Terms & Conditions

    Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
    Entry is open to Australian residents aged 18 years or over, excluding any individuals who reside in a dry area/zone where possession and/or consumption of alcohol is prohibited. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
    Promotion commences at 12:01am AEDST on 01/11/2013 an entries close at 11:59pm AEDST on 19/05/2014 (“Promotional Period”).
    The Promotional Period will be divided into twelve (12) entry periods, as detailed in the table below (Entry Periods). All times listed in the table are AEDST.

    To enter, individuals must complete the following steps (during the Entry Period they wish to be entered into)Surprised):

        visit the Casella Wine Facebook Page at https://www.facebook.com/yellowtail?fref=ts (“Facebook Page”) using a desktop computer, laptop or mobile device capable of accessing the internet;
        select the ‘like’ button on the Facebook Page (if not done so already);
        follow the prompts to the ‘Discover Your Colour’ promotional tab (once clicked this will re-direct the individual to the promotional webpage www.discoveryourcolour.com);
        confirm date of birth;
        input the requested details including the answers to a series of multiple choice questions. Once the multiple questions have been answered the individual will be given a colour for a Yellow Tail Wine as well as a travel destination that best matches them as an individual (out of New York, USA; Paris, France; Rio De Janeiro, Brazil; Costa Rica; or Maldives), based on the answers provided to the multiple choice questions;
        the individual must then, answer the question “What is your favourite yellowtail wine and why?” in 25 words or less; and
        submit the fully completed online entry form.
    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    Incomplete or indecipherable entries will be deemed invalid.
    Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.
    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
    The judging for each Entry Period will take place at Casella Wines Pty. Limited, Unit 506 – 510, 460 Pacific Highway, St Leonards NSW 2965 and commence on the dates specified in the table above. The winners will be notified by telephone and mail. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit of the answer provided to the promotional question. The Promoter’s decision is final in relation to all aspects of this promotion and no correspondence will be entered into.
    The best valid entry in each Entry Period as determined by the judges (“Finalists”), will each win one (1) case (12 x 750ml bottles) of Yellow Tail Wine valued at up to $120 depending on the colour of Yellow Tail Wine awarded. The colour of Yellow Tail Wine awarded will be based on the colour revealed to the Finalist at the time of submitting their winning entry.
    At the end of the Promotional Period, the Promoter will re-judge the Finalists’ entries (against each other) and the overall best valid entry, as determined by the judges, will win the major prize (“Major Prize Winner”).
    The Major Prize Winner will win a trip for two (2) adults to the destination that was revealed to them at the time of submitting their winning entry (“Major Prize”), being either:
        New York, USA;
        Paris, France;
        Rio De Janeiro, Brazil;
        Costa Rica; or
        Maldives
    The Major Prize is valued at up to AU$20,000 depending on destination, date and point of departure. The Major Prize includes:
        two (2) x return economy airfares from the winner’s nearest capital city of Brisbane, Sydney, Adelaide, Perth or Melbourne to the destination revealed at the time of submitting their winning entry. The winner and their companion must make their own way to their nearest out of the nominated departure airports at their own cost ; and
        six (6) nights twin share minimum 4 star accommodation at the relevant destination (with the exact hotel chosen by the Promoter in its discretion).
    Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 30/06/2014 and is subject to booking and flight availability.
    The Major Prize Winner and their companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.
    The Major Prize Winner (and their companion) must depart from and return to the same departure point and travel together from their nearest capital city of Brisbane, Sydney, Adelaide, Perth or Melbourne. Frequent flyer points will not form part of the Major Prize. The Major Prize is subject to the standard terms and conditions of individual prize and service providers. The Major Prize Winner may be required to present their credit card at time of accommodation check in.
    Subject to the terms and conditions of the participating prize provider(s), if for any reason the Major Prize Winner does not, once the Major Prize has been booked, take the Major Prize (or an element of the Major Prize) at the time stipulated, then the Major Prize (or that element of the Major Prize) will be forfeited and will not be redeemable for cash.
    If for any reason any winner does not take a prize or an element of a prize at/by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
    In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.
    If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
    Total prize pool value is up to AU$21,440. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless stated otherwise.
    As a condition of entering this promotion, each entrant licenses the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
    Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
    Any cost associated with accessing the Internet is the entrant’s responsibility and is dependent on the Internet service provider used.
    The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy.
    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use/taking of a prize.
    As a condition of accepting a prize, each winner (and his/her companion where applicable) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
    The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
