Ride Smart Promotion: Conditions of Entry
The Promoter is the Transport Accident Commission of 60 Brougham Street, Geelong VIC 3220.
By entering this 'Ride Smart Promotion' (Promotion), you (the entrant) are deemed to accept these Conditions of Entry. Information on how to enter the Promotion and prizes form part of these Conditions of Entry.

Entry is only open to residents of Victoria aged 18 years and over and holding a current Victorian motorcycle learner's permit or motorcycle licence at the time of submitting their entry. Employees (and their immediate families) of the Promoter or any of its agents or contractors directly connected with this Promotion are not eligible to enter. By entering the Promotion, each entrant warrants to the Promoter that he or she is eligible to enter based on these Conditions of Entry.

The Promotion commences at 12.00am Australian Eastern Standard Time (AEST) on 12 April 2014 and closes at 11.59pm AEST on 11 July 2014 (Promotion Period).

To participate in the Promotion, entrants must register their details at ridesmartonline.com.au (Promotion Website) and follow the prompts to complete all exercises in the relevant modules of the main program (Observe, Self Defence on the Road and Keeping Control on the Road) and/or the refresher program. There will be one draw for completion of each module in the main program and one draw for completion of the refresher pack, 4 competitions in total. To be eligible for each competition, participants must complete all exercises in the relevant modules in the main program and/or complete all exercises in the refresher pack.

Upon completion of each module in the main program and/or the refresher pack, entrants will automatically be entered into the relevant draw/s to win a $300 voucher for motorcycle protective clothing. Four draws to determine the winners (one winner per draw) will be conducted on 14 July 2014 at 60 Brougham Street, Geelong, Victoria. Participants could be eligible for up to four draws only, depending on how much of Ride Smart they complete. Relevant exercises must be completed by 11:59pm on the Friday before that draw.

The winning entry for each draw will be the first entry drawn randomly. The Promoter will contact each winner by email (using the email address included in the entry). In the email, the Promoter will request the winner's address for the purpose of mailing the prize to the winner. Prizes will be delivered to winners by registered post. The Promoter is not responsible for any delay in delivery caused by any third party.
If a winner does not provide their address for delivery of their prize to the Promoter within two weeks of the email being sent, their entry will be deemed invalid and they will lose their entitlement to the prize.

The Promoter reserves the right to draw 4 additional reserve entries per draw and to record them (in order drawn) in case an invalid entry or ineligible entrant is drawn as a winner or the winner is unable or unwilling to accept or participate in the prize. If that occurs, the Promoter will award the prize to the first reserve entry drawn. If the prize cannot be awarded to that entrant, the Promoter will continue the process with the remaining reserve entries until each prize is awarded.

Entry is limited to one entry per person. There is no cost to enter the Promotion. Entrants may only enter in their own name. Entrants who provide incorrect, fraudulent or misleading information are ineligible to participate and their entries will be deemed invalid. The Promoter reserves the right to verify the validity of entries. No responsibility is accepted for late, lost or misdirected entries.

Total prize pool is valued at A$1,200. Vouchers are not transferable and cannot be taken as cash. Vouchers are issued subject to any conditions of the store from which the voucher is issued. The Promoter accepts no responsibility for any variation in the prize value. If the prize is not available for any reason, the Promoter reserves the right to substitute the prize with another prize of equal or greater value.

The Promoter (including its employees, agents and contractors) is not liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss including loss of opportunity) or for personal injury (including death) suffered or sustained in connection with participating in the Promotion or accepting and using any of the prizes, except for any liability which cannot be excluded by law. To the extent permitted by law, the Promoter's liability that is not otherwise excluded by this condition is limited to the amount of the total prize pool, as specified in condition 11.

Entries in this Promotion are transmitted over the internet. Entrants acknowledge that although encrypting precautions are taken, the internet is not a secure medium and that the Promoter is not responsible for the security of entries.
The Promoter is not responsible for any difficulties caused by technical errors or malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, technical problems or traffic congestion on the internet or at any web site (including the Promotion Website), or any combination of these that may occur in the course of the administration of this Promotion. The Promoter accepts no liability for any injury or damage to entrant's or any other person's computer related to or resulting from participation in, downloading or transmitting any materials in this Promotion (except for any liability that cannot be excluded by law). The Promoter is not responsible for any delay or failure in delivery of entries, including problems in completing the exercises or transmission of completed exercises required to enter this Promotion.
If for any reason this Promotion is not capable of running as planned or is interfered with in any way, including as a result of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who has tampered with the entry process, or, subject to any written directions received from a regulatory authority, to cancel, terminate, modify or suspend the Promotion.

The Promoter is required to comply with the Information Privacy Principles in the Information Privacy Act 2000 (Vic). Entrants may view the Promoter's privacy policy at http://www.tac.vic.gov.au/jsp/corporate/privacy/privacy.jsp. Entrants may gain access to, update or correct any personal information held by the Promoter by contacting the TAC's Information Privacy Officer on 1300 654 329 or 1800 332 556.
The Promoter collects personal information about entrants for the primary purpose of including the entrant in the Promotion and, where appropriate, awarding a prize. By submitting an entry, an entrant consents to the use and disclosure by the Promoter (and its employees, agents and contractors) of any personal information (including sensitive information) that is collected by the Promoter as part of, or in the course of administering, the Promotion to third parties for the purpose of:
conducting and evaluating the Promotion (including to confirm with VicRoads that the entrant holds a valid motorcycle permit or licence);
communicating with the entrant;
obtaining feedback about the Promotion for evaluation purposes;
exercising the Promoter's rights under these Conditions of Entry (including the right to publish the names of winners); and
if the entrant consents when entering the Promotion by ticking the appropriate box on the entry form, sending the entrant further information about TAC safety initiatives or for other research, survey or educational purposes including to contact the entrant in the future for such purposes or to provide the entrant with marketing materials.
If personal information requested is not provided (with the exception of any information marked "optional"), the entrant is deemed ineligible and may not participate in the Promotion.
The Promoter reserves the right to vary these Conditions of Entry at any time during the Promotion Period. Any variation will be published at the Promotion Website.
Subject to any laws governing this Promotion, any decision of the Promoter about this Promotion is final and no correspondence will be entered in to.
