1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoter is Colonial First State Property Management Pty Ltd (ABN 96 101 504 045), as disclosed agent for the owners of the Centre, at Corporate Office, 1341 Dandenong Road, Chadstone Victoria 3148, telephone: 03 9936 1222 (“Promoter”).
3. Entry is only open to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter, and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
4. Officers, management and employees (and their immediate families) of the Promoter, the Promoter’s associated companies and contractors, participating retailers and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. The promotion will be conducted at the shopping centre whose name and address is listed in A.1 (“the Centre”) from the start date listed in A.2 until close of business on the close date listed in A.3 (“Promotional Period”).
6. To be eligible to enter, individuals must make a purchase of the minimum spend amount indicated in A.4, in one transaction, at any participating retailer at the Centre during the Promotional Period (“Qualifying Spend”). The Qualifying Spend may include purchases of gift card(s). Transactions undertaken at major retailers such as department stores and supermarkets are ineligible. For a full list of participating retailers see the Centre’s website, the Customer Service Desk or the Centre Management Office.
7. To enter, individuals must then complete the following steps the same day the Qualifying Spend was made:
a) present their original purchase receipt for the Qualifying Spend to a representative at the Customer Service Desk.
Centre Management Office or promotion information booth of the Centre on the same day of the Qualifying Spend;
b) complete the official entry form featured on an iPad or provide details to customer service representative at the Customer Service Desk with all of the requested details (including their full name, postcode and suburb of residence, their mobile telephone number or a valid email address), opting-in to become a VIP member of the Centre is optional;
and
c) submit the fully completed entry form.
8. Incomplete, indecipherable or illegible entries will be deemed invalid.
9. The Centre will conduct a game activation within the Centre between 10am and 2pm AET (local time) each day during the Promotional Period. Promotional Staff or Customer Service Representatives will invite members of the public to play the Laughing Clowns carnival game where customers are required to accumulate number combinations which will determine being a winner. Winning number combinations are restricted to 8, 10, 12, 14, 16, 20, 24 and 26 conclusively to qualify for an Instant Win Prize. All other possible number combinations are non winning combinations.
10. To redeem their Instant Win Prize, promotional staff or customer service representatives will invite winners of the game activation (from clause 9) to play a digital game on an iPad, which will require them to select one (1) item on screen within the game. Once the item is selected, the base of the item selected will be shown on screen revealing a prize. The prize revealed to the entrant is the Instant Win Prize that the entrant will receive. All entrants that play the digital game are guaranteed an Instant Win Prize. Limit one (1) game play permitted per person per day.
11. Limit of one (1) entry is permitted per Qualifying Spend (excludes entrants who are already a VIP member of the Centre or sign up to become a VIP member of the Centre at the time of entry, who will receive two (2) entries per Qualifying Spend). Individuals must enter in accordance with the entry requirements.
12. Entrants must provide their original purchase receipt(s) at the Customer Service Desk, Centre Management Office or promotion information booth as proof of purchase. Purchase receipt(s) must clearly specify the store(s) of purchase. Failure to produce the proof of purchase may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize.
13. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. The Promoter may for this purpose request identification (in the form required by the Promoter) in order to claim a prize. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
14. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
15. There will be one (1) draw conducted for the entries received each day of the Promotional Period for a total of seven (7) draws, (“Daily Draws”), and there will be one (1) draw conducted for all entries received during the Promotional Period (“Major Draw”). Entries into each Daily Draw will open and close each day based on the opening hours of the Centre. Entries in each Daily Draw will NOT be entered into any subsequent Daily Draw(s), however, all entries (including the Daily Draw winners) will be entered into the Major Draw.
16. All draws will take place at the Promoter’s head office; 1341 Dandenong Road, Chadstone, VIC 3148. Each Daily Draw will take place at 11am AEDST on the business day after entries close for that Daily Draw, with the first Daily Draw taking place on the date listed in A.5 and the last Daily Draw taking place on the date listed in A.6. The Major Draw will take place at 11am AEDST on the date listed in A.7. For the removal of doubt, no draws will be conducted during the weekend or on a public holiday in Victoria.
17. Draw winners will be notified via email or phone within two (2) business days of the relevant draw. Instant Prize winners will be notified immediately on-screen on completion of digital game play. The Major Prize winner’s name will be published on the Centre’s website on the date listed in A.8. Winners’ details may also be published on the Centre’s Facebook Page.
18. Instant Win Prizes: The number, type and value of instant win prizes available to be won in this Centre are as outlined in Annexure A. All instant win prizes are subject to any terms and conditions printed on the voucher (prize).
19. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
20. The Promoter’s decision is final and no correspondence will be entered into.
21. The first valid entry drawn in the Major Prize Draw will win the prize indicated in A.9 valued at $1,000.
22. The first valid entry drawn in each Daily Draw will win the prize indicated in A.10 valued at $100.
23. All vouchers awarded must be redeemed at the Centre. Any ancillary costs associated with redeeming any of the vouchers are not included. Any unused balance of a voucher will not be awarded as cash. Redemption of any voucher is subject to any terms and conditions of the issuer including those specified on the vouchers. In the event that a gift pack is won, the exact contents of the gift pack will be determined by the Promoter in its absolute discretion.
24. If for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
25. If any prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
26. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
27. If a winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
28. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
29. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
30. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw.
31. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
32. A draw for any unclaimed prizes (including any unclaimed instant win prizes) may take place on the date indicated in A.11 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two (2) business days of the draw. In the event the Major Prize is awarded in the unclaimed prize draw, the winner’s name will be published on the Centre’s website on the date indicated in A.12.
33. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act orsimilarconsumer protection laws in the States and Territories of Australia (“Non-Excludable
Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
34. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking and/or use of a prize.
35. As a condition of accepting a prize, each winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
36. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.cfsgam.com.au/au/property/What_We_Do/Asset_Management/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter. Entrants’ PI will not be disclosed to any entity outside of Australia.
