Your Chance to win a Herb Faust Dining Experience

Competition Conditions of Entry

‘The Entrant’ means the person who has agreed to participate in this competition in accordance with these terms and conditions;

‘The Promoter’ means Brownes Foods Operations Pty Ltd (ABN 60 146 849 881), 22 Geddes St, Balcatta WA 6021; and

‘Competition Period’ means 12:01am on 14 April 2014 until 11:59pm on 14 July 2014

    Instructions on how to enter and other details contained within promotional advertisements form part of the Terms and Conditions. By participating in this promotion, Entrants shall be deemed to agree to abide by these Terms and Conditions. Entries not completed in accordance with these Terms and Conditions are ineligible.
    Entry is open only to Australian residents aged 18 and over.
    All management and employees of the Promoter and their immediate families, and all retailers and agents of the Promoter are not eligible to enter. Employees and officers (and their immediate families) of the Promoter or of any agencies or companies associated with this competition are ineligible to enter.
    The competition begins at 12:01am on 14 April 2014 and closes at 11:59pm on 14 July 2014 (‘the Competition Period’).  The Ultimate Dining Experience will take place at the winners home on Saturday 26 July 2014.  The winner’s home must be located in metro Western Australia.
    To enter, entrants must, during the Competition Period:
        Purchase any West N Fresh product from participating stores (while stocks last) and retain proof of purchase;
        Go to www.facebook.com/WestnFresh
            The entrant must enter the unique Club Fresh Code as it appears on the pack.
            The Entrant may enter multiple times, but if a winner, Entrant must present 1 Proof of Purchase promotional tub with corresponding unique code as entered to the Promoter.
            On 16 July 2014 the Winner will be drawn at 22 Geddes St Balcatta.
            On 16 July 2014 the Winner will be notified by email and/or telephone.
            If the winner is not contactable a second winner will be drawn, and so on until the winner is confirmed.
    6)The judges’ decision in relation to the winning Entrant for the prize will be final. The Promoter will not be required to enter into any correspondence with any Entrant or other person with respect to such judge’s decision for the prize draw. The Entrant may attempt to win a prize as many times as desired.
     The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants are responsible for their own costs associated with accessing the Internet.
    The Promoter disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, email, courier, express, electronic transmission, or other delivery method.
    By participating, each participant and winner waives any and all claims of liability against the Promoter, its employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the giveaway, or from the use of any prize.
    There is 1 Herb Faust Dining Experience to be won, valued at $2,500.00 (incl. GST)
    The Winner will win a Herb Faust Dining Experience for 10 people in the winners home comprising of the following:
        An in-home dining experience for 10 people, in the comfort of your own home.
        A 5 course seasonal degustation menu
        Food will be prepared exclusively by Herb Faust, the only winning contestant from Channel 7's series of Iron Chef Australia.
        All crockery, cutlery, napkins, printed menus, and a wait-person for the service of your food are included.  Drinks and glasswear will need to be supplied by the Winner.
        Allergies and dietary requirements are happily and creatively accounted for.
    Any valuation of the prize(s) stated above is based on available information provided to the Promoter, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes. The prizes are not transferable, exchangeable or redeemable for cash. The Promoter accepts no responsibility for any variation in prize value. If a prize is unavailable for any reason the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant gaming authorities, if required.
    13)The Promoter reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the giveaway, or obtained winner status using fraudulent means. Further, the Promoter will resolve any disputes, conflicting claims or ambiguities concerning the rules and the Promoter's decisions concerning such disputes shall be final. All decisions will be made by the Promoter and are final. The Promoter may waive any of these rules in its sole discretion.
    The Winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
    If the winning Entrant is deemed not to comply with these conditions of entry, their entry will be discarded.
    The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
    Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
    The Promoter may require entrants to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
    The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person.
    If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorized intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities, if required.
    All entries and Facebook correspondence between Promoter and Entrant will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address provided at the top of the Conditions of Entry.
    The Promoter makes no representations or warranties as to the quality, suitability or merchantability of the goods offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury however caused including, but not limited to, by the negligence of the Promoter, suffered by the Entrant, the Entrant’s parent or guardian, or any other person relating to the use, non-delivery or non-useability of a prize. The Promoter accepts no responsibility for any variation in the prize value of the prizes in this competition. Any picture used to depict prizes is for illustration purposes only and not representational of the prizes to be won.
