TERMS AND CONDITIONS
By entering The Herald and Weekly Times Pty Ltd’s ‘The Weekly Times Seymour Alternative Farming Expo’ competition, you are agreeing to the following Terms and Conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the Terms and Conditions. Entry into the competition is deemed acceptance of these Terms and Conditions.
1. WHO CAN ENTER
2.1 Subject to clause 2.3, entry is only open to Australian residents.
2.2 All entrants under the age of 18 must obtain the prior permission of their legal parent or guardian over the age of 18 to enter. The parent or guardian of the entrant must read and consent to all Terms and Conditions. The parent or guardian may be called to verify consent and may be required to sign a release at the discretion of the Promoter. The release will require the winner’s parent or guardian to accept responsibility for the acts and forbearances of the winner. The release will include the full name, address and telephone number of the winner’s legal guardian. Failure to provide such proof, particulars or releases will immediately invalidate the winner’s entitlement to the prize, subject to State and Territory legislation. If the competition winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian.
2.3 Directors, management, employees and their immediate families of the Promoter and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3. HOW TO ENTER
3.1 The competition will be conducted from 12.01am AEST on the 5th of February 2014 to 11.59 pm on the 10th of February 2014 inclusive (“the Competition Period”).
3.2 To enter the competition, eligible entrants must during the Competition Period, write their name, address and telephone number and describe in 25 words of less what you are most looking forward to at the event on the back of an envelope addressed to:

3.3 The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.
3.4 Incomprehensible, indecipherable or incomplete entries will be deemed invalid.
3.5 If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
4. HOW TO WIN
4.1 Entries will be judged by The Weekly Times at 10am on the 11th of February 2014 at L 10, HWT Tower, 40 City Road, Southbank VIC 3006. The twelve most creative entries will win.
4.2 The prize winner will be notified by phone (within two (2) days of judging) and his or her name will be published online at
www.weeklytimesnow.com.au on the 12th of February 2014.
4.3 The Promoter’s decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding the result.
4.4 Entries not completed in accordance with these Terms and Conditions will not be considered valid.
4.5 The Promoter reserves the right to request that the winner provides proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bills) in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
4.6 The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process. An entrant who submits an entry that is not in accordance with these Terms and Conditions, or who has, in the opinion of the Promoter, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
4.7 In the event the prize is unclaimed, a secondary judging may take place on the 13th of February 2014 at the same time and place as the original judging. The winner, if any, will be notified by phone within two (2) days of the draw and his or her name will be published at
www.weeklytimesnow.com.au from the 14th of February 2014.
5. PRIZE
5.1 The twelve most creative entries will win the prize below.
5.2 Each prize consist of a single day family pass to the Seymour Alternative Farming Expo Prize which provides entry to the event for two adults and up to three children valued at $40 each.
TOTAL PRIZE POOL VALUED AT UP TO: $480.00
5.3 Prizes are not exchangeable and cannot be taken as cash. Any additional charges such as spending money and travel are the responsibility of the winner. The Promoter accepts no responsibility for any variation in the prize value.
5.4 If the winner or his or her companion, for whatever reason, are unable to participate in a prize which is restricted to a specific date, or do not take an element of the prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and his or her companion. Cash will not be awarded in lieu of the prize or element thereof.
5.5 If the prize or any part of the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
5.6 By submitting an entry into the competition a participant is deemed to acknowledge and agree that the prize may be subject to additional terms and conditions imposed by third parties. The Promoter does not accept any responsibility and is not liable for additional conditions imposed by third party, or for the breach of those conditions by any person.
5.7 Subject to the unclaimed prize clause, if for any reason a winner does not take the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
6. NO LIABILITY
6.1 If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.
6.2 In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the competition or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
6.3 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
6.4 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize / participation in a prize.
6.5 The winner and his or her companion acknowledge that they participate in the events that form part of the prize at their own risk. If the winner or his or her companion become aware of any medical condition or impairment that will be detrimental to their health if they participate in the events that form part of the prize they must withdraw from those events.
6.6 The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
7. PRIVACY CONSENT
7.1 HWT, as the Promoter of this competition, collects information about competition entrants, including for example their name and contact details which they provide when registering or using our services as well as information from other sources. We collect and use that information to provide you with our goods and services and to promote and improve our goods and services. We may share your information with our related companies and any of us may be in contact for those purposes. We may also use your information as described when we collect information from you. If you do not provide us with requested information we may not be able to provide you with the goods and services you require. We disclose your information to our related companies, service and content providers, including those located outside Australia. Where you have entered a competition, we may disclose your personal information to authorities if you are a prize winner or otherwise as required by law. All entries become the property of the Promoter upon their submission. By entering the competition, a participant irrevocably assigns the copyright in their entry to the Promoter.
