat Fresh® Club members will have the option to join the Subway Eat Fresh® Club as part of the entry form.
•Eligible Entrants must retain their original SUBWAY® Restaurant purchase receipts for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Eligible Entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the Participating Store of purchase, the date of purchase and that the purchase was made during the Promotion Period but prior to entry.
•Prize Draws
•Computerised random prize draw will be conducted by a representative of SFAFA’s third-party service provider, Anisimoff Legal representative, at Suite 3, Erina Plaza, 210 The Central Coast Highway, Erina, NSW 2250 (Draw Location) at 12:00pm AEDST on 13/02/14.
•The first Eligible Entrant drawn will win the Major Prize (as defined below) and the next one hundred (100) Eligible Entrants drawn will each win a Minor Prize (as defined below).
•All winners will be notified by Anisimoff Legal in writing within two (2) business days of the draw and by telephone and/or SMS using the details provided at the time of entry.
•The first initial, surname and postcode of the Major Prize winner will be published in The Australian on 20/02/14.

This prize is scheduled to take place in late January 2015 to coincide with the 2015 Australian open. The exact dates for this prize are still to be confirmed and will be advised at the time of winner notification.

If the winner is from Victoria, then the prize does not include airfares or airport transfers and the airfare/airport transfer components of the prize are not redeemable for cash. If the winner is from Victoria, they will be responsible for making their own way to the accommodation venue.

This prize must be taken between 25/08/2014 and 08/09/2014 to coincide with US Open (exact dates to be stipulated by the Promoter once the winner is selected).
•Bonus Prize
•If the Major Prize winner is a registered member of the Subway Eat Fresh® Club they will also win AU$2,000 spending money.
•The selected Major Prize must be booked and taken to coincide with the relevant event.
•All components of the selected Major Prize must be taken together as a single trip and cannot be redeemed separately. The winner of the Major Prize and his/her companion/s must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize.
•In the case of each Major Prize option, the Promoter in its absolute discretion will determine the Itinerary.
•The Major Prize winner must hold a valid credit card and present it on check in at accommodation to cover any incidental charges they incur during their stay.
•The Major Prize winner and their nominated travel companion/s must have a valid passport that will have 6 months or more remaining before expiration when they arrive back in Australia from their selected destination (should an international destination be selected).
•Travel and accommodation are subject to availability at the time of booking.
•All costs associated or arising in connection with the Major Prize are the responsibility of the Major Prize winner and their nominated travel companion/s as the case may be, unless otherwise provided in these Terms. Specifically, the Major Prize does not include, and the winner and/or their nominated travel companion/s will be responsible for:
transport to and from the winner’s/companion’s place of residence and the departure airport of initial departure;
any overnight accommodation required by the winner or their nominated travel companion/s while travelling to the departure airport or any other transfers;
any travel, accommodation, insurance costs, meals or spending money not specifically included in these Terms or any other ancillary costs incurred by the Major Prize winner or their nominated travel companion/s in making use of the Major Prize, including but not limited to in-room charges and items of a personal nature; or
any costs associated with any passport, visa, health or other requirements for entry into the Major Prize winner’s nominated destination.
•Penalties may apply to re-booking, amending, extending or cancelling travel and/or accommodation, and are the responsibility of the Major Prize winner and/or their nominated travel companion/s as the case may be.
•The Major Prize winner and their travel companion/s, and their parent or guardian if they are aged under 18 years, are required to sign a release and indemnity agreement in favour of, and in terms determined by, the Promoter and return the document to the Promoter, in order to accept or participate in the Major Prize.
•If the Major Prize winner is under the age of 18 years, the Major Prize will be awarded to their parent or guardian. Supporting identification documents such as drivers licence will be requested for verification of guardian.
•If the Major Prize winner or their travel companion/s is/are under the age of 18 years, they must also be accompanied by a parent or guardian when taking the Major Prize. Any additional cost incurred in order to comply with this condition is the responsibility of the Major Prize winner and/or their nominated travel companions.
•Re-Draw
•If the Major Prize or any Minor Prizes have not been claimed or are forfeited for any reason, a re-draw will take place on 13/05/14 at the same time and place as the original draw, subject to any directions from a regulatory authority.
•The re-draw winners, if any, will be notified in writing within two (2) business days of the draw and by telephone and/or SMS. In the event the Major Prize is awarded in the re-draw their first initial, surname and postcode will be published in The Australian on 22/05/14.
•Verification
•The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
•Provisional winners will be required to send the following items via mail to a reply paid address nominated by the Promoter, within a time period determined by the Promoter,
their original purchase receipts for all entries as proof of purchase; and
copies of appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm their identity, age, residential address, eligibility to enter and claim a prize, that they are an Eligible Entrant and have complied with these Terms and any information submitted by the Eligible Entrant in entering the Promotion,
•in order for the Promoter to validate the Eligible Entrant’s winning entry. The Promoter recommends that such provisional winners send the items referred to in this paragraph via registered mail, however this is not a condition of claiming a prize, and any cost to do so, if the winner chooses to, will be the responsibility of the winner.
•If more than one person attempts to claim a particular prize, the Promoter has sole and absolute discretion to determine which of those persons is the winning Eligible Entrant.
•General
•Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
•The total prize pool available to be won in the Promotion is up to AU$52,500 (including GST).
•Each purchase receipt is valid for one (1) entry only; unless the receipt indicates more than one qualifying purchase was made in the one transaction.
•Multiple entries permitted, subject to the following:
•(a) only one (1) entry permitted per specified purchase requirement;
•(b) each entry must be submitted separately and in accordance with entry requirements;
•(c) unrecognised purchase receipts will be deemed invalid.
•A maximum of one (1) prize may be won per Eligible Entrant, except where the Eligible Entrant is a South Australian resident.
•There is a limit to the number of invalid entries that may be submitted by Eligible Entrants in attempting to enter the Promotion. The Promoter may at its absolute discretion block and or disqualify Eligible Entrants from submitting further entries in the Promotion where they have reached the limit of ten (10), as determined by the Promoter.
•Eligible Entrants can only enter in their own name.
•Prizes are not transferable, exchangeable or redeemable for cash. Prizes must be taken as offered and may not be varied.
•The Promoter accepts no responsibility for any variation in the value of prizes.
•If the Promoter is unable to provide a winner with the nominated prize, the Promoter reserves the right to supply an alternative prize of equal or greater monetary value to the nominated prize, subject to any written directions given by State or Territory gaming departments.
•The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. Entries will be deemed to be accepted at the time of receipt and not the time of transmission. No responsibility will be taken for lost, stolen or damaged purchase receipts or late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
•If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to State and Territory regulations, including cancelling, terminating, modifying or suspending the Promotion or disqualifying an entrant.
•Any Eligible Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanisms, draws or purchase receipt in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win. Prizes will only be awarded where the winner’s purchase receipt fulfils all of the requirements of the Promoter’s verification tests and procedures, where the tests and procedures are determined by the Promoter at its absolute discretion.
•Incomplete, indecipherable, illegible or incorrect entries, entries which are not in the required format or which contain offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
•Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render entries submitted by an Eligible Entrant using such means invalid.
•The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. Failure by the Promoter to enforce any of its rights under these Terms at any stage does not constitute a waiver of those rights.
•The Promoter’s decisions in relation to all aspects of the Promotion are final and binding on each Eligible Entrant and no correspondence will be entered into.
•By entering into the Promotion, the Eligible Entrant agrees and consents to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for the period of the Promotion without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

The SUBWAY® TENNIS PROMOTION Privacy Statement located at: www.subway.com.au/tennis describes, among other things, the types of Personal Information the Administrator and/or Promoter , may collect from Participant, how Participants Personal Information may be used, when Participants Personal Information may be shared, who Participants Personal Information may be shared with, and how the Administrator and/or Promoter , protects Participants Personal Information when Participant registers for the Sweepstakes online. •.Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

By entering this Promotion, the Entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty, in addition to any claims with respect to the acceptance, use or misuse of the prizes.
