Competition Terms
Information on how to enter the competition and information about the prizes form part of these terms. By entering the competition, you accept these terms.
Eligibility
1 To be eligible to enter you must:
(a) be an Australian resident;
(b) if you are under 18 years of age, you must have a parent or guardian approve your entry and agree to these terms; and
(c) not be our employee or an immediate family member of our employee (or an employee of an agency associated with the competition).

(d) complete your details, including first name, last name, post code, phone and e-mail;
(e) click on the green submit button.
5 Entries must be received between 12:01AM (AEDT) on 15/05/2014 and 11:59PM (AEDT) on 04/06/2014. Entries are deemed to be received at the time they are received by us (and not at the time you submit the entry).
6 Entries are limited to one for each household.
7 Upon receipt by us, entries become our property.
Selecting winners
8 We will select one (1) winner, and one hundred (100) follow up winners on 07/06/14 at 12 – 14 Thompson Road, Geelong North 3215.
Entering
(in our absolute discretion):
verify entrant’s identity and the validity of entries;
disqualify entrants who submit an entry that is not in accordance with these terms or who tampers with the entry process;
disqualify entrants who enter using multiple aliases;
accept entries that contain errors or omissions;
deem incomplete, plagarised, defamatory or indecipherable entries invalid; and
require parents or guardians of entrants who are under 18 years of age to provide written evidence of their approval of the entrant entering the competition and agreeing to these terms.
enter the competition:9 The competition is based on a game of skill. Winners will be selected from the pool of eligible entries which comply with these terms and demonstrate creativity and originality (as determined by us in our absolute discretion). We will award a prize to each of the selected winners.
Awarding the prize
10 The prize is a Justice League Super Hero Party at your home, this includes Justice League characters, a Justice League Cake and Justice League gift pack. The characters will be at the party for a maximum of three (3) hours and can play party games, take part in photos and present the cake, valued at $4000.00 (including GST). 100 runners will receive Justice League Colouring Book (total value $695) The total prize pool is valued at $4,695 (including GST).
11 The winners will be notified by telephone or e-mail on the day of selection. The winners must respond within 3 days after notification to claim their prize.
12 The runners up should allow twenty-eight (28) days for us to mail the prize to the mailing address provided by you upon notification. We are not liable for any loss, expense, damage or liability suffered or incurred by a winner as a result of providing an incorrect mailing address provided by you upon notification.
13 Prizes cannot be taken on Public Holidays.
14 Prize is valid for 12 months from date 07/06/2014 winner is drawn.
15 Characters are subject to availability on date chosen for party by winner.
16 Prize is valid for all states with a maximum travel time of five (5) hours from the nearest capital city.
Alternative winners
17 If a winner fails to claim their prize within 3 days after notification, we will select an alternative winner and award the prize in accordance with the procedures specified above on 07/06/14 and we will notify the winner and dispatch the prize in accordance with the procedures specified above. If the alternative winner fails to claim their prize within 3 days after notification, we may (in our absolute discretion) retain the prize and are under no obligation to find a further alternative winner.
18 The prize is not transferable or exchangeable and cannot be taken as cash. If a prize is not available, we may (in our absolute discretion) substitute that prize for another item of equal or higher value as determined by us (in our absolute discretion).
Changing the competition
19 If the competition is not capable of running as planned, including by reason of misdirected entries, tampering, unauthorized intervention, fraud, technical failure or any cause beyond our control, we may (in our absolute discretion) cancel, terminate, modify or suspend the competition or invalidate any affected entries.
Liability
20 We (and our officers, employees and agents) are not liable for any loss, expense, damage or liability suffered or incurred by you in connection with the competition, including:
(a) any late, lost, incomplete, incorrectly submitted, delayed, illegible or misdirected entries;
(b) any technical difficulties or equipment malfunction;
(c) any theft, unauthorised access or interference by another person;
(d) any entry or prize claim that is late, lost, altered, damaged or misdirected;
(e) any variation in prize value to that stated in these terms;
(f) any tax liability incurred by you;
(g) use of, or taking of, a prize; or
(h) participation in the competition.21 Nothing in these terms limits, excludes or modifies the statutory consumer guarantees or implied warranties under the Competition and Consumer Act 2013 or similar state legislation.
Privacy
22 Collecting personal information: When you enter the competition or if you are selected as a winner and awarded the prize, we collect your personal information, such your first name, last name, postcode, phone and e-mail. Without your personal information, we may not be able to effectively run the competition, select winners and award the prizes. If you wish to access, update or correct your personal information or obtain a copy of our privacy policy, please contact us on 1800 814 788. While we work hard to ensure your personal information is safe and secure, we are not responsible for any unauthorised access to, and disclosure of, your personal information. Nothing in these terms limits, excludes or modifies our obligations under the relevant privacy legislation.
23 Using your personal information: We do not use your personal information for any other purpose, except to run the competition, select winners and award the prizes, as well as to market and promote other products and services which may be of interest to you. If you do not wish to receive marketing and promotional material from us, please contact us on 1800 814 788 or select “unsubscribe” on the marketing and promotional material. We do not sell or rent your personal information to another person for their own marketing and promotional purpose, without your express consent.
24 Disclosing your personal information: We may provide your personal information to our services providers, some of whom may be located outside Australia, who assist us with our business, including prize suppliers, data processing, data analysis, online computing, contact centre, legal, accounting, business consulting, auditing, archival, delivery and mailing services. While we believe our service providers also work hard to ensure your personal information is safe and secure, we are not responsible for their conduct. We may disclose your personal information for the following purposes:
(a) responding to lawful information requests from courts, government agencies and lawyers;
(b) investigating and dealing with suspected fraud and unlawful activity;
(c) protecting our lawful interests; or
(d) in the process of a sale or purchase of us or our business.
Right to use name and likeness
25 If you are selected as a winner, you grant us the right to use (and to license others to use) your name and likeness to market and promote the competition, us or our business, without royalty, payment or other compensation. If you do not wish to grant us the right to use (and to license others to use) your name and likeness to market and promote the competition, us or our business, please contact us on 1800 814 788.
Parents and guardians
26 If you are a parent or guardian of an entrant who is under 18 years of age, you:
(a) must approve entry of that entrant and agree to these terms;
(b) guarantee that the entrant has complied with these terms;
(c) warrant that the entrant’s work is original and their own; and
(d) are jointly and severally liable with the entrant for any loss, expense, damage or liability suffered or incurred by us in connection with a breach of these terms by you or the entrant.
